SUBJECT: Consider Plans and Specifications for Landscaping
Improvements for Home Acres Buffer Zone
HACR6ROUND
At the January 4, 1995 City Council meeting, the City Council approved
the conceptual design for the Home Acres Buffer Zone. The buffer zone
is located at the end of Shadyridge Drive, and is approximately 1 .5
acres.
The landscaping design is a passive one, utilizing turf areas as well as
trees, and shrubs around the perimeter of the buffer zone.
California Coy7..un ' ty Builders has installed, at their cost, the colored
concrete access road for Ventura County Flood Control and for emergency
vehicles . Th'_.s wcll also serve a:; the bicycle and pedestrian path
through the buffer zone . CCB has also installed the fencing for the
buffer zone from the entrance to Shadyridge, north to the flood control
channel, west to tile northwest corne- near the Home Acres property, and
south to the north entrance off of ualaway Drive . The City will be
responsible for the reirai-der of the fencing, from south of the entrance
off of Dalaway to the southwest corner of the buffer zone and east to
the block wall next to the Belmont homes . Staff will be letting this
contract separately in order to expedite construction of the fence prior
to the landscaping improvements . The fencing element has been removed
from the plans and specifications .
The Scope of work includes all fine grading and drainage, irrigation,
landscape planting, two security lights, and two park benches . Staff is
estimating that construction of the buffer zone improvements, upon
notice to proceed by the City, should take approximately 45 working
days to complete. As is the standard practice of the City, there shall
be required a 60 day maintenance period by the contractor.
Fiscal Impact
The Landscape Architect has estimated that the costs for this project
will be approximately $70, 000 . The City currently has a fund balance of
$52 , 000 for this project , with a fourth year of assessment for
improvements recommended by the City to fund the entire improvement
project . Bids will be received on April 21, 1995, which will allow the
Council to adjust the 1995/96 assessments to reflect the actual
construction costs.
RECOMMENDATION
Approve plans and specifications for landscape improvements for the Home
Acres Buffer Zone and authorize staff to advertise for receipt of
construction bids.

HOME ACRES BUFFER ZONE LANDSCAPING PROJECT
PUBLIC NOTICE IS HEREBY GIVEN that the City of Moorpark as Agency,
invites sealed bids for the above stated project and receive such
bids in the office of the City Clerk, 799 Moorpark Avenue,
Moorpark, California, 93021 up to the hour of 2 : 00 p.m. on the
21st day of April, 1995, at which time they will be publicly
opened and read.
The Landscape Architect ' s estimated construction cost is $70, 000 .
Copies of the Plans, Specifications, and Contract Documents are
available from the City of Moorpark, at 799 Moorpark Avenue,
Moorpark, California, 93021 , upon payment of a $30 . 00 non-
refundable fee if pick-up, or payment of a $40 . 00 non-refundable
fee if mailed.
Pursuant to California Labor Code Section 1770, et . seq. , copies
of the determination of the Director of the Department of
Industrial Relations of the general prevailing rate of per them
wages for each craft, classification and type of worker needed to
execute the work are on file in, and available to any interested
person on request, at the office of the City Clerk at 799 Moorpark
Avenue, Moorpark, California, and are hereby incorporated herein
and made a part hereof as though set forth in full .
Pursuant to California Civil Code Section 3248,
the successful
bidder shall furnish to the Agency at the time of execution of the
contract a payment bond approved by the Agency in an amount equal
to one hundred percent ( 100% ) of the contract price . The
successful bidder shall also furnish to the Agency at the time of
execution of the contract a faithful performance bond approved by
the Agency in an amount equal to one hundred percent (100%) of the
contract price.
Pursuant to California Government Code Section 4590, substitution
of eligible and equivalent securities for any monies withheld to
insure performance under the contract for the work to be performed
will be permitted at the request and expense of the successful
bidder.
Bids must be prepared on the approved Proposal forms in
conformance with the Instructions to Bidders and submitted in a
sealed envelope plainly marked on the outside, "HOME ACRES BUFFER
ZONE LANDSCAPING PROJECT -- DO NOT OPEN WITH REGULAR MAIL. "
All bidders must possess a Class "A" or Class "C-27" Contractor' s
License to be eligible for the award of contract . Refer to
Instructions to Bidders for details .

INSTRUCTIONS TO BIDDERS
PROPOSAL FORMS
Bids shall be submitted in writing on the forms provided by the
Agency, use of other forms may be cause for rejection of bids .
All information requested therein must be clearly and legibly set
forth in the manner and form indicated. The Agency will not
consider any proposal not meeting these requirements .
PROPOSAL GUARANTEE
Proposals must be accompanied by a proposal guarantee consisting
of a certified or cashier ' s check or bid bond payable to the
Agency in the amount not less than ten percent (100) of the total
amount bid. Any proposal not accompanied by such a guarantee will
not be considered. If a bidder to whom a contract is awarded
fails or refuses to execute the contract documents or furnish the
required insurance policies and bonds as set forth in those
documents , the proposal guarantee shall be forfeited to the
Agency. The proposal guarantees of all bidders will be held until
the successful bidder has properly executed all contract
documents .
DELIVERY OF PROPOSAL
Proposals shall be enclosed in a sealed envelope plainly marked on
the outside, "HOME ACRES BUFFER ZONE LANDSCAPING PROJECT -- DO NOT
OPEN WITH REGULAR MAIL" . Proposals may be mailed or delivered by
messenger. However, it is the bidder' s responsibility alone to
ensure delivery of the proposal to the hands of the Agency' s
designated official prior to the bid opening hour stipulated in
the Notice Inviting Sealed Bids . Late proposals will not be
considered.
WITHDRAWAL OF PROPOSALS
A proposal may be withdrawn by a written request signed by the
bidder. Such requests must be delivered to the City Clerk prior
to the bid opening hour stipulated in the Notice Inviting Sealed
Bids . Proposals may not be withdrawn after said hour without
forfeiture of the proposal guarantee . The withdrawal of a
proposal will not prejudice the right of the bidder to submit a
new proposal, providing there is time to do so.
IRREGULAR PROPOSALS
Unauthorized conditions , limitations , incompleteness , or
provisions attached to a proposal will render it irregular and may
cause its rejection . The completed Proposal forms shall be
without interl ineat ions, alterations, or erasures . Alternative
proposals will not be considered unless specifically requested.

Nor oral , telegraphic, or telephonic proposal, modification, or
withdrawal will be considered. Bids with supplemental information
or forms other than those proposed forms provided by the Agency
may not be considered.
TAXES
No mention shall be made in the proposal of Sales Tax, Use Tax or
any other tax, as all amounts bid will be deemed and held to
include any such taxes which may be applicable.
DISQUALIFICATION OF BIDDERS
In the event that any bidder acting as a prime contractor has an
interest in more than one proposal, all such proposals will be
rejected, and the bidder will be disqualified. This restriction
does not apply to subcontractors or suppliers who may submit
quotations to more than one bidder, and wile doing so, may also
submit a formal proposal as a prime contractor.
No award will be made to a bidder who has not been licensed in
accordance with the provisions of the State Business and
Professions Code by the date of the award of contract . All
bidders must possess a Class "A" or Class 11C-27 " Contractor ' s
License to be eligible for the award of contract . Bidders having
only a "C-27 " license must show proof that they have retained
services of a subcontractor with the proper license to perform the
asphalt work and the water service installation work required by
the plans and specifications .
DISCREPANCIES AND MISUNDERSTANDINGS
Bidders must satisfy themselves by personal examination of the
work site, Contract Documents, Specifications and by any other
means as they may believe necessary, as to the actual physical
conditions, requirements and difficulties under which the work
must be performed. No bidder shall at any time after submission
of a proposal make any claim or assertion that there was any
misunderstanding or lack of information regarding the nature or
the amount of work necessary for the satisfactory completion of
the job. Any errors, omissions, or discrepancies found in the
Plans, Specifications, or Contract Documents shall be called to
the attention of the Agency and clarified prior to the submission
of proposals . Neither the City nor any of its officers ,
employees , or servants assumes any responsibility for errors or
misinterpretations resulting from the receipt or use of an
incomplete set of contract documents or addenda. The bidder must
satisfy himself that he has received a complete set of contract
documents and addenda.
Written addenda shall be the sole means for modifying the Plans
and/or Specifications prior to the bid opening. The Agency shall

not be bound by oral communications purportedly modifying or
interpreting the Plans and/or Specifications regardless of when or
by whom such oral communications are made and you should not rely
upon such oral communications in preparing your bid.
REPORTS AVAILABLE
No reports have been prepared regarding the condition of the base
or sub-base material .
LEGAL RESPONSIBILITIES
All proposals must be submitted, filed, made and executed in
accordance with State and Federal laws relating to bids for
contracts of this nature whether the same is expressly referred to
herein or not .
Any bidder submitting a proposal shall by such action thereby
agree to each and all of the terms, conditions, provision, and
requirements set forth, contemplated, and referred to in the
Specifications, and Contract Documents, and to full compliance
therewith.
AWARD OF CONTRACT
The award of contract, if made, will be to the lowest responsible
bidder as determined solely by the Agency. Additionally, the
Agency reserves the right to reject any or all proposals, to waive
any irregularity, and to take the bids under advisement for a
period of sixty (60) days, all as may be required to provide for
the best interests of the Agency. In no event will an award be
made until all necessary investigations are made as to the
responsibility and qualifications of the bidder to whom the award
is contemplated. All bids will be compared with the Director ' s
Estimate .
TIME FOR COMMENCEMENT AND COMPLETION
Contractor shall commence the work within the time required in the
bidding documents as summarized above, and shall have fully
complied with Sub-Sections 2-1, 2-4 , and 6-1 of the General
Provisions . The Contractor shall diligently prosecute the work to
completion within the number of working days specified in the
proposal after the award of the contract by the City Council .
Upon written request of the Contractor and if approved in writing
by the Director, the time for commencement, completion or both may
be extended.

