OF THE CITY OF MOORPARK
Moorpark, California February 21, 2018
A Regular Meeting of the City Council of the City of Moorpark and the Successor
Agency was held on February 21, 2018, in the Council Chambers of said City located at
799 Moorpark Avenue, Moorpark, California. All items listed are heard and acted upon
by the City Council unless otherwise noted.
1. CALL TO ORDER:
Mayor Parvin called the meeting to order at 6:47 p.m.
2. PLEDGE OF ALLEGIANCE:
City Manager Steven Kueny led the Pledge of Allegiance.
3. ROLL CALL:
Present: Councilmembers Mikos, Pollock, Simons, Van Dam, and
Mayor Parvin.

4. PROCLAMATIONS AND COMMENDATIONS:
A. Recognition of City Manager Steven Kueny upon the Occasion of His
Retirement.
Mayor Parvin spoke in honor of Mr. Kueny describing many of his
accomplishments for the City over his 33% years of service. On behalf of
the City Council, she presented him with the City of Moorpark tile plaque.
Mayor Parvin read a letter from U.S. Senator Dianne Feinstein recognizing
Mr. Kueny for his many years of service and congratulating him upon his
retirement.

Mayor Parvin read U.S. Congresswoman Julia Brownley's Special
Congressional Recognition for his invaluable service to the community for
over 33 years.
Mayor Parvin read a certificate of Special Congressional Recognition to
Mr. Kueny from U.S. Senator Kamala Harris.
Ms. Morgan Culbertson, Field Representative for State Senator Henry
Stern presented Mr. Kueny with a Resolution from the State of California
recognizing him upon his retirement.
Field Representative, Andrew Munson for State Assembly Member Jacki
Irwin presented Mr. Kueny with a Resolution from the State of California.
Ventura County Supervisor Peter Foy presented Mr. Kueny with a
Certificate of Recognition signed by Ventura County Board of Supervisors.
He acknowledged Mark Lunn, County Clerk and Recorder and Brian Miller
his former chief of staff were also in attendance in honor of Mr. Kueny.
Superintendent Dr. Kelli Hays of the Moorpark Unified School District and
all of the members of the Board of Education were in attendance and
presented Mr. Kueny with a Certificate of Recognition.
Captain John Reilly, Moorpark Chief of Police from the Ventura County
Sheriff's Department acknowledged other law enforcement personnel in
the audience in attendance in honor of Mr. Kueny, including former Police
Chiefs Steve Wade, Dick Diaz, Ron Nelson and Marty Rouse. Captain
Reilly presented Mr. Kueny with a framed American flag which had flown
over the Moorpark Police Services Center.
Sheriff Geoff Dean from the Ventura County Sheriff's Department
presented Mr. Kueny with a framed photo of his office, complete with Post-
It notes, and spoke in recognition of Mr. Kueny's leadership and effective
partnership with the Ventura County Sheriff's Department.
Bernardo Perez, former Moorpark Mayor and Councilmember now
representing the Ventura County Community College District, presented
Mr. Kueny with a certificate of recognition from the Board; as a member of
the Moorpark Foundation of the Arts, he thanked Mr. Kueny for his support
of the arts in Moorpark; and as a former project manager of Cabrillo
Economic Development, he thanked Mr. Kueny for his support of
affordable housing in the community.
Bob Huber, Mayor of the City of Simi Valley presented Mr. Kueny with a
Resolution declaring his accomplishments over the years.

