SUBJECT: Consider Acceptance of the Maintenance of Tierra Rejada
Road in PC -3 and the Exoneration of the Related
Improvement Bond [California Community Builders]
The developer of the Mountain Meadows Planned Community (PC -3)
[initially Urban West Communities (UWC) -- now California Community
Builders (CCB) ] has completed the construction of the Tierra Rejada
Road street improvements. Bond No. 11127011986, in the amount of
$300,000, was deposited with the City to guarantee that said
construction was completed to the satisfaction of the City. It is,
therefore, appropriate for the City to consider acceptance of those
improvements and the exoneration of the related bond.

The following is a summary of the status of the Tierra Rejada
Road street improvements.
1. Street Repairs -- CCB has undertaken and completed
extensive asphalt removal and replacement along the subject
portion of Tierra Rejada Road.
2. Slurry Seal -- In April of 1995 the City Council canceled
the Tierra Rejada Road Slurry Seal Project and directed staff
to include this street segment in the next Asphalt Overlay
Project. As a part of that action, the City Council
stipulated that, consistent with prior agreement between CCB
and the City, CCB was to pay the City a sum equal to the
estimated cost (including City contract administration costs)
of applying a Type II slurry seal to the that portion of
Tierra Rejada Road within PC -3. Said amount has been paid by
CCB.

3. Subsurface Drainage System -- The April 1995 City Council
action included a requirement that a subsurface drainage
system be installed along Tierra Rejada Road where required,
as a remedial measure to cope with subsurface water intrusion
into the substructure of the roadbed. Said action also
stipulated that CCB was to pay an amount equal to the cost of
that portion of the subdrainage system constructed within PC-
3. A contract has been awarded for said work and
construction should commence in the near future.
4. Asphalt overlay -- The design for the 1995 Asphalt Overlay
Project is almost completed. Said project will include the
subject portion of Tierra Rejada Road. Said project will be
partially funded by a federal Surface Transportation Program
(STP) grant. As discussed above, the developer will not
participate in the funding of this project. It is
anticipated that this project will be presented to the City
Council in the near future for approval and authorization to
advertise.
1. Minor Modification [Landscaping] -- CCB has undertaken and
completed modifications to the parkway and median landscaping
consistent with the requirements of an approved Minor
Modification.
2. Medians -- The median landscaping is a part of the subject
improvements to be accepted. The maintenance of such
improvements is normally funded by the Citywide landscape
maintenance assessment in AD84 -2. In that these costs were
not included in the AD84 -2 assessments for FY 1995/96, it is
recommended that the City accept the maintenance of these
landscape improvements (subject to certain conditions
described below) , provided City costs for the remainder of FY
1995/96 be funded by CCB. These provisions are discussed in
more detail in Section F of this report.
3. Parkways -- The width of the street right -of -way along this
portion of Tierra Rejada Road is ninety -four feet (941). The
street improvements within this right -of -way consist of the
paved street, a center landscaped median and an eight feet
(81) wide sidewalk on each side of the street. The parkway
landscape and hardscape improvements on each side of the
street are beyond the limits of the street right -of -way, in
a separate parcel owned by the Mountain Meadows Community
Association. These parkway improvements are not a part of
the subject improvement to be accepted by the City.

Representatives of the Mountain Meadows Community Association
have requested that the City take over the maintenance of
this landscaping. Consistent with recent City Council
action, the Engineer's Report for AD84 -2 for FY 1996/97 will
include provisions for the establishment of a new Zone of
Benefit to fund City maintenance cost for these improvements.
If approved, the City will take over said maintenance
effective July 1, 1996.
As mentioned above, in an effort to render the landscaping
improvements in this area more "maintenance friendly," the
developer sought and received approval of a Minor Modification
to the approved parkway and median landscaping plans for that
portion of Tierra Rejada Road within PC -3. The changes to the
landscape improvements required by this Minor Modification have
been completed and accepted by the City. This effort included
the removal and replacement of a number of trees to resolve
certain visibility problems.
D. Minor Street Repairs
As stated in the attached letter (Exhibit 1) from the City
Engineer's Office dated January 12, 1996, CCB has been directed
to undertake certain minor pavement repairs to Tierra Rejada
Road. It is recommended that the subject action be approved
subject to the completion of those repairs by CCB.
E. CCB Share of Costs for sub-Drainage System
CCB has agreed to pay the City a total sum of $90,000 for their
share of costs related to the construction of the Sub- drainage
system. It is recommended that the subject action be approved
subject to receipt of such payment.
F. City Maintenance of Median Landscaping
As stated above, AD84 -2 cannot fund the maintenance of the
subject median landscaping during FY 1995/96. It is the intent
of staff to include the costs of this maintenance in the budget
for AD84 -2 for FY 1996/97. It is the desire of CCB that the
City take over the median landscape maintenance effective March
1, 1996. Accordingly, CCB has agreed to pay the City for such
costs through June 30, 1996. The estimated monthly cost of such
maintenance is $3,333. It is recommended that the subject
action be approved subject to receipt of a letter agreeing to
such payment.

