SUBJECT: Consider Beer Garden at Moorpark Multicultural Arts Festival
BACKGROUND & DISCUSSION
On December 20, 2017, the City Council approved implementation of the Moorpark
Multicultural Arts Festival (Multicultural Arts Festival) that will be held on May 19, 2018
on High Street The event will replace the Moorpark Arts Festival that was managed by
the Parks, Recreation and Community Services Department from 2007 through 2015
For a variety of factors, including declining attendance and difficulty securing artist
participation, the Arts Festival was cancelled in 2016 and 2017
Staff recommended replacing the Arts Festival with the Multicultural Arts Festival
because it will appeal to a broader audience than a fine arts festival, while still allowing
a focus on art, music and dance Food vendors will be enhanced to feature specific
ethnic cuisines Other activities will include informational booths from local cultural
organizations, craft vendors, an art show, a variety of cultural music and dance, and a
children's area featuring games and crafts from around the world Staff's
recommendation for the Multicultural Arts Festival involved a broader event concept,
rather than a more limited fine arts festival Staff is in the process of planning and
coordinating the event
One component of the event that staff has been considering is the inclusion of an area
dedicated to the purchase and consumption of craft beer, particularly craft beer that
represents a particular culture Historically, the City's practice has been not to include
alcohol service at City events, primarily due to the fact that City events are generally
held in our parks and the Moorpark Municipal Code prohibits alcohol consumption at all

parks and open space areas within the City, with the exception of the Community
Center. However, the City’s Municipal Code does not prohibit the consumption of
alcohol on High Street under a Temporary Use Permit (T.U.P), and modifications or
adjustments to the Municipal Code would not be necessary to allow this use. In fact
there have been several non-City events where the City has approved a TUP to sell and
consume alcoholic beverages on High Street in the past. In 2014, 2016 and 2017 the
Morning Rotary Club has held the Moorpark Beer Festival on High Street and during a
recent Country Days event the Chamber of Commerce included a beer garden as a
component of the event. It is also important to note that during certain City events held
at the High Street Arts Center (HSAC), such as the Moorpark Has Talent show, the
Moorpark Foundation for the Arts (Foundation) sells beer and wine through their
concession stand. The Foundation also typically operates their concession stand during
outside uses of the HSAC. The Foundation retains the proceeds of the sales, which are
then used for the benefit of HSAC programming.
Staff believes that the Multicultural Arts Festival would be an ideal first event to assess
whether offering alcohol service at certain City events is appropriate. Since the
Multicultural Arts Festival is held on High Street, it would allow staff an opportunity to
evaluate alcohol service at a City event without making any necessary modifications or
adjustments to the City’s Municipal Code. The City Council has requested that staff
prepare an agenda report regarding the use of alcohol at City parks at a future date.
Staff believes that allowing alcohol consumption in a contained and regulated
environment at the Multicultural Arts Festival would allow staff an opportunity to
evaluate any concerns prior to scheduling a future agenda item.
To this end, staff has contacted the Enegren Brewing Company (Enegren’s) to see if
they had an interest in participating in the Multicultural Arts Festival. Enegren’s is a
local craft brewery that brews German style beer, as well as several traditional, and not
so traditional American beers. Staff believes that Enegren’s beer and their craft beer
ideology personifies the cultural theme of the event. Staff has contacted several food
trucks that serve specific ethnic and cultural foods, and the addition of a culturally
appropriate beer would work well within the food planning activities of the festival.
Additionally, Enegren’s is a local Moorpark business. Their popularity in Moorpark and
the surrounding communities could garner significant participation simply due to their
reputation.
Staff has discussed the idea of a beer garden with Moorpark’s Police Captain and has
been informed that there are few concerns regarding this type of use, provided the beer
garden is contained and all requirements of the Alcohol Beverage Control (ABC) Act are
adhered too. It should be noted that there is already a sworn officer scheduled for this
event. Additionally, staff intends to provide a separate enclosed area and will require a
security guard to check identification and provide general oversight. It should be noted
that in order to obtain an ABC Daily License, a local non-profit organization will need to
sponsor this activity and apply for the permit, as the City cannot apply for the required

permit under ABC rules. Staff will reach out to the local non-profit organizations to see
if there is any interest in sponsoring the beer garden should the City Council approve
this activity.
Staff believes that this event may attract other vendors with similar products. For
instance, there may be wine or other alcohol vendors that feel that this event is an
opportunity to showcase their products. In light of the fact that this event focuses
specifically on different cultures, staff believes that it is important to establish some
parameters:
1. Alcohol vendors shall only be allowed to serve beer or wine.
2. The alcohol served must be produced by the company serving the alcohol.
3. The alcohol served must be specific to a specific culture or region.
4. Sales are limited to one drink per person at a time, and each drink is limited to 16
ounces for beer and 6 ounces for wine.
FISCAL IMPACT
There is no additional fiscal impact to the General Fund for adding a beer garden to the
Multicultural Arts Festival. As described in the December 20, 2017 staff report, funds
are currently budgeted for an arts festival and it is expected that this event will be able
to meet its’ minimum cost recovery requirement. While the addition of a beer garden
may result in additional costs to the event, including permits and security, it is
anticipated that vendor fees will be adequate to cover these costs.
A summary of the event budget, estimated direct costs, and estimated revenue is
below. In addition to direct costs, it is anticipated that approximately 300 full-time staff
hours will be dedicated to planning and coordinating the event.
