BY M Benson MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Ron Ahlers, Finance Director DATE: March 1, 2018 (City Council Meeting of March 7, 2018) SUBJECT: Consider Scheduling a Public Hearing to Consider a Resolution Updating Police Facilities Fee and Finding This Action Exempt from the California Environmental Quality Act SUMMARY The Police Facilities Fee is collected by the City prior to the issuance of building permits The purpose of the Police Facilities Fee is to provide funding for the construction and improvement of the Police Services Center as a result of increased demand for Police services arising from additional development The Police Services Center was completed in the fall of 2005 The last increase occurred in 2006 Staff recommends setting a public hearing for April 4, 2018, to consider an increase to the Police Facilities Fee DISCUSSION The City began collecting a Police Facilities Fee with the adoption of Ordinance No 9 in October 1983 During April 1995, Ordinance No 9 was replaced with Ordinance No 206 and Resolution No 95-1112, establishing the Police Facilities Fee Subsequently, in September 2000, Resolution No 2000-1777 was adoption which increased the Police Facilities Fee The last increase occurred in 2006 with the adoption of Resolution No 2006-2446 and is currently $1 ,027 per unit for residential development and $0 60 per square foot for non-residential development Twelve years has elapsed since the last increase and a number of factors have changed that warrant a new calculation of the Police Facilities Fee As of today, the exact amount of the recommended fee increase has not been determined Staff intends to complete the analysis prior to the April 4th meeting and provide that information to the City Council and other interested parties California Government Code Section 66014 provides for cities to charge fees that do not exceed the costs associated with processing land development, zoning and use 111 Honorable City Council March 7, 2018 Page 2 permit application Section 66016, 66018 and 6062a set forth the notification and hearing process required prior to levying new fees or service charges, or prior to increasing an existing fee or serve charge Section 66017 provides that certain fees shall take effect no sooner than 60 days from the date of adoption Notices will be provided in accordance with those requirements and, if adopted on April 4, updated fees would take effect on June 4, 2018 FISCAL IMPACT The Police Facilities Fees collected will continue to pay down the interfund loan from the Endowment Fund and should also provide funding for improvements to the Police Services Center STAFF RECOMMENDATION Schedule public hearing for consideration of increasing the Police Facilities Fee for the regular April 4, 2018 City Council meeting 112
