HomeMy WebLinkAboutMIN 2018 0221 CC SPC MINUTES OF THE CITY COUNCIL Moorpark, California February 21, 2018 A Special Meeting of the City Council of the City of Moorpark was held on February 21, 2018, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 5:31 p.m. 2. ROLL CALL: Present: Councilmembers Mikos, Pollock, Simons, Van Dam, and Mayor Parvin. Staff Present: Steven Kueny, City Manager; Kevin Ennis, City Attorney; Deborah Traffenstedt, Assistant City Manager; and David Bobardt, Community Development Director. 3. PUBLIC COMMENT: None. 4. REORDERING OF, AND ADDITIONS TO, THE AGENDA: None. 5. PRESENTATION/ACTION/DISCUSSION OR CONSENT CALENDAR: A. Consider Mutual Release and Pre-Litigation Settlement Agreement between The Bennett Partnership and the City of Moorpark. Staff Recommendation: Authorize the City Manager to sign Mutual Release and Pre-Litigation Settlement Agreement, subject to final language approval by the City Manager and City Attorney. Mr. Bobardt gave the staff report. . Leslie and Michael Bennett and Ralph Silva, representing the Bennett Partnership, discussed their concerns with the compliance time period for the Settlement Agreement. A discussion among the City Council and staff focused on the compliance time period, including for No. 7 on Exhibit A of the proposed Settlement Agreement. Minutes of the City Council Moorpark, California Page 2 February 21, 2018 MOTION: Mayor Parvin moved and Councilmember Van Dam seconded a motion to authorize the City Manager to sign the Mutual Release and Pre- Litigation Settlement Agreement between The Bennett Partnership and the City of Moorpark, subject to final language approval by the City Manager and City Attorney. The motion carried by unanimous voice vote. 6. CLOSED SESSION: Mr. Kueny requested the Council go into closed session for discussion of one case under Item 6.A and Items 6.E and 6.F on the agenda. Mr. Ennis announced the facts and circumstances for going into closed session for the one case under Item 6.A are covered under Paragraph (2) of Subdivision (d) of Government Code Section 54956.9 with no further announcement at this time. MOTION: Councilmember Pollock moved and Councilmember Mikos seconded a motion to adjourn to closed session for discussion of one case under Item 6.A and Items 6.E and 6.F on the agenda. The motion carried by unanimous voice vote. The time was 5:50 p.m. A. CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Pursuant to Government Code Section 54956.8) Property: 139 High Street (APN 512-0-092-160) City Negotiator: Steven Kueny, City Manager Negotiating Parties: The City of Moorpark and Family Realty Trust Under Negotiation: Price and terms of payment F. CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Pursuant to Government Code Section 54956.8) Property: 488 McFadden Avenue (APN 511-0-101-290) City Negotiator: Steven Kueny, City Manager Negotiating Parties: The City of Moorpark and Kathy Houlehan) Under Negotiation: Price and terms of payment for the rental of property Present in closed session at 5:50 p.m. were Councilmembers Mikos, Pollock, Simons, Van Dam, and Mayor Parvin; Steven Kueny, City Manager; Kevin Ennis, City Attorney; and Deborah Traffenstedt, Assistant City Manager. James Markman, City Attorney's Office, and a City Attorney's Office subcontractor joined the closed session by conference call beginning at 5:51 p.m. Mr. Markman and the subcontractor left the meeting at 6:14 p.m., and Jessica Sandifer, Community Services Manager, joined the closed session at this time. Minutes of the City Council Moorpark, California Page 3 February 21, 2018 The Council reconvened into open session at 6:23 p.m. Mr. Kueny stated one case under Item 6.A and Items 6.E and 6.F on the agenda were discussed and there was no action to report. 8.
