My , DATE: September 22, 1995 (CC Meeting of October 4, 1995) SUBJECT: Consider Certified Unified Program Agency (CUPA) Responsibilities For Hazardous Materials Programs within the City of Moorpark BACKGROUND In 1994, the State Legislature passed SB 1082 which requires that the implementation of certain hazardous materials programs be coordinated by a single Certified Unified Program Agency (CUPA) agency within each jurisdiction. Specifically, the programs combined under the CUPA are Hazardous Materials Business Plans, Hazardous Waste, Underground Tanks, and Aboveground Tanks. The Ventura County Environmental Health Division (VCEHD) has been designated by the Board of Supervisors to be the County CUPA Agency. VCEHD currently operates three of the above CUPA programs (except Aboveground Tanks) for most jurisdictions within the County, including the City of Moorpark. The Aboveground Tanks program is currently regulated by the State Regional Water Quality Control Board. However, VCEHD is proposing to take over administration this program locally as of January 1, 1996. SB 1082 has provided several options for cities in implementing the mandated CUPA programs. Cal /EPA has asked cities to select one of the following options: 1. A city may form of its own CUPA agency in which the city would then take over responsibility for implementing the CUPA programs and be accountable directly to the State; 2. A city could become a participating agency (PA) and implement some of the programs under the CUPA umbrella with oversight by the County; or 3. A city may allow the County to implement all four CUPA programs within the city. Option 3 currently applies to Moorpark. Although the City offers household hazardous waste collection events and education programs, VCEHD conducts the CUPA programs. In regards to the CUPA Hazardous Waste program, VCEHD responds (in conjunction with the Fire Department) to hazardous waste spills and reports of illegal dumping. 0 ck.Vi Honorable City Council SB 1082 CUPA October 4, 1995 Page 2 VCEHD is currently assembling its CUPA application package due to Cal /EPA by January 1, 1996. As part of the package, VCEHD has requested to be notified of Moorpark's intent regarding SB 1082 and the implementation of CUPA programs. VCEHD is requesting that the City send a letter indicating that it either plans to continue having the County (VCEHD) implement and administer CUPA programs as identified in Option 3, or state that the City plans to select an alternative option. Staff is satisfied with the services provided by VCEHD and supports the designation of VCEHD to administer and implement the four CUPA programs. RECOMMENDATION Staff recommends that the City Council: 1. Authorize the County (VCEHD) to implement all four CUPA programs within the City as identified in Option 3; and 2. Direct staff to send a letter on behalf of the City Council in support of the County (VCEHD) providing such services.
