Consider Opposition to Senate Bill 265 Regarding Family Day Care Homes 44".
Senator O'Connell has authored a bill (SB 265) that would increase the number of children
permitted in small and large family day care homes. Under existing law, small family day care
homes may provide care to six or fewer children and large family day care homes to no more than
twelve children. Cities have no land use or regulatory authority over small family day care homes
(i.e., they cannot deny or condition the use), but may impose conditions on large family day care
homes to address parking, noise, etc.
If approved, SB 265 would expand the number of children permitted in a small family day care
home to eight and a large family day care home to 14. It would also modify the number of infants
and school age children permitted in each: Small family day care homes may care for no more
than two infants at any time when more than six children are cared for, and large family day care
homes may care for no more than three infants at any time when more than 12 children are being
cared for. Cities would continue to have no regulatory authority over small family day care
homes, but would be able to impose conditions on large family day care homes, consistent with
existing law.
Increasing the number of children allowed at small and large family day care homes has the
potential for increasing traffic and causing parking problems in the immediate surrounding areas
where these homes are located. The City could expect complaints from residents negatively
impacted by this increased activity.
Recommendation
Staff recommends that the City Council oppose SB 265 and direct the Mayor to sign a letter
communicating the City's position.
