Subject: Consider Minor Modification No. 2 to Planned Development
Permit 1051 (Leonard Rose) , request to modify the sign
program to allow an additional sign adjacent to Spring
Road.
Background
On June 16, 1986 the City Council approved Resolution No. 86 -317 to
allow the construction of 136 apartment units. Minor Modification
No. 1 was approved on September 18, 1987 to redesign the outdoor
recreation facilities. The existing monument sign was approved and
constructed as part of the Planned Development permit.
Discussion
This request is to modify the conditions of approval to place an
additional project identification sign adjacent to Spring Road. The
proposed sign is 4' x 4' sandblasted wood, painted white with dark
and light blue trim and letters, and will be located five feet
behind the property line. The landscaped area between the sidewalk
and the pond waterscape varies from 4' to 19.'
The existing project identification sign is constructed of
decorative rock, "V" shaped, with a 1�1 x 7' sign located on each
side of the sign, and is located adjacent the existing waterscape.
This sign is setback 21' from the front property at Spring Road.
Although Section 17.40.120 of the Zoning Code allows neighborhood
identification signs with the approval of the Director of Community
Development, this sign is being denied for the following reasons:
1) An additional sign is not necessary for identification of
the apartment complex.
2) This business operates as a destination (people are already
looking for an apartment and know they are there and look for
them) as opposed to an opportunity, where a need exists to
attract passers by (such as a restaurant).

3) Signs within one -half of the front setback area (151) are
not allowed pursuant to Section 17.40.040.
4) The materials and colors (sandblasted wood) proposed are
not consistent with either the development or the existing
signs (concrete signs, decorative river -rock trim and metal
letters).
This proposal has been reviewed by the Director of Community
Development who denied the application on October 6, 1995. This
matter is being presented to the Council as a courtesy. Should the
Council, or any other party, desire to appeal the Director's
decision, the item should be scheduled for a regular Council
meeting. The last day for an appeal to be filed is October 23,
1995. The next available City Council meeting for a hearing is
November 1, 1995. If the Council, or other interested party, takes
no action to appeal this item, the Director's decision will become
effective on October 24, 1995.

For: Locate an additional project identification sign adjacent to
Spring Road. The proposed sign is 4' x 4' sandblasted wood, painted
white with dark and light blue trim and letters, located five feet
behind the property line.
As shown on Exhibit "A ". The land involved is Assessor's Parcels
No.: 512 -0- 150 -200, in the RPD zone.
California Environmental Quality Act (CEQA) Compliance: This
Department has reviewed the project to ascertain if there will be
a significant effect on the environment. It has been determined
that this project is categorically exempt from CEQA requirements as
a Class 11 exemption for minor alterations.
Basis for denial:
1) An additional sign is not necessary for identification of
the apartment complex.
2) This business operates as a destination (people are already
looking for an apartment and know they are there and look for
them) as opposed to an opportunity, where a need exists to
attract passers by (such as a restaurant).
3) Signs within one -half of the front setback area (151) are
not allowed pursuant to Section 17.40.040.
4) The materials and colors (sandblasted wood) proposed are
not consistent with either the development or the existing
signs (concrete signs, decorative river -rock trim and metal
letters).
Appeals: As stated in Section 17.44.090, within 16 calendar days
after the permit has been approved, conditionally approved or
denied, any aggrieved person may file an appeal of the approval,
conditional approval or denial with the Community Development

Department who shall set a hearing date before the City Council to
review the matter at the earliest convenient date.