Mayor Pro Tern Carmen Ramirez of the City of Oxnard presented Mr.
Kueny with a certificate of recognition from the City Council.
Mayor Sylvia Munoz-Schnopp of the City of Port Hueneme presented Mr.
Kueny with a certificate of recognition from the City Council, and thanked
him for his dedication and service to the community.
Mayor Parvin announced the cities of Camarillo, Fillmore, Santa Paula,
Thousand Oaks, and Ventura had each sent a certificate or proclamation
honoring Mr. Kueny.
Division Chief John Spykerman of the Ventura County Fire Protection
District and resident of Moorpark, representing Chief Mark Lorenzen,
Deputy Chief Vaughn Miller, Division Chief Chad Cook and the entire
Executive staff, congratulated Mr. Kueny on his retirement and presented
him with a gift.
Former Councilmember Keith Millhouse spoke in honor of Mr. Kueny and
credited him with making Moorpark the community it is today.
Bruce Rokos, representing the Moorpark Chamber of Commerce and
speaking on behalf of President/CEO Dale Parvin and the Board of
Directors thanked Mr. Kueny for his leadership and integrity championing
Moorpark businesses. As a resident of Moorpark, he thanked Mr. Kueny
for the safety of the City, and he presented him with a distinguished
service award from the Chamber.
Hugh Riley, retired former Moorpark Assistant City Manager and now
Executive Director of the Moorpark Foundation for the Arts, presented Mr.
Kueny with a letter from the High Street Arts Center thanking him for
giving the community "live theater".
Nelson Chung, developer for Pacific Communities complimented Mr.
Kueny for his skills and passion for negotiating on behalf of the City of
Moorpark with a keen business sense.
Bob Braitman, former executive officer of the Ventura Local Agency
Formation Commission during the time the City of Moorpark was
incorporated in 1983, read a proclamation he composed for Mr. Kueny.
Scott Mosher, Executive Director of the Moorpark Boys and Girls Club
presented Mr. Kueny with a certificate of appreciation on behalf of the
Board of Directors and the kids of the Boys and Girls Club.
Linda and Harvey Plaks, long-time residents of Moorpark congratulated
Mr. Kueny and thanked him for his many contributions to the community.

Mayor Parvin acknowledged others in attendance in the audience who
came to honor Mr. Kueny including: former Mayor Patrick Hunter who
traveled from out-of-state, former Councilmembers Clint Harper, John
Wozniak, and John Lane; Chris Oberender, Deputy Director of
Maintenance for the City of Simi Valley, Jennifer Mellon, Deputy
Community Services Director/Transit Division for the City of Simi Valley,
Jordan Gastworth, Deb Brousalian; and other guests John and Mary
Roberts, Doug Anderson of Urban Futures, Elaine Freeman formerly of
Urban Futures now a member of LAFCO and the Board for Rancho Simi
Recreation and Parks District, John Newton, Marshall Linn formerly of
Urban Futures, Robert and Steven Anderson of RJR Engineering, Rusty
Reed the President of Charles Abbott and Associates, and Valorie
Draeger of Trilliad Development.
Councilmember Pollock stated Mr. Kueny's name is synonymous with the
City of Moorpark and he complimented him on his depth of
professionalism and stated he always had the City's interest at heart.
Councilmember Mikos stated she learned a lot from Mr. Kueny and
acknowledged that he was always thinking about things to make the
community better.
Councilmember Van Dam read a special poem he wrote in honor of Mr.
Kueny.
Councilmember Simons stated he would miss the quality times he spent
with Mr. Kueny during his first year as a Councilmember, and described
what Mr. Kueny does as similar to the Wizard of Oz, always working
behind the curtain on behalf of Moorpark.
Mayor Parvin wished Mr. Kueny best wishes upon his retirement and
thanked him for all his help and for his creative visionary ideas, which
have made the City thrive and made a lasting impact on the residents.
Mr. Kueny thanked his wife and family for their support over the years;
thanked all of the guests for coming this evening;
AT THIS POINT in the meeting, the Council recessed for a reception. The time was
7:49 p.m. The City Council meeting reconvened at 9:05 p.m. with Councilmembers
Mikos, Pollock, Simons, Van Dam, and Mayor Parvin present.