In accordance with Agency ' s Notice Inviting Sealed Bids, and the
instructions to bidders, the undersigned bidder hereby proposes to
furnish all materials, equipment, tools, labor, transportation,
and incidentals required for the above stated project as set forth
in the Contract Documents, Plans, Specifications, and to perform
all work in the manner and time prescribed therein.
Bidder declares that this proposal is based upon careful
examination of the work site, Plans, Specifications, Instructions
to Bidders, and all other contract documents. If this proposal is
accepted for award, bidder agrees to enter into a contract with
Agency at the unit and/or lump sum prices set forth in the
following Bid Schedule . Bidder understands that failure to enter
into a contract in the manner and time prescribed will result in
forfeiture to Agency of the guarantee accompanying this proposal .
Bidder understands that a bid is required for the entire work,
that the estimated quantities set forth in the Bid Schedule are
solely for the purpose of comparing bids , and that final
compensation under the contract will be based upon the actual
quantities of work satisfactorily completed. THE AGENCY RESERVES

the unit and/or lump sum prices bid include all appurtenant

AGREEMENT **
(Public works Contract)
THIS AGREEMENT, made and entered into this day of
_ 1995, in the County of Ventura, State of
California, by and between the City of Moorpark, a municipal
corporation (hereinafter "Agency" ) and
(hereinafter "Contractor" ) .
WHEREAS, the City Council of the City of Moorpark at a
meeting held on day of , 19 ,
authorized the Mayor and City Clerk to enter into this Agreement
after public bidding in accordance with California Public Code
Section 20160, et sea.
NOW, THEREFORE, it is hereby agreed by and between the
parties that :
1 . Defined Terms
1 . 1 Terms used in this Agreement which are defined in the
General Provisions and Special Provisions have the meaning
assigned to them in the General Provisions and Special
Provisions of the Contract Documents and Specifications .
2 . Scope of Work
2 . 1 The Contractor shall furnish all of the labor,
materials , tools, equipment, services and transportation
necessary to perform all of the work described as follows :

2 . 3 The Contractor shall be liable to the Agency for any
damages arising from, or as a result of, a failure to fully
comply with the Contract Documents . Contractor shall not be
excused with respect to any failure to so comply by any act
or omission of the Agency, its officers, employees or agents,
unless such act or omission actually prevents the Contractor
from fully complying with the requirements of the Contract
Documents .
3 . Schedule
3 . 1 The Contractor shall commence the work on the date
stated in the Notice to Proceed and shall diligently pursue
the work to completion within ( ) working
days thereafter, and upon the work schedule, if any, as
specified in the Special Provisions, except at such time may
be extended in writing by the Agency in accordance with the
Specifications, time being of the essence.
4. Liquidated Damages
4 . 1 If the Contractor fails to complete the work, or any
portion thereof, within the time period required by Article 3
herein or as duly extended in writing by the Agency, he shall
forfeit and pay to the Agency, as liquidated damages, the sum
of dollars ($ . 00) per day for each calendar
day the work, or portion thereof, remains uncompleted after
the above specified completion date. The liquidated damages
shall be deducted from any payments due or to become due to
the Contractor under the terms of this contract . [Gov' t C .
Sec . 53069 . 851 Progress payments made by the Agency after
the above specified completion date shall not constitute a
waiver of liquidated damages by the Agency.
5. Contract Price
5 . 1 The Agency shall pay to the Contractor as full
consideration for the faithful performance of the contract
entered into by this Agreement, subject to any additions or
deductions as provided in the Contract Documents the sum of
dollars ($ ) , said sum being
the total amount of the amounts stipulated in the
Contractor ' s Proposal attached as Exhibit "A" of this
Agreement .

6. Payments
6 . 1 If the Special Provisions do not provide for progress
payments, the Contractor shall be paid within thirty-five
(35) days after Contractor furnishes Agency with a release of
all undisputed contract amounts , if required by Agency, and
final acceptance of the work by the City Council .
6 .2 If progress payments are to be made pursuant to the
Special Provisions , Contractor shall submit the required
monthly statement to the Director commencing on the 10th day
of month after the Agency issues the Notice to Proceed and,
if required by Director, a release of all undisputed contract
amounts related to said statement .
6 . 3 In the event there is any claim specifically excluded by
Contractor from the operation of the release, there shall be
retained by Agency an amount not to exceed the amount of the
disputed claim [P.C.C . Sec . 7100]
7 . Legal Requirements
7 . 1 Pursuant to California Labor Code Section 1810, et sea. ,
eight ( 8 ) hours labor constitutes a legal day ' s work.
Contractor shall forfeit as a penalty to Agency the sum of
$25 . 00 for each worker employed in the execution of the
contract by Contractor or subcontractor for each calendar day
in which such worker is required or permitted to work more
than 8 hours in any one calendar day and 40 hours in any one
calendar week in violation of the provisions of Labor Code
Section 1815 . [Labor Code Sec . 1813]
7 . 2 (A) Copies of the determination of the Director of the
Department of Industrial Relations of the rate of per diem
wages for each craft, classification or type of worker needed
to execute the contract are on file in, and available at, the
office of the City Clerk, 799 Moorpark Avenue, Moorpark, CA

(B) The Contractor shall post at the work site, for the
duration of the contract, a copy of the determination of the
specified prevailing rate of per diem wages . [Labor Code
Sec . 1773 .21
(C) The Contractor, and any subcontractor, under the
Contractor, shall pay not less than the specified prevailing
rate of per diem wages to all workers employed in the
execution of the contract . [Labor Code Sec . 1771] The
contractor shall have responsibility for compliance with
California Labor Code Section 1776 relative to the retention
and inspection of payroll records . [Labor Code Sec. 1776]

7 . 3 The Agency shall withhold penalties and forfeitures from
payments due to the Contract for noncompliance with the
California Labor Code [Labor Code Sec. 1727] .
_ 7 .4 Nothing in this contract shall prevent the Contractor or
any subcontractor from employing properly registered
apprentices in the execution of the contract . The Contractor
shall have responsibility for compliance with California
Labor Code Section 1777 . 5 for all apprentice occupations .

7 . 5 Neither the Contractor, nor any subcontractor under the
Contractor, shall discriminate in the employment of persons
upon the work because of the race, religious creed, color,
national origin, ancestry, physical handicap, medical
condition, marital status or sex of such person, except as
provided in Section 12940 of the Government Code . The
Contractor shall have responsibility for compliance with this
Section. [Labor Code Sec . 1735]
7 . 6 Contractor shall, at Contractor ' s sole expense, obtain
all necessary permits and licenses for the work and give all
necessary notices and pay all fees and taxes required by law.

9 . Independent Contractor
9 . 1 The Contractor is and shall at all times remain as to
the Agency a wholly-independent Contractor . Neither the
Agency nor any of its officers, employees, or agents shall
have control over the conduct of the Contractor or any of the
Contractor ' s officers , employees , servants , agents or
subcontractors, except as set forth in the Contract Documents
and Specifications . The Contractor shall not at any time or
in any manner represent that it or any of its officers,
employees , agents, or subcontractors, are in any manner
officers, employees, agents or subcontractors of the Agency.
10 . Indemnification
10 . 1 The Contractor hereby agrees to indemnify, defend and
hold harmless the Agency, and its officers, employees,
servants and agents from and against any and all claims,
liability, loss, damage, cost, and expense, including court
costs and attorneys ' fees, whether or not litigations be
commenced, of whatever nature or type, that the Agency or any
of its officers, employees or agents, may hereinafter suffer,
incur, be put to pay or lay out by reason of :
(1) Any injury or death to any person or damage to any
property sustained or alleged to have been sustained as
a result of the work, or the performance thereof,
contemplated hereby, or any defect in material ,
equipment or workmanship that becomes evident within one
year after the date of recordation of the notice of
completion.
(2 ) Any other act or omission of the Contractor, its agents,
representatives or other persons who are at any time
engaged in the course of work or in the repair,
replacement or restoration of any portion of the work
made necessary by any defect in material or workmanship
including, but not limited to, subcontractors, laborers,
materialism and suppliers; or
(3 ) Any breach or default of the Contractor in the
performance of its obligations hereunder.

10 . 2 The aforesaid Indemnification and Held Harmless
Agreement shall not include any claims of liability arising
from the established sole negligence of willful misconduct of
the City or its officers, employees, servants or agents .
10 . 3 The aforesaid Indemnification and Held Harmless
Agreement shall apply regardless of whether or not the
insurance policies specified in this agreement or other
Contract Document shall have been determined to be applicable
to the claim, liability, loss, damage, cost or expense.
11 . Insurance
11 . 1 Contractor shall not commence work until he shall have
purchased, at his sole expense, from one or more good and
responsible companies doing insurance business in the State
of California and shall have furnished to the City Clerk
certificates of all insurance required under this Article and
such insurance shall have been approved by the Agency as to
form, amount and terms ; nor shall Contractor allow any
subcontractor to commence work on his subcontract until all
similar insurance required on the subcontractor shall have
been so obtained and approved. Each such policy of insurance
shall be maintained in full force and effect for the duration
of the contract and shall bear an endorsement or shall have
attached a rider whereby it is provided that, in the event of
expiration or proposed cancellation or amendment of the
policy for any reason whatsoever, the City Clerk shall be
notified by registered mail, postage prepaid, return receipt
requested, not less than thirty (30 ) days before the
expiration, cancellation or amendment is effective.
11 . 2 Contractor, and every subcontractor, shall provide
comprehensive liability insurance in which the Agency is the
named insured or is named as an additional insured.
Notwithstanding any inconsistent statement in the policy or
any subsequent endorsement attached thereto, the protection
offered by the policy shall :
(1) Insure the Agency and its officers, employees, servants
and agents from claims for damages for personal injury
to any person, including death and for damage to the
property of any person which may arise or result from
Contractor ' s or any subcontractor ' s execution of the
work or other obligation under the execution of the work
or other obligation under the Contract Documents,
whether such execution be by Contractor or by any
subcontractor or by anyone directly or indirectly
employed by either Contractor or any subcontractor.
(2) Provide the minimum limits set forth in the
Specifications .

