SUBJECT: Consider Authorizing the City Manager to Sign an Irrevocable Offer
of Fee Dedication of Right of Way and a Temporary Construction
Easement Agreement for Future Meridian Hills Drive Modifications
BACKGROUND
City Council approved a Subdivision Improvement Agreement (SIA) for Tracts 5187-1 ,
5187-2, and 5405 for the Meridian Hills Residential Subdivision on July 20, 2016,
subject to final language approval of the City Manager and City Attorney After
extensive negotiations, Mayor Parvin signed the SIA on March 2, 2018
The design for Meridian Hills Drive was approved more than a decade ago Under
Development Agreement Condition of Approval 6 20, the Developer is required to
construct the required grading, drainage, and street improvements extending Meridian
Hills Drive to the southern boundary of the tract However, the horizontal and vertical
alignment of Meridian Hills Drive as designed may not comport with the future extension
of Meridian Hills Drive within the proposed, adjoining Hitch Ranch project to the south
This area is illustrated in Attachment 1 Therefore, the Developer and the City agreed in
section 17 H of the SIA that, in lieu of the Developer constructing the improvements,
they shall instead, subject to the approval of the City Engineer at his sole discretion and
acceptance by the City Council,
1 irrevocably offer to the City the property necessary for a realigned public street
(Attachment 2),
2 grant to the City a temporary construction easement to provide room for the
future work (Attachment 3), and
3 pay the City $170,000, the estimated, present value of the work necessary to
complete the street

DISCUSSION
The Developer has paid the City. That money will be held with the presumption that the
Hitch Ranch Developer will accomplish any realignment work. The irrevocable offer and
temporary construction easement include a 100 foot width on both sides of the existing
right of way, from the equestrian area (Lot L) down to the southern tract boundary.
Based on an estimate from Hitch Ranch’s representative, that width will be more than
adequate to accommodate a future realignment. This area is currently owned by the
Meridian Hills Developer and will be transferred to the Home Owners’ Association, to be
maintained by the Landscape Maintenance District.
FISCAL IMPACT
None.
STAFF RECOMMENDATION
Authorize the City Manager to sign and the City Clerk to record the Irrevocable Offer of
Fee Dedication and Temporary Construction Easement Agreement.
