Y Manager Cit Mana g ITEM'•, C', !Y C0Un i- ,'c _ 0r c;2 -/ - ACTION: February 1, 1996 (CC Meeting of February 7, 1996) Consider City Attorney Attendance at City Council Meetings The City Attorney has historically been requested to attend both regularly scheduled City Council meetings each month. During the 1995/96 budget deliberations, the City Council discussed the possibility of limiting the City Attorney's attendance to one of the two regular meetings. Action was deferred until after the City Council adopted revised rules of procedure; namely "Resolution No. 95- 1163 - -A Resolution of the City Council of the City of Moorpark, California, Adopting Rules of Procedure for Council Meetings and Related Functions and Activities and Rescinding Resolution No. 94- 1022." The recently adopted Rules of Procedure include a provision to include proclamations and special presentations only on the second regularly scheduled meeting each month. The intent is to have these more ceremonial actions done only once per month to limit the impact on time needed for business items at the other regularly scheduled (first) meeting each month. DISCUSSION: The proposal to have the City Attorney attend only one regular meeting will save a minimum of $560.00 per month, based on four (4) hours at $140.00 per hour. This can be done on a 4 to 5- month trial basis (February to May /June) and reevaluated as part of the 1996/97 budget deliberations. The Mayor and City Manager can decide if attendance at the other meeting is needed, as is now done for special meetings. The City Council could also request her attendance at a future meeting by stating such request at a meeting. This proposal has been discussed with the City Attorney. She has indicated that while she would not regularly schedule a standing commitment for the third Wednesday of the month, she would be available on a first come, first served basis. This is currently t)30 her status for the 2nd, 4th, and 5th Wednesdays of a month. Staff would generally know at least two weeks in advance if her attendance was needed at a meeting. Currently, City staff has the opportunity to schedule meetings with the City Attorney prior to the City Council meetings beginning as early as 4:00 p.m. if needed. This practice would be limited to one Wednesday per month. STAFF RECOMMENDATION: Direct that the City Attorney not be scheduled to attend the second regularly scheduled meeting of the month for a four (4) month trial period (February to May) to be evaluated by the City Council in June 1996.