11 . 3 Contractor, and every subcontractor, shall provide
complete workers ' compensation insurance in accordance with
the requirements of Section 3800 of the California Labor
Code . If any class of employees engaged in the work is not
protected under any workers ' compensation law, Contractor
shall provide, and shall cause each subcontractor to provide,
adequate insurance for the protection not otherwise
protected . Contractor shall indemnify, defend and hold
harmless the Agency and its officers, employees, servants and
agents from any claim resulting from failure of either
Contractor or any subcontractor to take out or maintain such
insurance.
12 . Aaency' s Right to Terminate
12 . 1 . If the Contractor refuses or fails to prosecute the
work or any separable part thereof with such diligence as
will insure it completion within the time specified or any
extension thereof, or fails to complete said work within such
time, or if the Contractor should be adjudged a bankrupt, or
if he should make a general assignment for the benefit of his
creditors, or if a receiver should be appointed on account of
his insolvency, or if he should persistently or repeatedly
refuse or should fail, except in cases for which extension of
time is provided, to supply enough properly skilled workers
or proper materials to complete the work in the time
specified, or if he should fail to make prompt payment to
subcontractors or for material or labor, or persistently
disregard laws, ordinances, or instructions of the Agency, or
otherwise breach any reasons for such intention to terminate.
Unless within five (5) days after the service of such notice
such condition or violation shall cease or satisfactory
arrangements for the correction thereof be made, this
contract shall upon the expiration of said five (5) days,
cease and terminate. In such case, Contractor shall not be
entitled to receive any further payment until the work is
finished.
12 .2 Performance by Surety or Agency. In event of any such
termination, the Agency shall immediately serve written
notice thereof upon surety and Contractor and surety shall
have the right to take over and perform this contract,
provided, however, that if surety within five (5) days after
service upon it of said notice of termination does not give
the Agency written notice of its intention to take over and
perform this contract or does not commence performance
thereof within ten (10) days from the date of servicing such
notice, the Agency may take over the work and prosecute the
same to completion by contract or by any other method it may
deem advisable for the account and at the expense of the
Contractor, and he and his surety shall be liable to the
Agency for any excess cost or other damages occasioned the
Agency thereby.

If the Agency takes over the work as hereinabove provided,
the Agency may, without liability for so doing, take
possession of , and utilize in completing the work, such
materials, appliances, plant, and other property belonging to
the Contractor as may be on the site of the work and
necessary therefore.
Additional Costs of finishing work, including compensation
for additional engineering, architectural, managerial, and
administrative services, shall be paid to the Agency, without
prejudice to any other rights or remedies available at law or
in equity to the Agency.
13 . Notice
13 . 1 Whenever it shall be necessary for either party to
serve notice on the other respecting the contract, such
notice shall be served by registered mail, postage prepaid,
return receipt requested, addressed to the City of Moorpark,
799 Moorpark Avenue, Moorpark, California, 93021, and to the
Contractor at :
unless and until different addresses may be furnished in
writing by either party to the other.
13 . 2 Notice shall be deemed to have been served seventy-two
(72 ) hours after the same has been deposited in the United
States Postal Service. This shall be a valid and sufficient
service of notice for all purposes .
14 . Assignment
14 . 1 The Contractor shall not assign the performance of the
contract , nor nay part thereof, nor any monies due or to
become due hereunder, without the prior written consent of
the Agency. It is understood and acknowledged by the parties
that the contractor is the lowest responsible bidder
qualified to perform the work.
14 . 2 Subject to the provision of this Article regarding
assignment, the contract shall be binding upon the heirs,
executors , administrators, successors, and assigns of the
Contractor.

15 . Attorney ' s Fees
15 . 1 If any action at law or in equity, including an action
for declaratory relief, is brought to enforce or interpret
the provisions of the contract, the prevailing party shall be
entitled to reasonable attorney ' s fees, court costs and
necessary disbursements, in addition to any other relief to
which it may be entitled.
16 . Miscellaneous Provisions
16 . 1 Should a change be contemplated in the name or nature
of the Contractor ' s legal entity, the Contractor shall first
notify the Agency in order that proper steps may be taken to
have the change reflected in the Contract Documents .
16 .2 The contract shall be effective from and after the date
that this Agreement is signed by the representatives of the
Agency.
16 . 3 This Agreement is made in three (3 ) duplicate
originals .
16 . 4 The captions of the articles, sections , subsections,
paragraphs, and subparagraphs of the Contract Documents are
for reference only and are not to be construed in any way as
a part of the contract .
16 . 5 The remedies contained in this agreement , are
cumulative, and in addition to and not limitation of, any
remedy at law or in equity to which the City may be entitled.
17 . Entire Agreement
17 . 1 The Contract Documents integrate all terms and
conditions in connection with the work called for herein and
supersede all negotiations and prior understandings, either
oral or in writing, in respect to the subject matter hereto.
17 . 2 The Contract Documents are intended to be
complimentary . Work required by one of the Contract
Documents and Specifications and not by others shall be done
as if required by all .
17 . 3 Each and every provision of law and clause required to
be inserted into the Contract Documents shall be deemed to be
inserted therein, and if through mistake or otherwise any
such provisions is not inserted, or is not inserted
correctly, then upon application of either party, the
Contract Documents shall forthwith be amended in writing to
make such insertion or correction.

17 .4 The Contract Documents shall not be amended except by a
writing duly executed by the parties .

Unemployment Insurance Code with respect to such work and labor
the surety hereon shall pay for the same in any amount not
exceeding the sums specified in this bond, otherwise the above
obligation shall be void. In case suit is brought upon this bond,
the court shall fix and award and the surety shall pay, in
addition to the fact amount hereof , costs and reasonable
attorney ' s fees incurred by the City of Moorpark in successfully
enforcing said obligation. This bond will inure to the benefit of
any and all persons, companies and corporations entitled to file

SECTION 2 - SCOPE AND CONTROL OF THE WORK
2-1 AWARD AND EXECUTION OF CONTRACT
Within ten working days after the date of the Notice of Award
is received, the Contractor shall execute and return the
following contract documents to the Agency:

Public Liability and Property Damage Insurance

Worker ' s Compensation Insurance Certificate
Failure to comply with the above will result in annulment of
the award.

The Contract Agreement shall not be considered binding upon
the Agency until executed by the authorized Agency officials .
A corporation to which an award is made may be required to
furnish evidence of its corporate existence, of its right to
enter into contracts in the State of California, and that the
officers signing the contract and bond have the authority to
do so.
2-4 CONTRACT BONDS
The third and fourth paragraphs are amended and supplemented
to read as follows :
The Bidder shall provide good and sufficient surety
bonds . The "Payment Bond" (Material and Labor Bond)
shall be for not less than 100 percent of the contract
price, to satisfy claims of material suppliers and of
mechanics and laborers employed by it on the work. Said
Bonds shall be issued by an admitted surety insurer and
shall be maintained by the Contractor in full force and
effect until six months after the date of recordation of
the Notice of Completion.
The " Performance Bond" shall be for 100 percent of the
contract price to guarantee faithful performance of all
work, within the time prescribed, in a manner
satisfactory to the Agency, and that all materials and
workmanship will be free from original or developed
defects . The bond shall remain in force until one year
from the date of recordation of the Notice of
Completion.
2-5 PLANS AND SPECIFICATIONS
2-5 . 4 Standard Specifications . The Standard Specifications
of the agency are contained in the latest edition of the
Standard Specifications for Public Works Construction,
including all supplements, as written and promulgated by the
Joint Cooperative Committee of the Southern California
District of the Associated General Contractors of California.
Copies of these Standard Specifications are available from
the publisher, Building News , Incorporated, 3055 Overland
Avenue, Los Angeles, California, 90034, Telephone (310) 202-
7775 .
The Standard Specifications set forth above will control the
general provisions, construction material, and construction
methods for this contract except as amended by the Plans,
Special Provisions, Special Permits , or any other contract
documents . The Special Provisions are supplementary and in
addition to the provisions of the Standard Specifications .
Only those sections requiring elaboration, amendments,
specifying of options, or additions are called out .

2-5 . 5 Plans . The plans for the project are those plans
identified as Plan No. 94-ML-10487 .
SECTION 4 - CONTROL OF MATERIALS
4-1 MATERIALS AND WORKMANSHIP
4-1 . 3 . 4 Contractor ' s Guarantee . The Contractor and all
subcontractors, suppliers, and vendors, shall guarantee that
the entire work will meet all requirements of this contract
as to the quality of materials, equipment, and workmanship.
The Contractor, at no cost to the Agency, shall make any
repairs , restorations or replacements made necessary by
defects in material, equipment, or workmanship that become
evident within one year after the date of recordation of the
Notice of Completion. Within this one year period, the
Contractor shall also restore to full compliance with the
requirements of this contract any portion of the work which
is found to not meet those requirements .
The Contractor shall make all repairs, replacements, and
restorations within thirty days after the date of the
Director' s written notice.
4-1 .3 . 5 Inspection. The Agency shall provide inspection
for an 8-hour day and 40-hour week for normal working days .
The Contractor shall reimburse the Agency at rates
established by the Agency for inspection in excess to the
foregoing, including legal holidays, Saturdays and Sundays .
Authorization to work other than normal working days is
subject to approval of the Director.
4-1 .4 Test of Materials . Except as elsewhere specified,
the Agency will bear the cost of testing material and/or
workmanship which meet or exceed the requirements indicated
in the Standard Specifications and the Special Provisions .
The cost of all other tests , including the retesting of
material or workmanship that fails to pass the first test,
shall be borne by the Contractor.
SECTION 5 - UTILITIES
5-1 LOCATION
The location and existence of substructures have been
determined by a search of records maintained by their owners .
No guarantee is made or implied that the information shown is
complete or accurate . It shall be the Contractor ' s
responsibility alone to determine the exact location of
substructures of every nature and to protect them from
damage . The Contractor shall pothole or expose all high risk
underground facilities .

listed on the cover sheet of the plans .
SECTION 6 - PROSECUTION, PROGRESS, ACCEPTANCE OF THE WORK
6-1 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK
The Contractor ' s proposed Construction Schedule shall be
submitted to the Director within ten working days after the
date of the Agency' s execution of the Agreement .
Prior to issuing the Notice to Proceed, the Director will
schedule a pre-construction meeting with the Contractor to
review the proposed Construction Schedule and delivery dates,
arrange utility coordination, discuss construction methods,
and clarify inspection procedures .
The Contractor shall not perform any work prior to receiving
a copy of the Agreement signed by the Agency and a Notice to
Proceed.
SECTION 7 - RESPONSIBILITIES OF THE CONTRACTOR
7-1 CONTRACTOR' S EQUIPMENT AND FACILITIES
A noise level limit of 86 dba at a distance of fifty feet
shall apply to all construction equipment on or related to
the job whether owned by the Contractor or not . The use of
excessively loud warning signals shall be avoided except in
those cases required for the protection of personnel .
7-2 LABOR
7-2 .2 Laws . The Contractor, and all subcontractors,
suppliers and vendors, shall comply with all Agency, State,
and Federal orders regarding affirmative action to ensure
equal employment opportunities and fair employment practices .
Failure to file any report due under said orders will result
in suspension of periodic progress payments . The Contractor
shall ensure unlimited access to the job site for all equal
employment opportunity compliance officers .
7-2 . 3 Prevailing Rates of Wages . In accordance with
California Labor Code Section 1770 et . sea. , determinations
of the generally prevailing wages for various classes of
workers in Ventura County have been made by the California
Director of Industrial Relations as required by law.
The determinations made by the State are on file with the
Agency. A copy will be furnished without cost to the
successful bidder. The Contractor shall post a copy of both
wage rates at each job site at a location readily available
to the workers .

