2018 (CC Meeting of 03107118) SUBJECT: Consider Amendment No. 6 to Agreement Between the City of Moorpark and Stantec Consulting Services, Inc. for the Re-Design of the Princeton Avenue Widening Project (C0020) SUMMARY On March 19, 2008, the City Council approved an agreement for civil engineering design services with Penfield & Smith, in an amount not to exceed $279,148, to provide conceptual and final design for the Princeton Avenue Widening Project (now C0020, formerly 8012) Since the original contract agreement, the Princeton Avenue Widening Project has required several contract amendments to augment Penfield & Smith's scope of services including their name change to Stantec Consulting Services, Inc The current contract value is $731 ,638 25 On January 27, 2010, the City was awarded $900,000 in federal funds from the Highway Safety Improvement Program for the construction of the Princeton Avenue Widening Project Projects seeking federal reimbursement for eligible construction and construction engineering costs must obtain the Federal Highway Administration's (FHWA) Authorization to Proceed (E-76) For federally funded projects, the State Department of Transportation (Caltrans) acts on behalf of the FHWA and provides guidance and administration during the project authorization process There are three project milestones that must be met to obtain FHWA's Authorization to Proceed 1) National Environmental Policy Act (NEPA) clearance, 2) Plans, Specifications and Estimate (PS&E) approval, and 3) right-of-way certification Staff is currently working with Caltrans Local Assistance staff to obtain NEPA clearance All required technical studies and memorandums have already been submitted and reviewed by Caltrans environmental planning staff All except the four Cultural Resources studies have been accepted by Caltrans Staff is awaiting Caltrans' action on these four Cultural Resources studies At staff's direction, Stantec has provided these 89 Honorable City Council March 7, 2018 Page 2 environmental services and has provided a cost proposal for the NEPA clearance phase Amendment No 6 is attached for the City Council's consideration and approval BACKGROUND On March 19, 2008, the City Council approved an agreement for civil engineering design services with Penfield & Smith, in an amount not to exceed $279,148, to provide conceptual and final designs, soils report and analysis, utility coordination, and aerial mapping of the existing topography for the Princeton Avenue Widening Project (C0020) The scope of services and the Agreement with Penfield & Smith provided technical studies and design data, which were used as the basis for all project re-design efforts Since the original contract agreement, the Princeton Avenue Widening Project has required several contract amendments to augment Penfield & Smith's scope of services due to the project's complexity and design criteria On February 3, 2010, Amendment No 1 to the Agreement was approved by the City Council, in an amount not to exceed $74,692 25, to provide land surveying services and updates to the geotechnical report On November 3, 2010, Amendment No 2 to the Agreement was approved by the City Council, in an amount not to exceed $130,000 00, to provide a drainage study, drainage infrastructure improvement plan, extension of the project limit to Condor Drive, and future right-of-way acquisition support services On July 12, 2013, Amendment No 3 to the Agreement was executed, in an amount not to exceed $211 ,790 00, to provide updates to the drainage study, design modifications to the drainage infrastructure improvement plans, retaining wall design, additional utility coordination services, Caltrans permitting support services, 100% final design plan and specifications, and construction administration support services On February 5, 2015, Amendment No 4 to the Agreement was executed to document the Consultant's name change from Penfield & Smith to Stantec Consulting Service, Inc On September 21 , 2016, Amendment No 5 to the Agreement was approved by the City Council, in an amount not to exceed $36,008 00, to provide domestic water improvement plans and specifications, update current design infrastructure improvement plans, and additional utility coordination services The current contract amount, including the five amendments, is $731 ,638 25 90 Honorable City Council March 7, 2018 Page 3 DISCUSSION On January 27, 2010, the City was awarded $900,000 in federal funds from the Highway Safety Improvement Program for the design and construction of the Princeton Avenue Widening Project For federally funded projects, the Caltrans acts on behalf of the FHWA for project authorization for which federal