6. REORDERING OF, AND ADDITIONS TO, THE AGENDA:
None.
7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON
MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND
MAYOR:
Councilmember Van Dam recommended everyone attend a showing of "Singing
in the Rain" at the High Street Arts Center.
Councilmember Van Dam thanked staff for their park reservation system which
benefited his neighbor.
Councilmember Van Dam stated he had participated as a judge for Moorpark
Has Talent.
Councilmember Van Dam announced he had attended a Moorpark Chamber of
Commerce Installation.
Councilmember Simons announced he too attended the Moorpark Chamber of
Commerce Installation.
Councilmember Pollock announced he also attended the Chamber Installation
and he attended an a capital campaign event with Mayor Parvin at the Adventist
Health Center in Simi Valley to raise funds for another "catheter lab" as they are
moving to become certified as a stroke center.
Councilmember Mikos announced she had also attended the Chamber
Installation.
Councilmember Mikos invited everyone to attend the 60th anniversary of
Moorpark Little League at 1:00 p.m. on Saturday, February 24.
Mayor Parvin announced registration is open for spring recreation classes at
Arroyo Vista Recreation Center.
8. PUBLIC HEARINGS:
A. Consider a Resolution Approving Tentative Parcel Map No. 2017-02 for
the Subdivision of a 9.61 Acre Developed Lot into Two Parcels of 9.11

Acres and 0.50 Acres at 800 Los Angeles Avenue (Target Store), and
Making a Determination of Exemption Under the California Environmental
Quality Act (CEQA) in Connection Therewith, on the Application of
Moorpark Covenant Group, LLC. Staff Recommendation: 1) Open the
public hearing, accept public testimony and close the public hearing; and
2) Adopt Resolution No. 2018-3676.
Mr. Bobardt gave the staff report.
Mayor Parvin opened the public hearing.

MOTION: Councilmember Pollock moved and Councilmember Simons
seconded a motion to adopt Resolution No. 2018-3676 approving Tentative
Parcel Map No. 2017-02 for the Subdivision of a 9.61 Acre Developed Lot into
Two Parcels of 9.11 Acres and 0.50 Acres at 800 Los Angeles Avenue (Target
Store), and Making a Determination of Exemption Under the California
Environmental Quality Act (CEQA) in Connection Therewith, on the Application of
Moorpark Covenant Group, LLC. The motion carried by unanimous voice vote.
B. Consider Resolution to Form City of Moorpark Community Facilities
District 2018-1 (CFD 2018-1) Pacific Arroyo, Resolution Determining
Necessity to Incur Bonded Indebtedness, Resolution Calling Special
Election, Resolution Declaring Results of Special Election, and Ordinance
Levying Special Taxes within CFD 2018-1. Staff Recommendation: 1)
Open the public hearing, accept public testimony, and close the public
hearing; 2) Adopt Resolution No. 2018-3677 to form CFD 2018-01, Adopt
Resolution 2018-3678 Determining the Necessity to Incur Bonded
Indebtedness, and Adopt Resolution No. 2018-3679 Calling Special
Election; 3) Adopt Resolution No. 2018-3680 Declaring Results of Special
Election; and 4) Introduce Ordinance No. 462 for first reading, waive full
reading, and place the ordinance on the agenda for the March 7, 2018
regular meeting for purposes of providing second reading and adoption of
the Ordinance.
Mayor Parvin made the following opening remarks: "This is the time and
place for the public hearing sin this Council's proceedings for
establishment of Community Facilities District No. 2018-1 (Pacific Arroyo).
The hearing is to inquire into the formation of the District, the levy of
special taxes in the District and the need to incur bonded indebtedness in
the District."