As required by California Labor Code Section 1777 . 5, only
properly indentured apprentices shall be employed on the
work. Travel and subsistence shall be paid in accordance
with California Labor Code Section 1773 .8 .
Information relative to apprenticeship standards , wage
schedules and other requirements may be obtained from the
Director of Industrial Relations , ex-officio of the
Administrator of Apprenticeship, San Francisco, California,
or from the Division of Apprenticeship Standards and its

7-5 PERMITS
The text of Subsection 7-5 of the Standard specifications is
hereby deleted and replaced with the following:
Prior to the start of any work, the Contractor shall take out
the applicable Agency permits and make arrangements for
Agency inspections . The Agency will issue the permits at no
charge to the Contractor . The Contractor and all
subcontractors shall each obtain an Agency business license,
and shall be licensed in accordance with the State Business
and Professions Code . The Contractor shall also obtain and
pay for any and all other permits, licenses , inspections,
certificates , or authorizations required by any governing
body or entity.
7-9 PROTECTION AND RESTORATION OF EXISTING
IMPROVEMENTS
The second paragraph of Subsection 7-9 of the Standard
Specifications is hereby deleted and replaced with the
following:
The Contractor shall restore, relocate, repair, replace or
reestablish all existing improvements within the project
limits which are not designated for removal (e .g. fences,
sprinkler systems , utility installations, structures, etc . )
which are damaged or removed as a result of the Contractor ' s
operations or as required by the Plans and Standard
Specifications .
The last paragraph of Subsection 7-9 of the Standard
Specifications is hereby deleted and replaced with the
following:
All cost to the Contractor for protecting, removing,
restoring, repairing, replacing, or reestablishing existing
improvements shall be considered included in applicable bid
items .
7-10 PUBLIC CONVENIENCE AND SAFETY
7-10 . 1 Traffic and Access . The Contractor shall notify
the occupants of all affected properties at least forty-eight
hours prior to any temporary obstruction of access .
Vehicular access to property line shall be maintained except
as required for construction for a reasonable period of time.
No overnight closure of any driveway will be allowed except
as permitted by the Director.
At least one twelve foot wide traffic lane shall be provided
for each direction of travel on all streets at all times
except as permitted by the Director.

The traffic lanes shall be maintained on pavement, and shall
remain unobstructed. Lane transitions shall not be sharper
than a taper of thirty to one.
The Contractor shall maintain turning movements at all times
unless otherwise approved by the Director.
Clearances from traffic lanes shall be five feet to the edge
of any excavation and two feet to the face of any curb,
pole, barricade, delineator, or other vertical obstruction.
7-10 . 3 Street Closures, Detours , Barricades . Street
Closures will not be allowed except as specifically permitted
by the Director.
Temporary traffic channelization shall be accomplished with
barricades or delineators .
7-10 . 5 Protection of the Public . The following minimum
restrictions shall be maintained by the Contractor in the
conduct of his work.
It is part of the work required of the contractor to make
whatever provisions are necessary to protect the public. The
Contractor shall use foresight and shall take such steps and
precautions as his operations warrant to protect the public
from danger, loss of life or loss of property, which would
result from interruption or contamination of other public
works or public service, or from the failure of partly
completed work or the work which will require that immediate
and unusual provisions be made to protect the public from
danger or loss, or damage to life and property, due directly
or indirectly to prosecution of work under this contract .
Whenever, in the opinion of the Director, an emergency
exists against which the Contractor has not taken sufficient
precaution for the public safety, protection of utilities,
public works or service or protection of adjacent structures
or property, which may be damaged by the Contractor ' s
operations and when, in the opinion of the Director,
immediate action shall be considered necessary in order to
protect the public or property due to the Contractor ' s
operations under his contract, the Director will order the
contractor to provide a remedy for the unsafe condition. If
the Contractor fails to act promptly on the situation, the
Director may provide suitable protection to said interest by
causing such work to be done and material to be furnished as,
in the opinion of the Director, may seem reasonable and
necessary.
The cost and expense of said labor and material , together
with the cost and expense of such repairs as are deemed
necessary, shall be borne by the Contractor.

All expenses incurred by the Agency for emergency repairs
will be deducted from the progress payments and the final
payment due to the Contractor. However, if the Agency does
not take such remedial measures , the Contractor is not
relieved of the full responsibility for public safety.
7-10 . 6 Payment for the traffic control plan, detours,
traffic control and public convenience for the entire project
shall be considered as included in applicable bid items, and
no additional payment will be made therefore. No additional
payment will be allowed for night and weekend work necessary
to prepare and maintain traffic control and public
convenience.
SECTION 9 - MEASUREMENT AND PAYMENT
9-3 PAYMENT
9-3 .2 Partial and Final Payment . The last paragraph of
Subsection 9-3 . 2 of the Standard Specifications is hereby
deleted and replaced with the following:
The closure date for progress payments will be the
twenty-fifth day of each month. The Contractor shall
prepare the measurement of the work performed through
the closure date and submit it to the Agency for
approval by the tenth day of the month. Payments are
commonly authorized and made within thirty days
following the tenth day of the month submitted.
However, payments will be withheld pending receipt of
any outstanding reports required by the contract
documents .
The full ten percent retention will be deducted from all
payments . The final retention will be authorized for
payment thirty-five days after the date of recordation
of the Notice of Completion.
9-4 TERMINATION OF AGENCY LIABILITY
Prior to receiving final payment, the Contractor shall
execute a "Release on Contract" form which shall operate as,
and shall be, a release to the Agency, the City Council and
each member of the City Council and their agents, from all
claims of and liability to the Contractor for anything done
or furnished for, or relating to, the work or for any act of
neglect of the Agency or of any person relating to or
affecting the work, except the claim against the Agency for
the remainder, if any there be, of the amounts kept or
retained as provided in Subsection 9-3 and except for any
unsettled claims listed on said form which have been filed in
compliance with the requirements for making claims .

A payment of $1 . 00 will be made to the Contractor for
executing this document . An example of the "Release on
Contract" form is in Section D.
SECTION 10 - DIVERSION AND CONTROL OF WATER
10-1 DESCRIPTION
This section covers the diversion and control of all water
entering into the construction area or otherwise affecting
construction activities .
All permanent construction shall be performed in a site free
from water unless otherwise provided for in the Special
Provisions . The Contractor shall construct, maintain and
operate all necessary cofferdams, pumps, channels, flumes,
drains and/or other temporary diversion and protective works
required for diversion and control of water, whatever its
source, during construction.
Inundation of partially completed work due to lack of control
during non-working periods will not be permitted and may be
cause for requiring removal of work already completed with
replacement at the Contractor' s expense.
The contractor shall be responsible for obtaining the use of
any property in addition to that provided for in the Plans
and Standard Specifications, which may be required for the
diversion and protective works so as not to create a hazard
to persons or property or to interfere with the water rights
of others .
10-2 DIVERSION AND CONTROL WORKS
Prior to beginning work involving diversion and control of
water, the Contractor shall submit a water control plan to
the Director. In event circumstances during the course of
construction require changes to the original water control
plan, a revised water control plan shall be promptly
submitted to the Director in each instance.
Construction and operation of the diversion and control works
shall be in accordance with the water control plan submitted,
except as deviation therefrom may be specifically approved by
the Director. No responsibility shall accrue to the Director
or the Agency as a result of the plan, or knowledge of the
plan, or any deviation therefrom approved by the Director.
All works installed by the Contractor in connection with
dewatering, control, and diversion of water but not specified
to become a permanent part of the project, shall be removed

and the site restored, insofar as practical, to its original
condition prior to completion of construction or when
directed by the Director.
10-3 PAYMENT
When a separate bid item is included for "Diversion and
Control of Water" , progress payments will be computed by the
Director based on his estimate of the percentage completion
of this item of the work . In general , this will be
proportional to the percentage completion of the major items
of the work to which diversion of water is incidental . When
no separate bid item is included, payment for this work will
be considered to be included in the payments made for the
other items of contract work to which water control is
incidental .

SPECIAL PROVISIONS
SECTION 600 GENERAL CONDITIONS
600-1 Description
The work to be performed under this Specification consists of
furnishing by the Contractor, in accordance with these
specifications and subject to the terms and conditions of the
Agreement , all materials , equipment, tools , labor, and
incidentals necessary for the construction of the proposed
project, complete in place.
The scope of work to be accomplished by the Contractor under
these specifications shall include, but not necessarily be
limited to, the following general categories of work:
earthwork and the construction of storm drains , retaining
walls and pavement in order to provide an access road in
accordance with the plans and specifications .
600-2 Plans
The plans showing the work to be done are set forth in a set
of plans identified as Plan No .
600-3 Standard Specifications
Except as hereinafter provided, the provisions of the
Standard Specifications for Public Works Construction, dated
1994 or latest revision, along with the modifications thereto
in the General Provisions, have been adopted as the Standard
Specification by the Agency. These specifications will
prevail as the basic Standard Specifications for this
project, except as otherwise specifically noted in the
Special Provisions where reference has been made to the State
Standard Specifications . The State Standard Specifications
is that document issued by the State of California,
Department of Transportation, titled Standard Specifications,
July 1992 , referred to herein as the State Standard
Specifications, or SSS .

