Reynolds Jr., Administrative Services Manage DATE: July 11, 1995 (CC Mtg. 07/19/95) SUBJECT: Consider Bid Solicitations for Play Equipment at Mountain Meadows ParrooippARlc, CALIFORNIA City Council Meeting SUMMARY of t%/-2- 199,E ACTION: apiginkCr Staff is presenting the draft bid solicitation and specifications for the installation of playground equipment at Mountain Meadows Park for the Council's consideration. This equipment is proposed to be purchased by the Community Development Block Grant ("CDBG") as pit • - ' removal of architectural barriers at this park. BACKGROUND During the annual CDBG hearing in March of this year, the Council appropriated $25,300 of surplus monies from the First Street Improvement project for the removal of architectural barriers at Mountain Meadows Park. It was described to the Council that removing architectural barriers to persons with limited mobility and replacing these barriers with facilities that provide access to these same persons, is an eligible use of CDBG monies. It was also described to the Council that the project would be completed in three steps: 1) staff to remove the existing barriers; 2) a qualified company will purchase and install new equipment and related safety surface materials at the park, and; 3) if sufficient funds remained, a sidewalk of approximately fifteen feet in length will be completed between the existing sidewalk adjacent to Mountain Meadows Drive and the play area. DISCUSSION Staff has been working on this project since April, 1995, by completing the needed revisions to the HUD grant application and the required environmental work, and presenting the proposed project to the Parks and Recreation Commission for consideration. The grant changes and environmental approval were received two weeks ago. Attachment "A" is staffs report to the Parks and Recreation Commission which became the design specifications for the equipment in the bid document provided as "Attachment "B", (Attachment "B" is available on the Council's desk for consideration). The Commission specifically reviewed equipment and safety surfaces designed by one manufacturer for each, however, the bid specifications will present a more general description of the materials needed. Staff anticipates that the more general description will open the bid process 000074 • • to the satisfaction of the federal procurement provisions, as well as provide the City with more options to select from when making the final selection. This project is somewhat unique however, because new existing equipment is in place and will not be removed, which narrows the project and the specifications close to being a "sole source" selection, (if the new and existing equipment are to match). Nonetheless, HUD prefers that "sole source" be determined by the open bid process, rather than by staffs interpretation of needs. Staff has confirmed with the County that two significant CDBG regulations apply to this project. The first is the open bidding/procurement policy and the second is enforcement of the federal prevailing wages. The attached bid document allows for the proper bid solicitation process, includes the special federal provisions, and the most current prevailing wage document. The bid document only addresses the procurement and installation of the playground equipment and the safety surface. As proposed, CDBG will reimburse the City directly for its actual expenses to complete the removal of the barriers and installation of sidewalks. Federal prevailing wage requirements (Davis Bacon) and the procurement provisions are not applicable to in-house work at this funding level. The Davis Bacon requirements do apply to the installation of the equipment. However, this work will last less than one week. Staff does not expect there to be sub-contractors or other related complications that can make the Davis Bacon requirement cumbersome. The enforcement of these provisions will be minimal. The bid closing date is August 21, 1995. Depending on how much lead time is needed to receive the specified equipment, the project could be completed by late September, or the first week in October. Recommendation That the City Council authorize bid solicitation for the Mountain Meadows playground equipment and the City Manager to contract for installation to the lowest responsible bidder. BACKGROUND The City has a surplus of funds from a Community Development Block Grant (CDBG) for 1994-95, of about $25, 000 . 00 . The criteria for use for these funds is to remove any architectural barriers that would conflict with the requirements of the Americans with Disabilities Act (ADA) . This can only be used for replacement equipment or upgrading existing facilities, and cannot be used for installing anything new or in a new area (thus , playground equipment at Arroyo Vista Community Park or Poindexter Park does not qualify) . Staff has recommended to the City Council that the funds be used to replace the large wooden playground structure at Mountain Meadows Park, with equipment that is ADA approved and has handicapped access points . The City Council reviewed this recommendation at the March 1, 1995, City Council meeting and has approved this expenditure of funds . In order to expedite the purchase and installation of this new equipment , staff has researched equipment designs and is recommending a structure which will provide maximum active play in the available area, and would complement the equipment that was installed last year. Attached is a sample design that would be within our budget range. Staff would also recommend the rubberized surfacing only at the transfer points of the equipment , thus leaving the sand base in the majority of the play area, and saving the City costs for new surfacing. The play equipment should be designed in the colors of white, purple, and metallic flake blue, to complement the existing equipment . Staff feels that the equipment that is being recommended has multiple active play elements, several slides, and several climbers, and can be used by all ages, but would primarily serve the grade school level (ages 6 - 12 ) , as it would be located in that area. 00Utria Staff further recommends that the wooden swing set remain until the Commission makes any capital improvement changes at Campus Canyon Park. In the event that the Commission decides to modify or replace the equipment at Campus Canyon Park, the swing set poles at Campus Canyon could be moved to Mountain Meadows Park. Mr. Pete Selak from Gametime Playground Equipment will be present at tonight ' s meeting to answer any questions from the Commission. RECOMMENDATION Select Play Equipment Design for Mountain Meadows Park. The The motion was carried 5-0 . Commission and Director--Adams discussed several rules that needed to -be updated. MOTION: Commissioner Hall moved to approve Teen Dance Rules with the followingfchanges-, - - - 1) Rule #1 : Exclude ei&-sentence "There will be - no exceptions to -this It will be at the Chaperone ' s discretion - to allow admittance of - _ visiting relatives. 2) Rule #5 : To replace wording "knives or guns" with "weapons or explosives. " 3) Rule #8 : To add "Sheriff ' s office to be notified of a middle school dance. " Commissioner Badoud seconded. The motion was carried 5-0 . 8. DISCUSSION/ACTION ITEMS: A. Consider Design and Selection of New Mountain Meadows Playground Equipment . Staff Recommendation: Select Play Equipment Design for Mountain Meadows Park. Director Adams explained that existing equipment in the older children's area is being replaced because it does not meet A.D.A. standards . The Tot Lot is to remain the same. Pete Selak from Gametime was present to describe to Commission the new play equipment design and color. Commission discussed different alternatives with the proposed design that would include more variety with equipment . 0000E1.) Akr Minutes of the Parks and April 3, 1995 Recreation Commission Page Three • MOTION: Commissioner Thompson moved to approve the basic structure shown, same color, with the following changes: 1-) Replace the proposed equipment -design with the Power Scape Spy tube; 2) Eliminate one Crawl Tube and replace with if Climbers such as a Horizontal Loop Ladder, - - _ _ if budget will allow this change. - _ Coinutissioner Hartley seconded. The motion was carried 5-0 . B. Consider Design and Selection of Playground Equipment for Poindexter Park . Staff _-- - Recommendation: Select Play Equipment Design for Poindexter Park. :-Director Adams reviewed a diagram -0f Poindexter Park with the Commission and what was planned for each area, reminding Commission that just the main play structures were being discussed this evening. Pete Selak from Gametime described to Commission in detail the play equipment design and safety features that were being proposed for the older children' s play area and the Tot Lot . Commission discussed the main play equipment . Commissioner Hall stated that he would like to see the spring toys replaced with a merry-go-round. Commission agreed stating that the spring toys would be in the Tot Lot area and not needed in the older children' s area also. MOTION: Commissioner Badoud moved to approve replacing the spring toys in the older children ' s area with #6118 merry-go-round. Commissioner Harltey seconded. The motion was carried 5-0 . - C-ommission continued to discuss the safety features, price and variety of proposed design.