reimbursement will be requested Due to the project's design complexity and right-of-way issues, the HSIP funds for the project were deferred to the Construction and Construction Engineering phase The Caltrans Local Assistance Office provides guidance and administration of the federal Authorization to Proceed process Staff recently received a time extension request from the FHWA/Caltrans Local Assistance to obtain Project Authorization (E-76) by June 30, 2018 Staff will shortly be submitting another time extension request due to the lengthy authorization process Staff and the city consultant, Stantec, have initiated the request package for Authorization to Proceed and have been working closely with Caltrans' Environmental Planning Division staff to to obtain NEPA clearance During the environmental planning process, the Preliminary Environmental Study determined that several technical studies and memorandums were required to determine NEPA classification These technical studies include the following • Noise Impacts Technical Memorandum • Location Hydraulic Study Technical Memorandum • Biological Resources > Natural Environmental Study Minimal Impacts • Visual Resources Technical Memorandum • Land Use and Community Impacts Technical Memorandum • Cultural Resources > Area of Potential Effects • Historical Resources Evaluation Report (HRER) • Historical Property Survey Report (HPSR) • Archaeological Survey Report (ASR) Due to the complexity and expertise required, staff directed Stantec Consulting to prepare these studies Staff has already submitted the remaining Technical documents to Caltrans for their consideration Currently, the NEPA clearance process is approximately 50% complete Once NEPA clearance is obtained, staff will work with Caltrans staff to obtain PS&E approval 91 Honorable City Council March 7, 2018 Page 4 Attached for the City Council's consideration is Amendment No 6 to the City's Agreement with Stantec to provide environmental planning services for an amount not to exceed $61 ,000 FISCAL IMPACT The Fiscal Year 2017-2018 Capital Improvement Budget has appropriated $91 ,712 to budget account number 2014 311 C0020 55300 (Capital Professional Services) The entire budgeted amount is encumbered to the existing Stantec purchase order Amendment No 6 will increase the existing contract agreement by $61 ,000 Currently, the project budget (C0020) has available funds, in the amount of $6,051 ,591 , in account number 2014 311 C0020 55200 (Infrastructures) A budget line item adjustment between the budget subject to final language approval by the City Manager Attachment Amendment No 6 93 AMENDMENT NO. 6 AGREEMENT BETWEEN THE CITY OF MOORPARK AND STANTEC CONSULTING SERVICES, INC. FOR CIVIL ENGINEERING DESIGN SERVICES FOR THE RE- DESIGN OF THE PRINCETON AVENUE WIDENING PROJECT This Amendment No 6 to the Agreement between the City of Moorpark, a municipal corporation ("City"), and Stantec Consulting Services, Inc , a corporation ("Contractor"), for civil engineering design services ("Agreement"), is made and entered into the day of , 2018 RECITALS WHEREAS, on May 15, 2008 the City and Consultant entered into an Agreement to have the Consultant provide professional engineering design services for the re- design of the Princeton Avenue Widening Project for a total contract value of two hundred seventy-nine thousand, one hundred forty-eight dollars ($279,148), and WHEREAS, on February 20, 2009, a no cost Change Order was executed for a value of two thousand, five hundred dollars ($2,500) specifying the amount set aside for reimbursable expenses Other design services were reduced by an unspecified amount to accommodate reimbursable expenses and the total contract value remained the same, and WHEREAS, on February 16, 2010, Amendment No 1 to the Agreement was executed, including a boundary establishment survey and legal description preparation, a geotechnical update report, and an additional topographic survey in the amount of seventy-four thousand, six hundred ninety-two dollars and twenty-five cents ($74,692 25) for a total contract value of three hundred fifty-three thousand, eight hundred forty dollars and twenty-five cents ($353,840 25), and WHEREAS, on November 16, 2010, Amendment No 2 to the Agreement was executed, including a drainage study preparation, extension of the project limits, storm drain plan and profile design, reimbursement for previous out of scope services of work requested and conducted prior to Amendment No 2, and future anticipated engineering services required in support of ongoing right-of-way acquisition efforts in the amount of one hundred thirty thousand dollars ($130,000) for a total contract value of four hundred