600-5 Liability Insurance
The liability insurance coverage shall be as outlined in
Subsection 7-3 , " Liability Insurance" , of the General
Provisions .
An Additional Insured Endorsement to the Contractor ' s
liability insurance policy naming the Agency and its
officers , employees , and consultants as additional insured
shall be contained on the Certificate of Insurance form
approved by the Agency.
600-6 Investigation of Site Conditions
Bidders are urged to visit the sites of the work and by their
own investigations satisfy themselves as to the existing
conditions affecting the work to be done under these
specifications . If the bidder chooses not to visit the site
or conduct investigations, he will nevertheless be charged
with knowledge of conditions which reasonable inspection and
investigation would have disclosed.
Bidders and the contractor shall assume all responsibility
for deductions and conclusions as to the difficulties in
performing the work.
600-7 Payment
No separate payment will be made for work or other features
as required and outlined in this section. Full compensation
for such work and features shall be considered included in
the price bid for other items of work, and no additional
compensation will be allowed therefor.

SECTION 601 GENERAL CONSTRUCTION REQUIREMENTS
601-1 Emeraency Information
The Contractor shall provide the following information in
writing and submit it with the signed contract, and contract
bonds and certificates of insurance. Failure to comply may
result in delays in the processing of the contract documents .
1 . Name of authorized representative at the job site.
2 . Address and telephone number where the above
person can be reached.
3 . Address of the nearest office of the Contractor,
if any, and the name and telephone number of a
person at that office who is familiar with the
project.
4 . Address and telephone number of the Contractor ' s
main office and the name and telephone number of
the person at that office familiar with the
project .
601-2 Mobilization
Mobilization shall consist of preparatory work and operations
including, but not limited to, those necessary for the
movement of personnel, equipment, supplies, and incidentals
to the project sites, and for all other work operations which
must be performed, or cost incurred, prior to beginning work
on the various contract items on the project sites.
601-3 Construction Schedule and Hours
Two weeks prior to starting any construction work, the
Contractor shall submit to the Director for review a project
construction schedule in accordance with Subsection 6-1,
"Construction Schedule and Commencement of Work" .

601-4 Order of Work
A pre-construction conference will be held prior to the
commencement of the construction - at a place and time
designated by the Director, or the Director ' s designee - with
the Contractor' s representatives, City of Moorpark staff, and
other affected parties . Among the primary points of
discussion at this meeting, shall be the Contractor ' s
proposed construction schedule . With respect to the
prosecution of the work, special reference is made to
Subsection 6-2, "Prosecution of Work" .
601-5 Secure Work Areas
It is the responsibility of the contractor to maintain safe
and secure work areas at all times . Safe work areas will
include the use of barricades, guards, lights, signs and any
other devices necessary to protect the public.
601-6 Removal of Materials
Materials which are to be disposed of shall not be stored at
the site but shall be removed immediately. No overnight
storage of materials or debris will be allowed in the street
areas or surrounding areas .
601-7 Water for Construction
Water for construction purposes may be obtained from Ventura
County Water Works District No. 1 . The water agency will
supply a water meter or meters . The Contractor shall make
all arrangements to transport the water, and shall, at his
own expense, furnish and install all necessary piping and
fittings . All such water used for the proposed construction
shall be metered, and the Contractor will be charged for such
water used at the prevailing rates .
601-8 Equipment and Materials Storage
The Contractor shall arrange and maintain a secure storage
site for all equipment and materials . All equipment and
unused materials shall be returned to this site at the end of
each work day . The Contractor shall submit a route plan to
the Director or the Director ' s designee for the delivery of
materials to both the job and storage sites at least seven
days before commencing work.
601-9 Dust and Noise Control
The Contractor shall provide means to prevent dust, grit,
excessive noise, and other waste products from becoming a
nuisance in and around the working areas . The Contractor

shall take such steps, with the approval of the Director, to
reduce or eliminate such nuisance . The Contractor is
• required to control dust during the entire contract period,
including holidays and weekends .
If the Contractor fails to control dust in accordance with
these contract specifications, the City reserves the right to
hire another contractor or agency to perform this work on a
"force account" basis . The total cost for performing this
work will be deducted from the total contract price at final
payment .
601-10 Payment
No separate payment will be made for work or other features
as required and outlined in this section. Full compensation
for such work and features shall be considered included in
the price bid for other applicable items of work, and no
additional compensation will be allowed therefor.

SECTION 602 MISCELLANEOUS WORK
602-1 General
Work under this section shall consist of any and all work not
covered by other sections . All work shall conform to the
applicable provisions of the plans and the Standard
Specifications except as expanded or modified herein.
602-3 Electrical Services
The Contractor shall obtain all permits, meters, cabinets,
etc . to construct the electrical services required by the
plans .
602-4 Water Services
The Contractor shall obtain all permits, meters, vaults, etc.
to construct the water services required by the plans .
THE CITY SHALL REIMBURSE THE CONTRACTOR FOR THE ACTUAL COST
OF CERTAIN WATER CONNECTION FEES REQUIRED TO CONSTRUCT THE
WATER SERVICES CALLED FOR ON THE PLANS . SAID REIMBURSABLE
COSTS SHALL NOT INCLUDE THE CONTRACTORS TIME TO PAY SUCH
FEES, OBTAIN THE REQUIRED PERMITS AND OBTAIN ALL REQUIRED
INSPECTIONS AND APPROVALS. SAID REIMBURSABLE COSTS SHALL BE
LIMITED TO THE FOLLOWING:
1 . ALL WATER METER CONNECTION FEES CHARGED BY VENTURA
COUNTY WATERWORKS DISTRICT #1;
2 . ALL CAPITAL IMPROVEMENT CONNECTION FEES CHARGED BY
VENTURA COUNTY WATERWORKS DISTRICT #1; AND,
3 . ALL CAPITAL IMPROVEMENT CONNECTION FEES CHARGED BY
CALLEGUAS MUNICIPAL WATER DISTRICT.
602-6 Measurement and Payment
Payment for all Miscellaneous Work shall be made at the
contract price bid. Such payment shall be considered full
compensation for furnishing all labor, materials, equipment,
tools and incidentals necessary to perform all Miscellaneous
Work as specified in these Special Provisions .

SECTION 603 IRRIGATION
• The requirements of the General Conditions, Supplementary
General Conditions, and Division 1 apply to this section.
Part I GENERAL
603-1 REQUIREMENTS
A. Work included in this section: Trenching,
laying of pipes and control wires, installation
of valves , sprinkler heads, etc . , backfill,
testing, adjustments, record drawings and be
complete, ready for operation.
B. Related work not included in this section:
Landscaping
Electrical (120 volts only)
603 .2 INTENT OF SPECIFICATIONS
A. It is the intention of these specifications to
install a sprinkler system free from defects in
materials and workmanship.
B. In the event of any discrepancies between the
plans and the specifications , the final
decision to be followed shall be made by the
Landscape Architect .
603 .3 SCOPE OF WORK
A. The work included in these specifications shall
consist of furnishing all labor, tools ,
materials, appliances, tests , permits, taxes,
etc . , necessary for the installation of a
landscape sprinkler system, and the removal of
all debris legally from the site.
B. The system shall irrigate all areas and shall
be left ready for operation to the satisfaction
of the Landscape Architect .
C . Workmanship shall be first class, competent and
to the satisfaction of the Landscape Architect .
603 .4 GENERAL REQUIREMENTS
A. All local, municipal and state laws, rules and
regulations governing any portion of this work
shall be made a part of these specifications

and their provisions carried out . However,
when specifications or drawings describe
materials , workmanship or construction of
better quality or larger size it shall take
precedence over the rules and regulations.
B. Before submitting a bid, each bidder shall
carefully examine the sprinkler drawings and
specifications . He shall visit the site and
note all existing conditions and limitations
applying to the work and include in his bid a
sum sufficient to cover the cost of all items.
C. If the Irrigation Contractor wishes to
substitute a product that he believes to be
equal and meets all the mechanical, material,
and operational requirements of the products as
specified, he shall submit a letter stating, 1)
the qualifications of the substituted products,
2 ) reasons for requesting the substitution, 3 )
the credit the Irrigation ' s Contractor will
offer to the Agency if such substitution be
formally accepted as an equal .
D. The Irrigation Contractor shall be responsible
to cover all pipe openings , valves , etc . ,
before and after being set in place to prevent
obstructions in the pipe and valves .
E. The Contractor shall provide all temporary
storerooms and shops at the site for safe and
proper storage of his materials, tools, etc .
These rooms shall be constructed only in
locations approved by the owner and shall in no
way interfere with the work of any other
contractor . When these rooms interfere with
any installation, it shall be removed and/or
relocated by the Irrigation Contractor at his
expense after having been notified by the owner
that such removal is necessary.
F. Any existing buildings, equipment, piping, oil
lines , pipe coverings , sewers , sidewalks ,
landscaping, etc. , damaged during the course of
his work shall be replaced or repaired in a
manner satisfactory to the Landscape Architect
and at the Irrigation Contractor' s own expense,
and before final payment will be made.
G. The Irrigation Contractor shall be responsible
for damages to the grounds , walks, roads,
building, piping systems, electrical systems
and their equipment and contents caused by

leaks being installed or having been installed.
He shall repair, at his expense, all damage so
caused. All repair work shall be done in a
manner satisfactory to the Owner.
` 603 .5 GUARANTEE
A. The entire sprinkler system, done under this
Contract , shall be guaranteed against all
defects and faults or material and workmanship,
and sustain in working order for one (1) year
from date of completion without expense to the
Owner.
B. Materials used shall carry a minimum one (1)
year manufacturer ' s guarantee over and above
Irrigation Contractor ' s guarantee.
C. If , during period, settlement occurs and
adjustments in pipes , valves and sprinkler
heads, planting areas or paving are necessary
to bring the system to the proper level of the
permanent grades, the Irrigation Contractor
shall make all adjustments without extra cost
to the Owner.
D. After the system has been completed, the
Irrigation Contractor shall instruct the Owner
in the operation and maintenance of the system.
E. In the event the Contractor does not respond to
the Owner ' s request for repair work under this
guarantee within a period of 48 hours, the
Owner may make such repairs as he may deem
necessary at the full expense of the
Contractor.
PART II MATERIALS
All materials shall be new and of size and type as called out
on the drawings . All materials of like-kind shall be of one
manufacturer.
603 . 6 LIST OF MATERIALS FOR APPROVAL
Within 20 days after award of contract , the
Irrigation Contractor shall submit to the Landscape
Architect for approval, five ( 5 ) copies of a
complete materials list , together with
manufacturer ' s name and numbers covering all
material to be furnished under this contract .
Irrigation Contractor shall also furnish 5 copies
of descriptive literature with catalog cuts marked
with highlighter pen on all items to be used on
this project .

