Hare, City Clerk DATE: September 25, 1995 (CC Meeting of 10/4/95) SUBJECT: TEMPORARY USE PERMIT FEE WAIVERS POLICY ITT At its March 1, 1995 meeting, the City Council directed that staff establish a policy for Council review which would establish the procedures by which the City could grant waivers of fees to non- profit organizations. The Council has been requested on numerous occasions to waive the Temporary Use Permit fee for non - profit City of Moorpark based organizations. The Council has been disposed in past to grant such fee waivers on a case by case basis. During the March 1 discussion, where a waiver of the Temporary Use Permit fee was considered for the Community Christian Church, the City Attorney explained that in granting waivers of City fees, a distinction can be made between groups which are community (City of Moorpark) based and groups which are not. As a result of the March 1 discussion, the Council direct staff to write a policy establishing a procedure for waiving Temporary Use Permit fees by exempting the first event of each City of Moorpark based non - profit group each year. For example, a Christmas tree sale which would be for everyday or every weekend within 30 consecutive days would be considered one event; a monthly yard sale would only be exempt for the first event held within 30 consecutive days. In response to Council's direction the attached Moorpark Operating Procedure (MOP) has been drafted. STAFF RECOMMENDATION: Adopt Moorpark Operating Procedure No. 10 relative to Temporary Use Permit Fee Waivers. Attachment: MOP ouou?l MOP MOORPARK MOP MO. 10 OPERATING PROCEDURE DATE: 7 -06 -95 SUBJECT: TEMPORARY USE PERMIT FEE WAIVERS 1. Once each calendar year, a City of Moorpark organization having non - profit status may apply for and be granted a Temporary Use Permit fee waiver for one event. 2. The Director of Community Development shall waive a Temporary Use Permit fee pursuant to this MOP after an eligible organization has submitted a) a completed Temporary Use Permit application; b) a request for fee waiver; and c) proof of non - profit status. 3. Examples for which Temporary Use Permits are issued are special events such as Christmas tree sales, promotional parking lot sales, church carnivals, Country Days and sidewalk sales. 4. The Temporary Use Permit shall be issued for a single event of less than thirty (30) consecutive days in duration. 001W. Z r