The irrigation system for the medians is a part of the total
irrigation system for both the parkways and the medians. In the
event the City does not assume the maintenance of the parkways,
as discussed above, it will become necessary to undertake
significant modifications to this irrigation system to segregate
the irrigation system for the medians from the irrigation system
for the parkways. These efforts would include the installation
of a number of new improvements, including: a) several new
electrical services; b) one or more new irrigation controllers;
and, several new water meters. It is recommended that the
subject action be approved subject to receipt of a letter
agreeing to undertake such modifications to the irrigation
system, should same become necessary.
H. Total CCB Costs
Attached as Exhibit 2 is a letter to the City from CCB
summarizing the costs they have incurred in undertaking
corrections prerequisite to City acceptance of the subject
street. Those costs are summarized as follows:

Staff recommends that the City Council accept the Tierra Rejada
Road street improvements and median landscaping improvements within
PC -3 effective March 1, 1996, and authorize the City Clerk to
exonerate Bond #11127011986 ($300,000] subject to the following
conditions:
a) completion of the street repairs required by letter to CCB
dated January 12, 1996, prior to acceptance of improvements
and bond exoneration;
b) receipt of payment by CCB of $90,000 representing their total
cost for the Tierra Rejada Road Subdrain Project;
c) completion of the installation of sub - meters on all
irrigation lines serving the medians;
d) receipt of a letter from CCB agreeing to pay all actual City
costs for median landscape maintenance (including utility
costs) for the period between March 1, 1996 and July 1, 1996;
e) receipt of an advance payment in the amount of $13,333.00,
said amount being equal to an estimate monthly maintenance
cost of $3,333 for the above mentioned four (4) month period;
and,
f) receipt of a letter from CCB agreeing to undertake all
necessary modification to the median landscaping irrigation
systems required to completely separate same from the parkway
landscaping system, in the event the City does not assume the
maintenance responsibilities for said parkways.

Deficiencies to the improvements on Tierra Rejada have recently been
noted.
These deficiencies are as follows:
(1) The pavement in the left lane in the northbound direction on Tierra
Rejada, approximately 530 LF north of Mtn. Meadow, has deteriorated
due to erosion. Pot holes are forming and creating a rough road in
approximately a 10 ft. by 10 ft. section of the lane. In addition, the
pavement on the southbound lane of Tierra Rejada, at this same
location, is deteriorating due to erosion.
(2) A 3 ft. by 3 ft. section of pavement in the left turn lane in the
northbound direction of Tierra Rejada, at the intersection of Walnut
Creek Road, has subsided at the crosswalk.
The City will be overlaying Tierra Rejada Road in the next few months and
the asphalt in these areas must be repaired before the overlay can be
started.
Please review the deficiencies in the field and submit a schedule for
repairs as soon as possible.

This letter is the FOURTH formal request for exoneration of bond #2701986 in the
amount of $300,000.00.
The City of Moorpark agreed in October of 1994, that upon completion of right of way
repairs and contributions to the City of Moorpark Slurry Seal Project of Tierra Rejada
Road, UWC/Moorpark Investors Inc. would be released from further responsibilities to
maintain Tierra Rejada Rd.. The City of Moorpark would then perform all future
maintenance requirements of Tierra Rejada Road.
As you are aware Ken, the repairs were completed months ago and the In -Lieu Slurry
Seal fees have been paid. At this time we respectfully request that The City of
Moorpark acknowledge these items as complete and exonerate the above said bond.
Attached is a recap of costs incurred by UWC/Moorpark Investors Ltd. in conjunction
with said repairs and contributions and an opinion letter from Ken Bley.