1 , 4 inch minimum length, except where detailed
otherwise on drawings .
603 . 15 PVC LATERALS (NON-PRESSURE PIPING)
Laterals shall be 1120/1220 normal impact, schedule
40, solvent weld type PVC pipe.
603 . 16 FITTINGS - PVC
For make-up shall be on same chemical compound as
pipe on which it is installed. Use Schedule 40
medium-wall fittings for any " all socket "
connections . Use Schedule 40 heavy-wall fittings
for all fittings with one or more threaded outlets .
603 . 17 PIPE COMPOUND FOR PVC
Threaded connections, including PVC to steel make-
up, shall be best grade teflon tape.
603 .18 PRIMER
Primer for PVC solvent weld connections shall be as
recommended by the manufacturer of the PVC pipe, to
be chemically compatible with the pipe, fittings and
solvent .
603 .19 SOLVENT
Solvent for PVC solvent weld connections shall be as
recommended by the manufacturer of the PVC pipe, to
be chemically compatible with the pipe, fittings and
primer.
603 .20 REMOTE CONTROL VALVES
Remote control valves are to be diaphragm type, slow
closing, 150 lb. , electrically operated, 24 volt,
epoxy encapsulated waterproof solenoid to be an

Connectors shall be 600 volt, 60 degrees centigrade,
AWG-UF type, waterproof, epoxy or PVC compound

Quick coupler valves shall be 150 lb. two piece cast
bronze body, self-closing metal cover with yellow
vinyl protective caps, locking type. Single track

Couplers shall be same manufacturer as quick
coupling valve, cast bronze, machined shank,
stainless steel or bronze lugs, coupler to include
operating handle. Top of coupler equipped with 3/41,
bent nose type bronze hose Bibb with renewable disc

603 .28 GENERAL

irrigation work may properly commence.
D. Provide at least one qualified person who shall
be present at all times during execution of the
work. He shall be familiar with the type of
materials being installed and the material
manufacturers ' recommended methods of
installation and direct all work performed
under this section.
603 .29 CONNECTION TO WATER SUPPLY (POC)
Connect to water source at approximate locations
shown on the drawings . Minor changes caused by
actual conditions shall be made without additional
cost .
603 .30 VERIFICATION OF DIMENSIONS
A. Verify all horizontal and vertical site
dimensions prior to staking of heads .
B. In the event of discrepancies , immediately
notify the Landscape Architect . Do not proceed
with installation in these areas until the
discrepancies have been fully resolved.
603 .31 LAYOUT OF HEADS AND STAKING
Sprinkler heads shall be staked and installed in the
locations shown on the drawings . Discrepancies
between drawings and site shall be brought to the
attention of the Landscape Architect prior to
trenching . Do not exceed maximum spacings shown on
drawings, or exceed the GPM on the pipe sizes shown.

If spacings demand additional or less materials,
notify Landscape Architect before commencing work.
603 .32 TRENCHING
A. Check all grades so that work may proceed
keeping materials at specified depth.
B. Do all excavation for installation of work
included in contract . Mechanical trenching
machines shall be of approved type to cut
trenches with straight sides . Trenches shall be
only wide enough to lay the pipe and control
wires . Perform minor adjustments to avoid
existing utilities as directed without
additional cost . " Pulling" of pipe and/or
control wires will not be permitted.
C . Use all possible care to protect existing trees
and plants , during trenching . Roots 2 " or
larger in diameter shall be tunneled under and
wrapped with wet burlap to prevent scarring or
drying. When roots one inch and larger are cut,
they shall be painted with two coats of approved
sealer manufactured for this purpose. Cover all
trenches in root areas (only while open) with
wet burlap and backfill within 24 hours after
opening the trench . Obtain Landscape
Architect ' s approval before cutting any root
over one inch in diameter. All trenching in
such areas shall be done by hand.
D. If pipe must be laid after paving is in place,
it shall be done by jacking, boring, or
hydraulic driving . If cutting or breaking of
any paving is necessary, it shall be done and
replaced with like material at the expense of
the Irrigation Contractor after obtaining
approval of the Landscape Architect . Hydraulic
driving will not be permitted under asphalt
paving.
603 .33 ASSEMBLY OF PIPES
A. Metal Pipe -
Do not bend or spring pipe, make all offsets or
changes in direction with fittings . Cut
threads with sharp, clean dies to conform to
ASA Specification B2 . Assemble pipes free from
dirt and scale, ream and deburr . Make up
joints by applying oil base compound to male
threads only. Remove excessive compound after
make-up.

B. PVC Plastic Pipe
1 . Handle with care when loading, unloading,
transporting and storing material to avoid
damage . Store pipe and fittings under cover
before using. Transport in vehicle with bed of
sufficient length to carry pipe flat and fully
supported. Tore pipe in same manner . Notify
Landscape Architect when each pipe and fittings
shipment reaches the site for his observation.
Rejected materials shall be immediately removed
from the site and replace with new shipment of
different batch number.
2 . Solvent welding - use non-synthetic brush
to spread primer and solvent using no larger
than pint-sized cans . Clean and refill cans
each day. Cut pipe square, ream, chamfer
outside end at 10 degrees . Clean and dry pipe
and fitting socket . Scrub full length of
inside socket and pipe end with primer, prime
inside socket again. Immediately apply solvent
to pipe end and to socket, then again to pipe
end. Bottom the pipe in socket and turn 90
degrees . Hold joint together 30 seconds . wipe
off excess solvent . Allow to set 30 minutes
before moving. Centerload pipe with small
amount of backfill to prevent arching whipping
under pressure, leaving joints exposed.
3 . Threaded connections - Use teflon tape on
plastic threaded joints . Screw hand tight and
another half turn by wrench. On PVC to metal
pipe, work the metal connection first .
603 .34 LAYING OF LINES
A. All lines set in place under paving shall extend
181, minimum beyond such paving and be capped
hand tight . No fittings, including couplings
will be permitted under surfaces to be paved
except where the length of the line under the
paving exceeds 20 feet or where shown on the
drawings, i .e. parking lots, etc.
B. Snake PVC plastic pipes side to side in trench
bottom keeping 41, horizontal clearance between
two pipes in same trench. Do not lay pipe in
trench containing water or at less than 32
degrees F. Centerload immediately, leaving
joints exposed.

603 .35 LAYING OF CONTROL WIRES (24 VOLT)
Lay wires in common trench with main lines wherever
possible. Splicing is allowed with 24 " expansion
loop only in electrical junction box with box down
lid. Common wire and pilot wires are to be tagged
with 1/4 " wide embossed plastic labeling tape,
showing controller and station number designation.
Use plastic electrical tape and bind all control
wires in bundles at 10 feet intervals . All splices
shall be waterproof.
603 .36 FLUSHING OF LINES
A. Main lines shall be flushed before attaching
remote control valves or quick coupler valves
and with pipe centerloaded. All water being
discharged shall be temporarily piped up and
out of the trenches . Trenches are to be kept
dry for pressure tests to follow. Install all
valves after approval of flushing procedure by
the Landscape Architect .
B. Laterals shall be flushed before sprinkler
heads are installed. Cap all risers, apply
pressure, remove caps in sequence starting at
cap nearest the control valve. Replace caps
before removing caps to follow. Continue to
end of each lateral . Flush until all foreign
matter and mud is cleared of the system.
Contractor to provide all materials needed for
flushing operations .
603 .37 PRESSURE TESTS
Perform all hydrostatic tests in presence of the
Landscape Architect after flushing lines . Maintain
125 PSI without any pressure drop on main lines for
2 hours with all air expelled from line and with
all valves in place. All leaks shall be corrected
in mechanical manner without use of epoxy fillers
or other filler compounds . Contractor shall
provide all equipment for tests including force
pump and pressure gauges .
603 .38 BACKFILL
After the work has been installed, flushed, tested,
and proven tight in the presence of the Landscape
Architect, backfill with fine materials . Allow no
rocks or other objects larger than one inch
diameter to fall in the first 6 " of cover .
Backfill in 4 " layers and tamp properly to avoid
any voids . Flooding of trenches shall be done only

with the approval of the Landscape Architect .
However, all sandy soils, as determined by the
Landscape Architect, shall be flooded during the
backfill-compaction operation. Compact backfill
over lateral lines to equal density of adjoining
• undisturbed soils, and compact to 90 percent over
main lines . All trenches shall be left flush to
the adjoining undisturbed grades . All backfill
under surfaces to be paved for vehicular use shall
be compacted 95% . Any work covered prior to
observations by the Landscape Architect shall be
uncovered at the expense of the Contractor to allow
for such observations if demanded by the Landscape
Architect . Any surplus soil shall be distributed
on site as directed by the Landscape Architect .
603 .39 DRAWINGS OF RECORD
As part of contract, Contractor shall obtain blue
line ozalid prints from the Landscape Architect, at
cost , and maintain daily records showing all
locations of main lines, buried valves, conductor,
quick coupler valves and plugged or capped outlets .
Locate each item from two points of architectural
permanence i .e . , curbs, wall, light standards, etc.
prior to backfill . Do not dimension for sprinkler
heads or other parts of the irrigation system.
Keep record drawings on site for daily observation
by the Landscape Architect and on date of final
observation, deliver corrected drawings to the
Landscape Architect . Final drawings shall be
prepared, by the Irrigation Contractor, on mylar
prints obtained from the Landscape Architect, at
cost , showing all field notes in india ink by a
competent draftsman. Delivery of "As Built" prints
to Owner does not relieve the Irrigation Contractor
of responsibility of providing any further
information that may be omitted from the prints .
603 .40 CONTROLLER MAINTENANCE CHARTS
Provide hermetically sealed plastic covered charts
in each automatic controller, showing only the
systems operated by that controller. Charts to be
as large as possible to fit door and meet approval
of the Landscape Architect before being acceptable
for insertion in plastic . Charts to be in
controllers for the final observation by the
Landscape Architect . Two duplicate charts shall be
provided to Owner.

