to Adopt a Project List to be Funded by Senate Bill 1 (SB 1): The Road Repair and Accountability Act of 2017 BACKGROUND/DISCUSSION On April 28, 2017 the Governor signed Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017, into law which will nearly double the amount of revenue cities and counties will receive from the state for local street maintenance and rehabilitation needs On September 16, 2017 the Governor signed Assembly Bill 135 (AB 135) cleanup legislation for SB 1 In the part of the statute relevant to this staff report, the law was changed to simplify the process by which cities and counties could approve SB 1 project lists Cities only need to adopt project lists at a regularly scheduled meeting by resolution and not adopt the list as a budget amendment The California Transportation Commission (CTC) provided guidance to cities and counties that requires project lists to be submitted that include, at a minimum a description and location of projects to be funded by SB 1 revenues, schedule, and useful life of the work The CTC does not approve city and county lists but rather tracks and reports on the program Cities can revise the lists as desired To ensure that the City receives 2018-19 funding, the list must be sent to the CTC by May 1 , 2018 The proposed project is described below and within the Draft Resolution, Attachment The City will be required to submit a proposed project list and a completed and in-progress expenditure report each year in October Staff proposes that the 2018-19 Road Maintenance and Rehabilitation Account funding be used to accomplish general maintenance including but not limited to pavement maintenance and repairs and repairs to adjacent facilities due to the work This work will be accomplished in the downtown area between Spring Road and Moorpark Avenue, north of Los Angeles Avenue and south of Wicks Road Performing regular maintenance on roads preserves the pavement and is less expensive and less disruptive than having to do major reconstruction of roads once the pavement fails (e g 1 Honorable City Council April 18, 2018, Regular Meeting Page 2 Princeton Avenue) There is never enough money to complete the needs of these programs SB1 dollars will be used to augment existing dollars and help decrease the funding deficit Even with these SB1 dollars, there will still be insufficient funds to fully fund the City's maintenance needs This work will utilize the second year of SB 1 revenues, which will be received on a monthly basis beginning in 2018-19 Staff will return to Council with a specific design for this work FISCAL IMPACT Staff anticipates that approximately $611 ,000 of new funding will be made available to the City in this second program year That amount should increase over several years as new fees and taxes take effect STAFF RECOMMENDATION Adopt Resolution No 2018- and authorize staff to submit the proposed project list online to the California Transportation Commission prior to May 1 , 2018 Attachment Resolution No 2018- 2 RESOLUTION NO 2018- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING A PROJECT LIST TO BE FUNDED BY SB 1 THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017), was passed by the Legislature and signed into law by the Governor on April 28, 2017 in order to address significant multi-modal transportation funding shortfalls statewide, and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of the City of Moorpark are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year, and WHEREAS, the City of Moorpark must include a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1 , which must include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement, and WHEREAS, the City of Moorpark will receive an estimated $611 ,000 in Fiscal Year 2018-19, and WHEREAS, funding from SB 1 will help the City of Moorpark maintain and rehabilitate streets in the City of Moorpark this year and into the future, and WHEREAS, the 2016 California Statewide Local Streets and Roads Needs Assessment found that California's streets and roads are in "at-risk" condition and this revenue will help increase the overall quality of our road system, and WHEREAS, without revenue from SB 1, the City of Moorpark would have otherwise postponed street projects, and WHEREAS, modernizing the local street and road system provides well-paying construction jobs and boosts local economies, and WHEREAS, the local street and road system is also critical for farm-to-market needs, interconnectivity, multimodal needs, and commerce, and 3 Resolution No 2018- Page 2 WHEREAS, police, fire, and emergency medical services all need safe, reliable roads to react quickly to emergency calls and a few minutes of delay can be a matter of life and death, and WHEREAS, maintaining and preserving the local street and road system in good condition will reduce drive times and traffic congestion, improve bicycle safety, and make the pedestrian experience safer and more appealing, which leads to reduce vehicle emissions helping the State achieve its air quality and greenhouse gas emissions reductions goals, and WHEREAS, restoring roads before they fail also reduces construction time which results in less air pollution from heavy equipment and less water pollution from site run- off, and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, will have significant positive co-benefits statewide NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS SECTION 1 The foregoing recitals are true and correct SECTION 2 The following project is planned to be funded with Road Maintenance and Rehabilitation Account revenues Description & Location Project 2019-001 General maintenance including but not limited to pavement maintenance and repairs and repairs to adjacent facilities due to the work This work will be accomplished in the downtown area between Spring Road and Moorpark Avenue, north of Los Angeles Avenue and south of Wicks Road Estimated useful life 7 years Anticipated year of construction 2018 SECTION 3 The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions 4 Resolution No 2018-