Mayor Parvin went on to say: "Before formally opening the hearing, are
there any property owners or registered voters in the District who wish to
file written protests? If so, they must be filed with the City Clerk at this
time".
There being no protests, the Mayor Parvin opened the public hearing.
Mr. Ahlers gave the staff report and explained the editorial corrections to
the CFD Report provided by Willdan Financial Services in the
Supplemental report.
Mike Medve, consultant to the City and Project Manager from Willdan
Financial Services, 27368 Via Industria, Suite 200, Temecula, California,
clarified that the affordable residential units are exempt from the special
tax. Mr. Medve and Mr. Ahlers provided additional clarification on the
special tax and bond process.
Nelson Chung, developer of the project, Pacific Communities, 1000 Dove
Street, Newport Beach, California, described how the bond funds will be
issued and used.
Mayor Parvin closed the public hearing.
MOTION: Mayor Parvin moved and Councilmember Van Dam seconded a
motion to adopt Resolution No. 2018-3677 to form Community Facilities District
2018-01 Pacific Arroyo. The motion carried by unanimous voice vote.
MOTION: Councilmember Mikos moved and Councilmember Pollock seconded
a motion to adopt Resolution No. 2018-3678 Determining the Necessity to Incur
Bonded Indebtedness for the City of Moorpark Community Facilities District No.
2018-1 Pacific Arroyo. The motion carried by unanimous voice vote.
MOTION: Councilmember Pollock moved and Councilmember Mikos seconded
a motion to adopt Resolution No. 2018-3679 Calling a Special Election regarding
Community Facilities District No. 2018-1 Pacific Arroyo. The motion carried by
unanimous voice vote.
The City Clerk opened the ballots and announced the results of the
election.
Ms. Benson made the following announcement, "I hereby certify that on
February 21, 2018, I canvassed the returns of the election held on
February 21, 2018, in the City of Moorpark Community Facilities District
No. 2018-1 Pacific Arroyo and the total number of ballots cast in said
election and the total number of votes cast for and against the measure
are as follows and the totals as stated are true and correct.

Yes Votes: 3
No Votes: 0
Mayor Parvin announced the results of the election being unanimously in
favor of the levy of the special taxes, the establishment of the
appropriations limit and the incurring of bonded indebtedness, we may
now proceed with the final actions for the District.
MOTION: Councilmember Mikos moved and Councilmember Pollock seconded
a motion to adopt Resolution No. 2018-3680 Declaring the Results of the Special
Election. The motion carried by unanimous voice vote.
Mr. Ennis read the title of Ordinance No. 462 Levying Special Taxes within
CFD 2018-1.
MOTION: Councilmember Pollock moved and Mayor Parvin seconded the
motion to waive full reading, and place the Ordinance No. 462 on the agenda for
the March 7, 2018 regular meeting for purposes of providing second reading and
adoption of the ordinance. The motion carried by unanimous voice vote.
9. PRESENTATION/ACTION/DISCUSSION:
A. Consider Resolution Establishing Parking Restrictions on Second Street
and Finding this Action to be Exempt from Environmental Review Under the
California Environmental Quality Act. (continued from January 17, 2018)
Staff Recommendation: Adopt Resolution No. 2018-3681, establishing
parking restrictions on Second Street, with a revised length of 50 feet from
the back of the respective crosswalk for each intersection, which is
reduced from the original proposal of 65 feet from the beginning of the
respective intersection, made at the January 17, 2018 City Council
meeting, and finding this action to be exempt from environmental review
under the California Environmental Quality Act.
Mr. Kroes gave the staff report.
Mei Ling, Moorpark resident on Bard Street, spoke in opposition to the
parking restrictions and the unsafe conditions of the Second Street/Bard
Street location.
A discussion followed among the Councilmembers and staff and it was
recommended that these parking restrictions be implemented for now and
the situation reviewed by the Transportation and Public Works Standing

Committee; and that a presentation of a possible alternative be considered
at a Council meeting in May 2018.
MOTION: Councilmember Van Dam moved and Mayor Parvin seconded a
motion to adopt Resolution No. 2018-3681, establishing parking restrictions on