603 .41 LOWERING OF HEADS, VALVE BOXES, QUICK COUPLER
VALVES, ETC .
All of the above and any other equipment that may
be damaged by mowing shall be set flush to finished
grade, or as called out on the drawings, prior to
final acceptance. Replace any equipment damaged by
final acceptance. Replace any equipment damaged by
mowing during the Owner ' s first 90 days of
maintenance after the conclusion of the Irrigation
Contractor ' s maintenance period at no cost .
603 .42 ADJUSTING SYSTEM
Adjust entire system prior to coverage test , and
again at conclusion of maintenance period.
A. Set all shut-off valves in the system to full
open position.
B. Adjust all stationary heads to uniform coverage
on each system using adjusting screws in each
sprinkler head and by control of the throttle
device on each remote control valve.
C. Adjust arcs of all heads to prevent overspray
on areas to be kept dry. Replace nozzles in
heads to different arcs, i . e . , 180 degrees
nozzle to 120 degree nozzle, etc . to provide
proper and more adequate coverage . These
changes or adjustments shall be made without
additional cost .
D. Install check valves to prevent drainage from
any sprinkler head.
603 .43 COVERAGE TEST
When installation of the sprinkler system is
completed, perform a coverage test in the presence
of the Landscape Architect to determine that
coverage for planting and turf areas is complete
and adequate. Where inadequate coverage occurs due
to deviations from plans, or where site condition
differs and the system has been installed without
notifying the Landscape Architect, the Irrigation
Contractor shall provide necessary material and
perform work to correct all inadequacies without
additional cost . These tests and corrections shall
be accomplished before any ground cover or turf is
planted.

603 .44 SITE CLEANING
Clean and dispose, legally, all debris from site .
Remove all storage rooms and all other contructions
and make site ready for planting work to follow.
Debris not cleared for landscape work may be back
charged.
603 .45 OBSERVATIONS
Observations will be performed by representatives
of the Landscape Architect or Owner at the
following times and at random visits when the
observer may be on the site . When observations
have been conducted, show evidence of when and by
whom these observations were made.
A. Prework conference. To be conducted prior to
any irrigation work under this contract .
B. Observation of flushing.
C. Observation of pressure tests .
D. Observation of coverage performance.
E. Final observations of the completed
installation.
F. Irrigation Contractor shall not cover any work
prior to observation by the Landscape
Architect .
G. All observances shall be requested at least 48
hours in advance . All work shall meet the
Landscape Architect ' s approval, or be rectified
at no additional cost to the Owner. Irrigation
Contractor shall be financially responsible for
all members of the team of observers for
unprepared observation appointments .
603 .46 ITEMS FURNISHED
At time of final acceptance, Irrigation Contractor
shall deliver to the Owner:
A. One control valve key, 30" long, for every six
remote control valves installed.
B. One coupler key with hose bibb attached for
every six quick coupler valves installed.
C. One loose key for every six quick coupler
valves installed.

D. Two special wrenches suitable for operating
each type of shut-off valve installed.
E. Two tools for disassembly and assembly, or
adjustment, of each type equipment used in this
installation requiring such special tools .
F. Two valve box keys for every 12 lock lid valve
boxes used in this installation.

printed by each manufacturer of each type
equipment installed. Refer to "Materials "
section of the specifications and legend on
drawings .

603 .47 FINAL ACCEPTANCE
All equipment shall be checked and adjusted in
height, location, performance and appearance at time
of final acceptance. All damaged portions shall be
replaced with new materials of like-kind.

604 . 1 SCOPE

604 .2 VERIFICATION OF DIMENSIONS AND QUANTITIES
A. All scaled dimensions are approximate. Before
proceeding with any work, the contractor shall
carefully check and verify all dimensions and
quantities and shall immediately inform the
Landscape Architect of any discrepancies
between the drawings and/or the specifications
and the actual conditions . No work shall be
done in any area where there is such
discrepancy until approval for same has been
given by the Landscape Architect .
B. Contractor to provide hydroseeded turf on all
existing turf areas damaged by construction
operations .
604 .3 OBSERVATION
A. All observation herein specified shall be made
by the Landscape Architect. The contractor
shall request observation at least 48 hours in
advance of the time observation is required.
Observation will be required on the following
parts of the work:

1 . During preliminary grading , soil
preparation, and initial weeding.
2 . When shrubs and trees are spotted for
planting, before planting holes are
excavated.
• 3 . When finish grading has been completed,
and prior to hydroseeding.
4 . When planting and all other indicated or
specified work has been completed.
5 . Final observation at completion of
maintenance period.
B. The contractor shall be on the project site at
the time of each observation.
604 .4 MAINTENANCE
A. Contractor shall continuously maintain all
areas included in the Contract during progress
of the work, the maintenance period, and until
final acceptance of the work.
B. If plantings are not acceptable at the end of
the maintenance period for the entire work, due
to defective maintenance, the maintenance shall
be continued by the Contractor until all work
meets the Specifications and can be approved.
C. Maintenance shall include continuous operations
of watering, weeding, mowing, rolling,
trimming, edging, cultivating, fertilizing,
spraying insect and pest control , seeding,
and/or other operations necessary to assure
good normal growth.
D. All planted areas shall be kept free of debris
and shall be weeded at not more than 10-day
intervals . Grass, when 2-1/2 " high shall be
mowed and mowing shall be repeated whenever the
grass grows to 2-1/2 " high.
E. During the installation period and maintenance,
the Contractor shall be responsible for
maintaining adequate protection for all areas .
Any damaged planting shall be repaired at the
Contractor ' s expense.
F. At the termination of the maintenance period,
all plant material shall be live, healthy,
undamaged, and free of infestations . All lawn
areas shall be completely covered at the time
of final acceptance. Inferior plantings shall

be replaced and brought to a satisfactory
condition before final acceptance of the work
will be made. All ground cover and shrub areas
shall be neatly raked and free of weeds .
604 .5 GUARANTEE
A. All trees, shrubs, and hydroseeded areas shall
be guaranteed to take root and grow within 60
days after final acceptance of plantings, when
such plants have received normal care and
maintenance.
B. Any trees or other plant materials that die
back and lose the format and size as originally
specified shall be replaced even though they
may have taken root and are growing after the
die-back.
C. The Contractor, within 15 days of written
notification by the Owner, shall remove and
replace all guaranteed plant material which for
any reason fail to meet the requirements of the
guarantee. Replacement material and plantings
shall be to the same specifications as required
for the original planting and all replacements
shall be guaranteed as specified for the
original guaranteed materials .
PART II PRODUCTS
604 . 6 MATERIALS
A. Soils : verify amounts of soil required by plan
review and site observation. Provide adequate
amounts of specified soils to attain grades,
after compaction, as shown on drawings .
1 . Import topsoil . Soil for finish grading
and earthen berms : Soil to be fertile,
friable top loam having normal amount of
natural humus . Soil to be reasonably
free from sub-soil, rocks, refuse, roots,
weeds, noxious seeds, brush, nematodes,
ingredients or objects that are
detrimental to healthy plant growth (pH
between 6 . 0 and 8 . 0 ) . Provide a soil
fertility analysis of all import soil
with amendment recommendations .
B. Fertilizers and soil conditioners : all
material shall be first grade analysis ,
quantity or weight, attached to each sack or
container. Delivery certificates shall be

given to the inspector as each material is
delivered. A list of materials used, together
with typical certificates of each material,
shall be submitted to the Landscape Architect
prior to the final acceptance of the job.
•
C. Bulk humus and mulch shall be nitrogen
stabilized ground fir or pine bark containing
1% nitrogen on a dry weight basis as
manufactured by Sequoia Humus Products, Vita
Bark, or equal .
D. Fertilizer/Soil Conditioner: commercial type.
E. The fertilizer/soil conditioner shall be
derived from organic materials such as
decomposed animal , vegetable and mineral
matter, or chemically manufactured by an
approved fertilizer manufacturer. material
shall be relatively dry, friable, and pass a
one inch sieve; shall not contain poultry,
animal or human waste, pathogenic viruses, fly
larvae, insecticides, herbicides, fungicides,
or poisonous chemicals that would inhibit plant
growth; and shall have the guaranteed chemical
analysis as recommended by an approved soil
testing laboratory.
F. Contractor shall, at his own expense, submit at
least four samples of site soil for
agricultural suitability and fertility analysis
and amendment recommendation: Soil and Plant
Laboratory, Inc . , 1594 N. Main Street, Orange,
CA 92613 (714-282-8777 ) or other testing
laboratory approved by the Owner. All samples
to be taken from the top 61' of site soil after
completion of the demolition and rough grading.
G. Plant Materials :
1 . Plant materials indicated shall be
furnished to size, quantities, and
spacing as indicated or noted for each
location and shall be of the species,
kind, size, etc. , as shown and described
on the drawings :
2 . Quality:
a) Healthy, shapely, well-rooted,
disease and insect free, not
deformed or root bound.
b) Grown in nurseries inspected by the
State Department of Agriculture.

c) Free of abrasions, knots, injuries,
or disfigurements.
d) Plants not approved to be removed
from site immediately and replaced
with suitable plants .
3 . Grass seed: as specified on drawings .
H. Miscellaneous Materials :
1 . Stakes shall be treated lodgepole pine
not less than 101, in height for 15 gallon
and 24" box trees . Utilize two stakes
per tree.
2 . Tree supports : As noted on drawings .
3 . Contract herbicide : for treatment to
kill weeds and lawn both annual and
perennial , approved by the Landscape
Architect . Weed killer shall not leave
stain or residue.
4 . Pre-emergence herbicide to be broad
spectrum approved by the owner.
5 . Planting tablets : Agriform 21 gram or
approved equal .
I. "Grassroad Pavers" : Shall be as noted and
installed per detail on drawings .
PART III EXECUTION
604 .7 GRADING
A. Moisture content : The soil shall not be
worked when moisture content is so great that
excess compaction will occur nor when it is so
dry that dust will form in the air or that
clods will not break readily. Water shall be
applied if necessary to provide ideal moisture
content for filling and for planting as herein
specified.
B. Preliminary grading: Shall be done in such a
manner as to anticipate the finish grading.
Excess soil shall be removed or distributed
before the application of fertilizer and
mulch. Where soil is to be replaced by plants
and mulch, allowance shall be made so that
when finish grading has begun, there shall be
no deficiency in the specified depth of
mulched planted beds .

