SUBJECT: Consider a budget transfer of $40,628 from Fund 5 Reserve to Fund
05.4.147.903 for the Mail Marketing Art Project.
Discussion
The City Council may recall that the project known as G & S/Mail Marketing IPD 93 -1
was conditioned to pay the City's Art in Public Places fee or install a work of art in lieu of the fee.
Mail Marketing paid the $40,628 fee on 1/20/94. Mail Marketing then proceeded to submit to the
Council an art form for your review and approval. The City Council considered and approved the
item at its meeting of 8/2/95. Mail marketing proceeded to hire the sculptor for the purposes of
creating the art form and installing it at the main entrance to the Mail Marketing building.
Pursuant to the condition of approval, the City is to reimburse Mail Marketing for the cost of the
sculpture up to the amount of the fee collected. Mail Marketing submitted an invoice for $12,540
on 1 l /l /95. Mail Marketing also submitted proof of payments to the artist in the amount of
$12,540. In order to process the reimbursement to the applicant, as agreed, it is first necessary to
transfer the fee from Fund 5 reserve to Fund 05.4.147.903.

The balance of the fund will be paid to Mail Marketing as prescribed in the attached
schedule.
Recommendation (ROLL CALL VOTE)
That the City Council authorize the transfer of $40,628 form the unreserved balance
available in Fund 5, to Improvements Other Than Buildings, line item 05.4.147.903.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 140ORpARK,
CALIFORNIA APPROVING MINOR MODIFICATION NO. 2 TO INDUSTRIAL PLANNED
DEVELOPMENT PERMIT NO. 93 -1 - G &S PARTNERSHIP
WHEREAS, on December 1, 1993, the City Council adopted
Resolution No. 93 -988 approving Lot Line Adjustment No. 93 -8 to
consolidate three existing parcels into two parcels by eliminating
one of the lot lines and Industrial Planned Development Permit No.
93 -1 to construct two industrial concrete tilt -up warehouse
buildings of 253, 780 s.f. and 152,500 s.f.; and
WHEREAS, on July 10, 1995 G &S Partnership applied for
Minor Modification No. 2 requesting that the "Art in Public Places"
deposit in the amount of $40,628 be applied to a stone and water
feature which would be located in the plaza area; and
WHEREAS, the Director of Community Development deferred
the decision on this Minor Modification to the City Council on the
basis that Condition 45 specifically requires the artwork to be
approved by the City Council; and

staff report dated July 20, 1995; and
WHEREAS, the City Council determined that this project is
categorically exempt from CEQA requirements as a Class 1 exemption
for minor alterations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The stone and water feature to be located in'the plaza
Of Industrial Planned Development Permit No. 93 -1 consistent with
the July 20, 1995 staff report is of public benefit. The applicant
shall maintain the stone and water feature for the life of
Industrial Planned Development Permit No. 93 -1.
SECTION 2. Based upon the information and findings, the City
Council conditionally approves Minor Modification No. 2 to IPD 93 -1
for refund of the "Art in Public Places" fee in the amount of
$40,628 per the following schedule:

SECTION 2. The City Council has determined that the application