motion to refer this to the Transportation and Public Works Standing Committee
after an interview is completed for the Access Program riders and staff then
completes an analysis of the parking restrictions for presentation of a possible
alternative at the May 2, 2018 regular City Council meeting. The motion carried
by unanimous voice vote.
10. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED)
MOTION: Councilmember Pollock moved and Councilmember Van Dam seconded a
motion to approve the Consent Calendar. The motion carried by unanimous roll call
vote.
A. Consider Minutes of Special City Council Meeting of February 7, 2018.
Staff Recommendation: Approve the minutes.
B. Consider Minutes of Regular City Council/Successor Agency Meeting of
February 7, 2018. Staff Recommendation: Approve the minutes.
C. Consider Warrant Register for Fiscal Year 2017/18 — February 21, 2018.
Staff Recommendation: Approve the warrant register.
D. Consider Surety Bond Exoneration (Bond Nos. 10010644224 and
1001064425) for PennyMac Parking Lot Expansion Project. Staff
Recommendation: Authorize the City Clerk to fully exonerate the above
Surety Bonds.
E. Consider Award of Bid to Oakridge Landscape Inc. for Landscape
Renovation in Landscape Maintenance District 22 (Moorpark Highlands)
and Resolution Amending the Fiscal Year 2017/2018 Budget to Fund the
Project. Staff Recommendation: 1) Award Bid for Spring Road /
Ridgecrest Drive Landscape Renovation project to Oakridge Landscape,
Inc. for a total contract amount of $762,776, and authorize the City
Manager to sign the Agreement, subject to final language approval of the

City Manager; and 2) Adopt Resolution No. 2018-3682, amending the
Fiscal Year Budget to fund the project. ROLL CALL VOTE REQUIRED
F. Consider Approval of a Revised Classification Plan Resolution Amending
One Competitive Service Job Description and Rescinding Resolution No.
2017-3641, and a Revised Salary Plan Resolution Affecting Three
Competitive Services Positions and Rescinding Resolution No. 2017-
3658. Staff Recommendation: 1) Adopt Classification Plan Resolution
No. 2018-3683, rescinding Resolution No. 2017-3641 and 2) Adopt Salary

12. CLOSED SESSION:
Mr. Kueny requested the City Council go into closed session for discussion of
two cases under Item 12.A. and Items 12.C, 12.D, 12.E, 12.F, 12.G, 12.H, 12.1,
12.J, 12.K, 12.L. and 12.M. on the agenda.
Mr. Ennis announced the facts and circumstances for going into closed session
for the two cases under Item 12.A. are covered under Paragraph (2) of
Subdivision (d) of Government Code Section 54956.9 with no further
announcement at this time.
MOTION: Councilmember Mikos moved and Councilmember Pollock seconded a
motion to adjourn to closed session for a discussion of two cases under Item 12.A. and
Items 12.C, 12.D, 12.E, 12.F, 12.G, 12.H, 12.1, 12.J, 12.K, 12.L. and 12.M. on the
agenda. The motion carried by unanimous voice vote. The time was 10:16 p.m.

Manager. Mr. Bobardt and Ms. Sandifer left the meeting at 10:45 p.m. The
Council reconvened into open session at 11:17 p.m. Mr. Kueny stated two cases
under Item 12.A. and Items 12.C, 12.D, 12.E, 12.F, 12.G, 12.H, 12.1, 12.J, 12.K,
and 12.L. were discussed and there was no action to report with the exception of
the following City Attorney announcement.
Mr. Ennis announced that the City Council authorized Steve Kueny to convey
information disclosed or obtained during closed sessions of items listed on this
agenda and listed on prior agendas of the City Council to incoming City Manager
Troy Brown and to permit Mr. Kueny to convey that information to Mr. Brown and
to councilmembers in the future and after Mr. Kueny's retirement from the City.
The City Council also authorized all current councilmembers to convey the same
categories of information to Mr. Brown prior to Mr. Brown assuming the office of
City Manager. The voice vote was unanimous to approve these disclosures.
Mr. Ennis and Ms. Traffenstedt left the meeting at 11:18 p.m. The Council went
back into closed session at 11:19 p.m. for discussion of Item 12.M. and
reconvened into open session at 11:43 p.m. Mr. Kueny stated Item 12.M. was
discussed and there was no action to report.