C. The contractor shall check the site for weed
growth prior to grading or disturbance of the
soil in planting areas . These areas shall
receive an application of contact herbicide
per manufacturer ' s recommendations .
D. Finish grading: Shall consist of bringing all
ground areas to uniform slopes, meeting grades
of installed curbs, paving, etc. , and drainage
at a 2% slope unless otherwise indicated on
the drawings . The finish grade is the ground
surface grade after all loosening, soil
conditioning, fertilizing, and planting has
been completed. Ground shall be 2 " below
walks, curbs, and headers in ground cover and
shrub areas and 1" below same in lawn areas .
Accurate flow lines shall be set by instrument
to catch basins or other points of drainage
flow. Modeling of finish grade shall be done
as directed by the Landscape Architect .
604 .8 SOIL CONDITIONING
A. All planting areas shall be loosened to a
depth of 8 " . Apply 4 c .y . of organic
amendment and 15 lbs . of fertilizer per 1, 000
s . f . and blend with the top 6" of soil . This
amendment is for bidding purposes , and shall
be superseded by recommendations of soil
analysis report .
B. For all trees and shrub planting, the
following prepared soil mix shall be used for
backfill in tree and shrub pits : Site Soil -
2/3 by volume, Organic Amendment - 1/3 by
volume, Soil conditioner/Fertilizer - 1 lb.
per c .y. of mix, Iron Sulfate - 2 lbs . per
C .Y . of mix. thoroughly blend and mix prior
to placement . Do not mix in plant pit . This
mix is for bidding purposes, and shall be
superseded by recommendations of soil analysis
report .
C. Trees and shrubs to be planted before
hydroseeding . After all trees have been
planted, build good sized basins around each
and install a mulch of redwood shavings .
Basins in lawn areas shall be removed prior to
hydroseeding of lawn.
D. During the maintenance period, the contractor
shall apply commercial fertilizer/ soil
conditioner at the rate of 6 lb. . per 1, 000
s . f . at the 60th day of maintenance period,

minimum 16-6-8 fertilizer. One application
required.
604 . 9 PLANTING OF SHRUBS AND TREES
A. All materials to be set so that when settled
they shall bear the same relation to the
finish grades as they bore to the container
grade before being transplanted. The
Landscape Architect shall approve all
materials as to quality and placement before
the holes are dug. Dig pits a minimum of 2-
1/2 times the size of the plant container and
backfill with prepared soil specified in this
section.
B. Planting Tablets shall be placed 6 "-8" deep at
the side of root ball at the following rates :
1 gal . plants : 3 tablets; 5 gal . plants : 9
tablets ; 15 gal . plants : 15 tablets, 24" box
trees : 25 tablets .
C. If soil settles away from the ball of earth
around the plant after planting, fill topsoil
around same to bring to proper level with
finish grades .
D. Upon completion of all planting operations all
soil between plants shall be lightly
cultivated and neatly raked.
604 . 10 PLANTING OF NEW TURF AREAS
A. Remove existing turf and weeds by hand or
machine or by applying an approved contact
herbicide per manufacturer' s instructions .
B. After areas have been graded, and soil
amendments added as specified, the areas shall
be dragged and raked to remove all rocks
larger than 1 " in diameter, lumps , weeds ,
roots and debris . This material shall be
removed from the site.
C. Spray any weeds with a contact weed killer.
After weeds are dead, remove all dead weeds
and grasses and sufficiently moisten ground to
dissipate any remaining weed killer.
D. Hydroseeding: Stabilizing emulsion shall be
miscible with all available water at the time
of mixing and application . Stabilizing
emulsion shall not be applied during rainy

weather or when soil temperatures are below 40
degrees F. Pedestrians or equipment shall not
enter hydroseeded areas, after the materials
have been applied, until time for first
mowing . The materials shall be mixed and
applied in approximately the following
proportions : Material Per Acre :
Stabilizing emulsion 100 lbs .
Fiber 2, 000 lbs .
16-6-8/fertilizer 150 lbs .
Seed 500 lbs min.
E. Seed bed shall be finally prepared by floating
areas smooth to a neat uniform appearance free
from humps and depressions . Contractor shall
request inspection prior to seeding .
Quantities of material added to each tank lead
shall be verified by the Owner to insure
compliance with the above proportions . Mixing
shall be performed in a tank with a built-in
continuous agitation and recirculation system
of sufficient operating capacity of 1 , 000
gallons . A dispersing agent may be added
provided that the Contractor furnishes
evidence that the additive is not harmful to
the mixture . Any material considered to be
harmful , as determined shall not be used.
Materials shall not be applied more than four
hours after mixing . If material in place
begins to dry, the Owner may require spray
application of water to said material . The
nozzles used for watering shall produce a
spray that does not concentrate or wash the
material . Areas that do not properly
germinate shall be reseeded at ten day
intervals until an acceptable stand of grass
is obtained.
F. Protect turf areas against damage, including
erosion and trespass and provide proper
safeguards as may be needed. Replant damaged
areas promptly . Special care shall be taken
to prevent erosion from surface drainage from
other areas . Any damages from same shall be
the Contractor' s responsibility.
604 . 11 WATERING
A. Apply water to all planted areas and plants
during operations and thereafter until
acceptance of work.

B. Plants which cannot be watered efficiently
with the existing irrigation system shall be
watered by means of a hose, until problem is
corrected.
C. Immediately after planting, apply water to
each tree, shrub and vine by means of a hose.
Apply water in a moderate stream in the
planting hole until the material about the
roots is completely saturated from the bottom
of the hole to the top of the ground.
D. Apply water in sufficient quantities, and as
often as seasonal conditions require to keep
the ground, grass and planting moist . Protect
the turf areas against damage, including
erosion and trespass and provide proper
safeguards as may be needed. Replant damaged
areas promptly . Special care shall be taken
to prevent erosion from surface drainage from
other areas . Any damages from same shall be
the Contractor ' s responsibility.
E. Provide irrigation to all existing turf and
planting areas throughout the entire contract
period.
604 . 12 PRE-EMERGENT WEED CONTROL APPLICATION
A. Upon completion of all planting operations ,
apply pre-emergent weed control over all
ground cover and shrub areas . Prior to the
completion of the 60 day maintenance period,
cultivate all shrub and ground cover areas and
provide an additional application of pre-
emergent weed control as per manufacturer ' s
instructions .
604 .13 CLEAN-UP
A. Upon completion of all planting operations ,
the project site shall be cleaned of all
debris, superfluous materials and equipment .
All such materials and equipment shall be
entirely removed from the project site.
B. Walks or pavement shall be swept or washed
clean upon completion of the work of this
section.
C. During the entire contract period, plant
containers that have been cut or removed from
plant materials shall be removed from the
project site.

PART 1 GENERAL
605 .1 SCOPE
A. Furnish and install all site elements as shown
on the drawings and as specified herein

605 .2 GENERAL REQUIREMENTS
A. This work shall be coordinated with all
associated work in a manner that will insure
that all items are located properly per
drawings, complete in the proper sequence, and
accomplished as rapidly as the progress of the
project will allow so that no work will be
delayed for want of associated items or parts
of items .
B. If more than one subcontractor is to perform
various items or parts of items detailed by
this section, specific responsibility shall be
defined by the General Contractor.
605 .3 SHOP DRAWINGS SUBMITTALS

605 .8 GENERAL
A. Assembly, construction, and installation of
all items shall be of the highest
craftsmanship and in accordance with
manufacturer ' s recommendations and details on
the drawings . All construction shall be
accurately fitted, set plumb and level, free
from surface blemishes .
605 . 9 BENCHES
A. Benches shall be installed as shown on detail .
Embed steel posts into concrete footing .
Coordinate the installation of steel posts
with the concrete Subcontractor.
B. Protect steel supports and wood bench from
discoloration and damage during the
construction period until approved and
accepted. Any damage occurring shall be the
contractor ' s responsibility and shall be
repaired or replaced as directed by the
Landscape Architect .
605 . 10 FENCING
A. Install as specified in the drawings and by
manufacturer. Coordinate the installation of
anchor bolts and fence posts with concrete
block subcontractor as necessary.

SECTION 606 PLANTING AND IRRIGATION MAINTENANCE
* 606-1 General

Work to be performed under this section covers all labor,
materials, tools, equipment, transportation, and incidentals
necessary to provide landscaping and irrigation system
maintenance in accordance with the requirements set forth on
the plans .
606-2 Maintenance Period
The sixty ( 60 ) day maintenance period required by this
document shall not commence until the City issues a written
Notice of Acceptance of the work.
The Contractor shall pay for all water costs during the
maintenance period.
606-3 Measurement and Payment
Payment for providing the required landscaping and irrigation
system maintenance shall be made at the contract unit price
bid and shall include full compensation for furnishing all
labor, tools, materials, equipment, and incidentals necessary
to comply with the requirements of this Section.