eighty-three thousand, eight hundred forty dollars and twenty-five cents ($483,840 25), and WHEREAS, on July 12, 2013, Amendment No 3 to the Agreement was executed increasing the Consultant's Scope of Services to include ground penetrating radar for storm drain design, drainage report revisions, drainage design modifications, completion of plans specifications and cost estimates, structural wall design, utility coordination, Caltrans permitting, and bidding and construction phase services, and to identify optional drainage design alternatives that may be added to the Consultant's Scope of Services in the future by separate amendment in the amount of two hundred eleven thousand, seven hundred ninety dollars ($211 ,790) for a total contract value of six hundred ninety-five thousand, six hundred thirty dollars and twenty-five cents ($695,630 25), and 94 WHEREAS, on February 5, 2015, Amendment No 4 to the Agreement was executed to document the Consultant's name changed from Penfield & Smith to Stantec Consulting Services, Inc , and WHEREAS, on November 3, 2016, Amendment No 5 to the Agreement was executed to augment the Consultant's scope of services to include the preparation of domestic water improvement plans within the project limits in the amount of thirty-six thousand, eight dollars ($36,008) for a total contract value of seven hundred thirty-one thousand, six hundred thirty-eight dollars and twenty-five cents ($731 ,638 25), and WHEREAS, the State of California, on behalf of the Federal Highway Administration, requested technical studies for compliance with the National Environmental Policy Act, and WHEREAS, the Consultant provided a cost proposal on February 27, 2018 for additional environmental planning support services related to compliance with the National Environmental Policy Act, attached as Exhibit A, in the amount of sixty-one thousand dollars ($61 ,000), and WHEREAS, the City and Consultant now desire to amend the Agreement for an additional period, and WHEREAS, the City and Consultant now desire to amend the Agreement to increase the compensation for services to be performed by Consultant from seven hundred thirty-one thousand, six hundred thirty-eight dollars and twenty-five cents ($731 ,638 25) by a value of sixty-one thousand dollars ($61 ,000) for a total contract value of seven hundred ninety-two thousand, six hundred thirty-eight dollars and twenty- five cents ($792,638 25), and document said agreement to amend by jointly approving Amendment No 6 to the Agreement NOW, THEREFORE, it is mutually agreed by and between the parties to the Agreement as follows I Section 2, SCOPE OF SERVICES, is amended by replacing this section in its entirety as follows "City does hereby retain Consultant in a contractual capacity to provide civil engineering design services, as set forth in Exhibit B, Section C - Scope of Services, Change Order, and all amendments and the exhibits attached thereto and incorporated herein by this reference, and further defined in Exhibit C Consultant's Proposal, dated February 18, 2008, which is also attached hereto and incorporated herein by this reference Where said Scope of Services is modified by this Agreement, or in the event there is a conflict between the provisions of said Scope of Services or Consultant's Proposal and this Agreement, the language contained in this Agreement, and the Amendments shall take precedence Amendment No 6 to Agreement between City of Moorpark and Stantec Consulting Services, Inc Page 2 95 Compensation for the services to be performed by Consultant shall be in accordance with Exhibit B, Section C — Fee, and all amendments and the exhibits attached thereto Compensation shall not exceed the rates or total contract value of seven hundred ninety-two thousand, six hundred thirty-eight dollars and twenty-five cents ($792,638 25) as stated in Exhibit B, Section C - Fee and all amendments and the exhibits attached thereto without the written Amendment to the Agreement executed by both parties Payment by City to Consultant shall be in accordance with the provisions of this Agreement " II Section 5, PAYMENT, is amended by replacing the first paragraph in its entirety as follows "Taxpayer ID or Social Security numbers must be provided by Consultant on an IRS W-9 form before payments may be made by City to Consultant " The City agrees to pay Consultant monthly, in accordance with the payment rates and terms and the schedule of payment as set forth in Exhibit B, Section C - Additionally, the original contract did not account for any of the additional environmental review or studies required by Caltrans as a result of the HSIP funding. Also, this proposal includes the project management for the PES, Condition Compliance PM Services for the project (to comply with Archeological/Historical and Biological conditions) and it includes the preparation and filing of a CEQA Notice of Exemption and a FONSI for compliance with NEPA. These services were not anticipated at the time the project started with the City of Moorpark. ADDITIONAL SCOPE OF SERVICES Task 1 - Preliminary Environmental Study (PES) As required for Caltrans submittal for the local assistance (HSIP) funding: 1. Preparation of PES Form; this includes all supporting documentation, maps, studies, plans, and layout plans. 