Gilbert, Director of Public Work'`J` DATE: 3� % IF6 August 25-, 44 (Council Neeting } SUBJECT: Authorization to Proceed with Acquisition of Certain Property from the Southern California Edison Company (SCR) Required for the Construction of the Bicycle / Pedestrian / Equestrian / Emergency Access Bridge Across the Arroyo Simi at Liberty Bell Road to Serve Arroyo Vista Community Park I. In September of 1992 the City Council approved an implementation and Release Agreement with G. H. Palmer (PD -1010) which provided for the City to take over efforts to complete the design and construction of the Pedestrian / Equestrian / Bicycle Bridge. The purpose of this project was and still is to provide better access to Arroyo Vista Community Park from the area north of the Arroyo. 2. In April of 1993 the City Council approved the selection of VCE Civil Engineering & Surveying to prepare the design for this project. 3. In July 1993 the City Council approved the conceptual design for the project. 4. In September 1994 the City Council approved the final preliminary design for the project and authorized staff to proceed with efforts necessary to obtain certain easements required for the construction of the project. 5. In July 1995 the project design was completed and ready for presentation to the City Council for approval and authorization to advertise for receipt of bids. However, the City had not yet reached agreement with SCE regarding the subject property acquisition. During this period of time the City became aware of the fact that the alignment for the Arroyo Simi channel widening project proposed by the Ventura County Flood Control District (VCFCD) would preclude the proposed development of Campesina Park, located along the north side of the Arroyo just east of Liberty Bell Road. Subsequent to several meetings with the VCFCD on the matter, in August 1995 the City requested that the VCFCD develop an alternate alignment for their project which would enable the development of Campesina Park. Some of the possible alternative alignments being considered would require the acquisition of additional properties from SCE which could impact upon the subject efforts by the City to acquire needed easements for the pedestrian bridge. Further efforts by the City to acquire the SCE property for the pedestrian bride were suspended until the design for the channel widening could be determined. 7. on February 26, 1996, City and County officials met with the residents of the Villa Campesina neighborhood to discuss the revised channel widening project and its impact on the future Campesina Park. The recommend revised design concept will now allow for the development of Campesina Park. Those present at the February 26th meeting supported the revised designs. 8. It should be noted that the final conceptual design for the VCFCD channel widening project will require no Additional SCE property on the south side of the Arroyo, other than the relatively minor amount of additional property initially anticipated to be required by the VCFCD. ti �. • W -- City staff has been negotiating with representatives of SCE on the terms of a proposed reciprocal exchange of access rights. The City has offered to grant SCE easements at the east end and at the west end of Arroyo Vista Community Park, which would allow SCE maintenance and operations vehicles to cross park property to gain access to SCE property located just north of the park. SCE current has no means of access to this property other than one or more dry weather crossings across the Arroyo. It is likely that these rights would severed when the VCFCD constructs their channel widening project. p•dbrgio ref Arroyo Vista Park Bicycle /Pedestrian /Equestrian Bridge Property Acquisition March 1996 Page 3 It was the intent of staff to recommend the granting of the above described access rights to SCE in exchange for easements required for the construction of the pedestrian bridge. If approved by both parties, this would have been a "no cost" transaction for both parties. To date, SCE has declined the City's offer. SCE has requested that the easements to be granted to SCE by the City, include the right to provide utilities to their property and the right to open the Arroyo Community Park access road to all possible future lessees of the SCE property for agricultural and possible other uses permitted by the State Public Utilities Commission (PUC) and the City's zoning regulations. 1. Project Location -- The location and general description of the pedestrian bridge project is described in the attached Exhibit W. 2. Property Description -- In order to proceed with the pedestrian bridge project, it is necessary to acquire from SCE the three easements described in the diagrams attached as Exhibit 2. One of the easement is the granted to the City. The other two are to be granted to the VCFCD. The total area of all three easements is 33,809 sf. 3. Property Value -- Staff has asked SCE for their estimate of the value of the required easements based upon their experience of granting similar uses on other similar SCE properties. Presuming that said "asking" price could be supported by appropriate documentation and subsequent to final negotiation of price and other terms, staff would consider recommending that the City purchase the required easements for an agreed upon amount determined in this way. This would preclude the necessity of having the property appraised. To date SCE has not provided the City with an asking price. In the event an agreed upon price cannot be determined, it will become necessary for the City to have the property appraised. 4. Appraisal -- Staff has received proposals from a number of appraisal companies. The cost of an appraisal is estimated to range from $3,000 to $9,000 depending on the effort required. The preparation of an appraisal will require between six (6) and ten (10) weeks to complete. 2o Arroyo Vista Park Bicycle /Pedestrian /Equestrian Bridge Property Acquisition March 1996 Page 4 5. City Offer -- Upon completion, acceptance and approval of the appraisal by the City Council, the City would be prepared to make an offer to SCE for the purchase of the subject easements. If accepted, the transfer of the subject easements could occur within a few weeks. 6. SCE Access Rights -- Although the City's purchase of the required bridge access easements would not resolve SCE's lack of adequate access to their property, the price determined for the City's easements could be used as the basis for determining the City's "asking price " for granting SCE access rights across park property for their maintenance and operations vehicles. 7. OIP -- In the event the City's offer is rejected, the City could seek from a court of competent jurisdiction, an Order of Immediate Possession (01P). Under this procedure, the City would deposit with the court an amount equal to the appraised value of the property. Possession of the property could be granted to the City within a relatively short period of time with the actual purchase price to be determined at a trial in which, at SCE's option, either the court or a jury would make the determination based on evidence which could include a second appraisal report prepared by SCE. C. Fiscal Impact The total cost of property acquisition has not been determined.
