On December 1, 1993, the City Council adopted Resolution No. 93 -988
approving Lot Line Adjustment No. 93 -8 to consolidate three
existing parcels into two parcels by eliminating one of the lot
lines. The Resolution also approved an Industrial Planned
Development Permit to construct two industrial concrete tilt -up
warehouse buildings of 253, 780 s.f. and 152,500 s.f. Minor
Modification No. 1 to IPD 93 -1 was approved by the Director of
Community Development on November 3, 1994 eliminating condition No.
108 which required the exterior of the buildings to be painted with
anti - graffiti paint.
The applicant applied for Minor Modification No. 2 on July 10, 1995
requesting that the "Art in Public Places" deposit in the amount of
$40,628 be applied to a stone and water feature which would be
located in the plaza area. The water sculpture will feature a
hydroplaning stone with both exotic colors and natural textures.
Condition No. 45 states:
Art and Public Places Contribution
45. The applicant shall contribute to the City of Moorpark's Art
in Public Places Fund, an amount of $10 per each 100 square
feet of building area. In lieu of payment of the
contribution, the applicant may substitute art work on -site of
equal or greater value of the contribution. The design and
location of the artwork is subject to approval of the City
Council prior to obtaining a Certificate of Occupancy.
As the applicant was unable to provide the artwork prior to the
issuance of the Certificate of Occupancy, the applicant paid the
required deposit to the City.
The applicant has requested that the deposit be refunded to the
applicant as follows:

$4,000.00 Upon retaining of artists as evidenced by a signed
contract to perform services.
$8,540.00 Upon approval by G &S Partnership of design proposal
from artists.
$12,540.00 Upon approval by G &S Partnership of the rock to
allow for artists to transport the rock to artist's
studio.
$7,600.00 After the work is completed and is ready for
installation at the site.
$7,948.00 After the work is installed on the site.
The applicant has provided colored renderings, the agreement for
payment to the artists of $38,000 and the Change Order from Ware
and Malcomb in the amount of $4,000 and the Artists' Biographies as
well as the Resume of Michele Chapmin which are attached for the
Council's review. The Director of Community Development is
deferring the decision on this Minor Modification to the City
Council on the basis that Condition 45 specifically requires the
artwork to be approved by the City Council.
Staff has reviewed the Minor Modification and is of the opinion
that the proposed artwork would be complementary to the existing
building and would be of a public benefit.
Staff Recommendation:
Approve the attached resolution to approve Minor Modification No.
2 to IPD 93 -1 (Roll call vote required).