2. Coordination with Caltrans Environmental Division for updates to the PES form, additional information required, meetings requested, procurement of sub-consultant specialists (biologist, archaeologist, etc.), conference calls and emails/letters, and coordination with the City of Moorpark. Task 2 - Archaeological Resource Investigation As required for Caltrans submittal and as a result of the initial Caltrans environmental review,Stantec has retained Dudek as a sub-consulant to prepare the Archaeological Resource Investigation and reporting. The Dudek proposal for this task is included as Attachment 1. Design with community in mind 97 February 27,2018 Princeton Avenue Widening Project 8012, Proposal for Additional Services Page 2 of 4 Task 3 - Historical Resources Evaluation Report As required for Caltrans submittal and as a result of the initial Caltrans environmental review,Stantec has retained Dudek as a sub-consultant to prepare the Historical Resources Evaluation and Reporting. The Dudek proposal for this task is included as Attachment 2. Task 4 - Natural Environment Study- Minimal Impacts (NES-MI) The following is a Scope of Services and estimate of probable costs to conduct a site assessment and to prepare a Caltrans Natural Environment Study-Minimal Impacts (NES-MI) report. Projects with de minim us issues related to natural resources, or requiring a minimal amount of compensatory mitigation—and where the effects can be completely analyzed and mitigation properly justified relatively easily—are candidates for a Natural Environment Study Minimal Impact (NES-MI) format. his proposal also contains scope of work elements stemming from a meeting with the City on 09/13/2017, entailing native tree assessment within the Projects Area of Potential Effects (APE) and to evaluate existing conditions associated with proposed staging area. Task 5 CEQA and NEPA Clearance The project will require CEQA and NEPA clearances prior to construction. Stantec will provide a Notice of Exemption (NOE) for compliance with CEQA and will also provide a FONSI (Finding of No Significant Impact) to comply with NEPA. Task 6 - Post Permitting Assistance The City has requested Stantec to provide post-permitting planning assistance to the City of Moorpark, as required, and supplemental to the construction phase services for permit and environmental related matters. PROPOSED ADDITIONAL Fl Our services will be performed on a "time and materials" basis, not to exceed per the schedule below and shall be billed monthly at the rates then currently in effect. We estimate that the fees required for our services will be $61,000. Our charges will not exceed the fee estimate without your prior authorization. King The following is a time-and-materials, not-to-exceed proposal to conduct archaeological resources documentation for the Princeton Avenue Road Widening Project in Moorpark, California The work will satisfy requirements identified in National Historic Preservation Act (NHPA) Section 106 guidelines implemented by the California Department of Transportation(Caltrans) We understand that the Princeton Avenue Road Widening Project (Project) will occur from the roughly the Princeton Avenue/Hedyland Court intersection west to the Princeton Avenue/Virginia Colony intersection The Project involves federal funding, necessitating compliance with the National Historic Preservation Act Section 106 requirements Caltrans District 5 staff has determined in their Project Preliminary Environmental Study (PES) that the following documents are needed to address Section 106 requirements, consistent with their guidance provided in the Standard Environmental Reference (SER), Exhibit 5 1, Archaeological Survey Report (ASR) Format and Content Guide • Area of Potential Effects (APE)map • Archaeological Survey Report(ASR), and • Historic Property Survey Report (HPSR) Dudek has Expansion, City of Temecula The tasks associated with preparing this documentation are discussed below Task 1: Area of Potential Effect(APE) Figure The APE will be prepared in consultation with City of Public Works