Gilbert, Director of Public Works P4 DATE: October 6, 1995 (Council Meeting 10- 18 -95) SUBJECT: Consider Revisions to Contract for Engineering Services OVERVIEW This presents a request for an increase in the rates to be charged for Engineering Services. DISCUSSION A. Background: In March of 1991 the City entered into an Agreement for City Engineering Services with Charles Abbott Associates. B. Retainer: Paragraphs A & B of Section I of the Agreement provide for an automatic adjustment (not to exceed 7 %) to the retainer for City Engineer and Traffic Engineering Services each November 1 based on the change in the Consumer Price Index. No action is required by the City Council to effectuate this change. Based on a 2.5% increase in the CPI, the changes to the amount of the Engineering retainers is summarized as follows: Prior Revised Amount ($) Service Amount ($1 Effective 11 -1 -95 City Engineer 2,373 Traffic Engineer 374 2,432 383 C. Request for Cost -of- Living Adjustment: The Agreement for Engineering Services also states that the City may consider a request for a Cost -of- Living Adjustment to the hourly rates charged for Engineering Services. Such an adjustment, if made, shall be effective November 1 of each year, based on a request which is to be submitted by September 15 of that year. Attached as Exhibit 1, a request from the City Engineer's Office for such an adjustment, dated September 26, 1995. Although late, the request was prepared and submitted as soon as the required CPI information was made available. engfee95 Rates for Engineering Services October 1995 Page 2 As stated in the request, there was an increase of 2.5% to the CPI for the year ending August 1995, using the "U. S. City Average for All Urban Consumers All Items Indexes." September 26, 1995 Steven Kueny City of Moorpark 799 Moorpark Ave. Moorpark CA, 93021 Dear Steve, As outlined by provisions in our contract for Engineering Services to the City of Moorpark dated March 1, 1991, we will be moderately increasing our retainer fees and fee rates to keep pace with current consumer trends. The proposed increase will be 2.5% as dictated by our current agreement and the Consumer Price Index for the period August 1994 thru August 1995 and will take effect November 1, 1995. Attached is an itemization of the contract categories showing the related fees and hourly rates which will be changing. We understand that the Agreement for Engineering Services specifies that requested increases are to be submitted by September 15. Please forgive the late submittal of this request but the Consumer Price Index for August did not become available until today. We had requested the CPI in early August. This is the absolute earliest that this could have been submitted. We look forward to being of service to the community of Moorpark in the coming year and I would be happy to answer any questions you might have concerning these increases.
