SUBJECT: CONSIDER AMENDMENT TO THE MOORPARK MUNICIPAL CODE SECTION
ADDITION OF SECTION NO 17.32.011 REGARDING SECOND
DRIVEWAYS IN RESIDENTIAL ZONES
Background
The City Council adopted by minute action, the attached policy on
October 5, 1988 regarding second driveways. In the past, staff has
found that this policy has been difficult to interpret and apply.
In a memorandum to the City Council on March 1, 1995, staff
indicated that a request by Mr. Henry Bravo illustrated the
problems with the existing policy.
On October 4, 1995, the City Council discussed initiating an
amendment to the City's Zoning Ordinance and adopted the attached
resolution directing the Planning Commission to study, set a public
hearing and provide a recommendation to the City Council pertaining
to the addition of Section 17.32.011 regarding second driveways in
residential zones.
At a public hearing on November 13, 19951 the Planning Commission
adopted the attached Resolution recommending to the City Council
the addition of Section 17.32.011 regarding second driveways in
residential zones.
Discussion
The Planning Commission recommends the following revisions should
be added to the City's Zoning Ordinance as the Zoning Ordinance
does not currently address this issue. The City Attorney has
reviewed the Ordinance and have been placed in legislative format.

A. Maximum Number
No more than two driveway approaches per street
frontage shall be allowed.
B. Minimum Setbacks
1. Driveway approaches shall have a minimum
setback of 60 feet from the corner radius (as
measured from the end of the radius to full
curb height).
2. Driveway approaches shall have a minimum
setback of 40 feet from any other driveway
approach on the same property frontage (as
measured from full curb height to full curb
height).
3. Driveway approaches shall have a minimum
setback of 10 feet from any ether driveway
approach on an adjacent property (as measured
from full curb height to full curb height).
C. Required Development Standards

1. If a gate is i d te—be used over the
driveway, and 1--s" d"' gate is less than 20
feet from the curb, the gate shall swing
inward or be a sliding /rolling type parallel
to the property line.
2. Second driveways shall be located a minimum of
5 feet from the property line.
3. The second driveway shall have a maximum width
of 12 feet.
D. Approval Process
Construction of a second driveway for a residence
requires approval of an Administrative Permit
pursuant to Section 17.44.030.
Recommendations:
1. Open the public hearing, accept public testimony, and close
the public hearing.
2. Determine that the modifications to the City's Zoning
Ordinance are categorically exempt pursuant to State CEQA
Guidelines Section 15061 (b) (3).
3. Find that the proposal is a benefit to the City and that the
Ordinance and the proposal be forwarded to the City Council
with a recommendation of approval.
3. Introduce the Ordinance for first reading.