staff, based on the Draft Project Description Project map to be provided by Stantec As required by the SER Exhibit 5 1, ASR Format and Content Guide, Dudek will collaborate with you to determine and document • Direct, Permanent Impact Areas including all ground disturbance, vegetation removal, and demolition, • Indirect, Temporary Impact Areas including construction equipment staging, materials storage, etc , and • Maximum Depth of Disturbance Deliverables: A Draft APE will be submitted to Caltrans staff for review and comment One revised final APE will be prepared Task 2: Section 106 ASR 2.1 Background Research The Caltrans SER Exhibit 5 1, ASR Format and Content Guide provide clear direction on background research required The following information sources will be reviewed • Archaeological site record and literature search including a records search of previous investigations and site records maintained at the California Historical Resources Information System (CHRIS), South Central Coast Information Center (SCCIC), California State University Fullerton, including the Project APE and a 0 5-mile surrounding buffer, and • Sacred Lands Inventory search maintained by the State Native American Heritage Commission (NAHC) 102 Ms Hollee L Kmg,MPA,AICP August 14,2017 Page 3 2.2 Consultation with Local Native American Tribe and Individuals The Caltrans SER has been amended (January, 2015) to formalize required consultation with Native American tribes and individuals Chapter 3, Native American Consultation, states "Caltrans' historic preservation coordination efforts with Native Americans involve consulting with federally recognized tribes and California Indian traditional cultural leaders, unrecognized groups, and individuals on their concerns regardmg Caltrans activities Simultaneously, these efforts also include identifying other cultural concerns and areas of cultural significance that a proposed project may impact and that may need to be addressed under environmental law Consultation typically focuses on the identification, evaluation, determination of effects, and treatment of archaeo-logical resources However, consultation also is necessary to identify areas important to Native Americans that may be unrecognized by people outside the culture These include sacred sites, plant-gathering areas, and certain historic properties that are referred to as Traditional Cultural Properties (see Section 4 4 2 of this volume, and National Register Bulletin 38 Guidelines for Evaluating and Documenting Tradition-al Cultural Properties) Knowledge of such places is almost always confidential, and their identification and management, therefore, can be problematic and sensitive" The NAHC search of the Sacred Lands Inventory identified above will result in the identification of all "federally recognized tribes and California Indian traditional cultural leaders, unrecognized groups, and individuals" that must be consulted as part of the Caltrans Section 106 Guidelines compliance It is our experience that approximately 10 tribal representatives and individuals in the Ventura County Moorpark area are identified by the NAHC Consultation will include • Providing a memo to each entity via e-mail and mail summarizing the results of background research and intensive survey of the APE • If no response to the memo is received within 2 weeks, the entity will be contacted by phone as required by Caltrans SER Guidelines , Chapter 3, Native American Consultation "[Consultation] can [be] initiate[d] by various means, for instance, by letter, telephone call, and personal visit or by a semi-annual notice If there is no response to the initial contact, a telephone call or personal visit should be made " A summary of this consultation will be provided in a table in the ASR 2.3 Intensive Ground Surface Survey The Project APE will be intensively surveyed by a qualified archaeologist in no greater than Prepare HRER Dudek will prepare an HRER to document all identification, recordation, and evaluation efforts for historic built environment resources within the project APE (both direct and indirect) Dudek assumes that all but one property within the APE will qualify for exemption under Attachment 4 of the Caltrans Programmatic Agreement Should additional resources be identified, a budget augment would be required The HRER will be prepared by a Dudek architectural historian who meets Caltrans PQS standards for architectural history Dudek assumes no more than one (1) round of comments with Caltrans will be required on the HRER COST ESTIMATE Based on thoughtful consideration of the project requirements and a thorough estimate of the attendant labor and direct costs, Dudek's cost estimate
