SUBJECT: Consider Approval of a Mitigated Negative Declaration for
the Proposed Construction of a Bicycle / Pedestrian /
Equestrian / Emergency Access Bridge Across the Arroyo
Simi at Liberty Bell Road to Serve Arroyo Vista Community
Park
The design for the subject project is completed. The City is in
the process of acquiring right -o€ -way needed for the project. It
is the intent of the City to proceed with advertising for receipt
of bids, award of contract and construction of the subject project
as soon as possible.

A. Consultant
The City retained the services of The Planning Corporation to
prepare an environmental document which adequately meets the
requirements of the California Environmental Quality Act (CEQA),
for the proposed construction of a Bicycle / Equestrian /
Pedestrian / Emergency Access Bridge across the Arroyo Simi to
serve Arroyo Vista Community Park.
The Consultant has prepared a draft Mitigated Negative
Declaration for the subject project. A copy of this document
has been distributed to the City Council under separate cover.
The Consultant has attested that this draft document fully
describes the project and its impacts, and adequately defines
certain mitigating measures deemed necessary to address those
impacts.

On March 5, 1996, copies of the draft document were distributed
to the following parties:

The review period stated in the Notice of Completion extends
through 5:00 p. m. on April 3, 1996.
All written comments received are attached as Exhibit "A."
Those comments requiring a response are identified on page 1 of
Exhibit "A." Those responses are attached as Exhibit "B ".
The City Council is advised that a copy of this staff report,
along with the written comments and responses attached as
Exhibits 'A' & 'B', will be attached to and made a part of the
subject Mitigated Negative Declaration.
Staff recommends that City Council find that the subject Mitigated
Negative Declaration and related Mitigation Monitoring Program
fully meets the requirements of CEQA and is hereby approved.

The California Regional Water Quality Control Board for the Los Angeles Region (Regional
Board) is charged with protection of water quality for all waterbodies in the Los Angeles and
Ventura coastal watersheds. The Regional Board protects water quality by implementing
regulations, policies, and programs authorized by the State's Porter - Cologne Water Quality
Control Act, and by administering certain regulations established by the Federal Clean Water
Act. As a responsible agency under the California Environmental Quality Control Act
(CEQA), the Regional Board also reviews CEQA documents and comments upon water
quality issues.
Regional Board staff have reviewed the referenced document for this project. This project
involves a proposal to construct a pedestrian, equestrian, and bicycle bridge over the Arroyo
Simi at Liberty Bell Road. The purposes of the bridge will be to link neighborhoods within
the City that are currently not served by a pedestrian connection over the Arroyo Simi,
provide a connection to a community park proposed in the immediate project vicinity, provide
safe passage for school children who currently use the bridge location to access community
schools and neighborhoods, and a potential access for emergency vehicles to the community
south of Arroyo Vista Park.
In Response No. 5 of Section III, "Initial Study Checklist and Responses," the document
states that "The entire project will be subject to erosion mitigation planning during
construction; soil erosion measures have not been included in the Contract Documents for
the project. Mitigation measures have been provided to assure that excessive erosion or
siltation does not occur." Please identify and describe these mitigation measures so that
their potential effectiveness can be evaluated.

Thank you for the including the Southern California Edison Company in the review
process for the above referenced document.
Edison Not Shown As Property Owner
This negative declaration fails to describe any impact on Edison or Edison's property due to
the fact we are not mentioned as a land owner.
The "Notice of Preparation and Availability Page" presents the property owners as the City
of Moorpark (City) and the Ventura County Flood Control (Flood Control), erroneously
omitting Southern California Edison Company (Edison) as an affected property owner.
This is falsely reflected in Paragraph #4 and in Paragraph #5 of this "Notice of Preparation
and Availability Page ", as well as on the "Project Description Setting" on page #1.
Approximately one acre of Edison property south of the Arroyo will be affected and change
of ownership to the City and an easement to the Flood Control over this property will be
required for the construction of the bridge.
Negotiation for Reciprocal Exchange of Rim
Edison and the City are currently working on negotiations for a reciprocal exchange of
rights that, if successful, may also include the easement for the Flood Control.
This reciprocal exchange of rights will also allow Edison to improve the appearance of the
project vicinity that is being reflected as "degraded" on page 10 of the "existing
environment" portion of the Mitigated Negative Declaration.
Compatible Use
The "Arroyo Simi Pedestrian Bridge Initial Study" page 11 states that the project area is
planned for park purposes. The portion of Edison property that will be affected is NOT
planned for park purposes except by the City of Moorpark, however, Edison's plans for
the property are of a compatible use.

Edison would like the opportunity to discuss the possibility of negotiating with the city for
use of proposed water line under the pedestrian/equestrian bridge.
As you know, the proposed project is located within the service territory of the Edison
Company and that the electric loads of the project are within the parameters of the overall
projected load growth which we are planning to meet in this area.
Unless the demand for electrical generating capacity exceeds our estimates, and provided
that there are no unexpected outages to major sources of electrical supply, we expect to
meet our electrical requirements for the next several years.
In addition, the relocation, reconstruction, extension, or undergrounding of Edison's
electrical distribution system which may be necessitated by activities within the proposed
project area, will be performed by Edison in accordance with Edison's effective Tariff
Schedules approved by and filed with the California Public Utilities Commission.
As an affected property owner, Edison would like a revised Mitigated Negative Declaration
published in which the following items would be addressed:
• What methods of erosion control will be used to guarantee that Edison towers will
not be affected.
• What methods of fencing will be used on the portion of the easement that crosses
Edison's property to insure that litter and trespassing are controlled.
• If the Liberty Bell/Arizona crossing is removed after construction of the bridge,
Edison's public access to our property will be severed. The issue of Edison's
public access to the property needs to be addressed.

Dear Ms. Phillips,
You have requested that the City identify the specific erosion control measures
which will be required. This is not possible. As the Mitigated Negative
Declaration states, the plans and specifications require the contractor to submit
to the City for approval, an Erosion Control Plan which fully describes the
erosion control measures which will be undertaken by the contractor to prevent
or mitigate any construction related erosion problems. In order to be approved
by the City, that plan must fully describe a) the construction approach, methods
and techniques to be utilized; b) the scope and degree of erosion which could
be generated by such efforts; and, c) the mitigation measures to be employed.
It is not feasible to craft an Erosion Control Plan prior to identifying and
understanding the construction methods to be employed by the Contractor. Said
plan must be "tailored" to fit the specific work to be done.
In addition, be advised that the City will not approve the Erosion Control Plan
unless said plan fully addresses the requirements of permits to be issued to the
City by the Ventura County Flood Control District (VCFCD), the California Fish
and Game Department and the U.S. Army Corp of Engineers. These permits will be
included in the project specifications.

Dear Rudy,
This will serve to respond to the comments provided to the City on
the subject Mitigated Negative Declaration in your letter of March
25, 1996.
1. Edison Not Shown as Property Owner: The Mitigated Negative
Declaration pertains to a proposed City project. Obviously,
the City cannot and will not proceed with the project until
all rights -of -way are acquired. There is no need for any
other party to be shown as property owner of the project.
2. Degraded Condition of Adjacent Property: Your comments appear
to agree with the description of the Existing Environment as
stated on page 10 of the Mitigated Negative Declaration. Any
possible change to the future use of your property is not
relevant to the scope and purpose of this document.
3. Compatible Use: The questions on page 11 of the Initial Study
attempt to determine whether or not the City's project is
incompatible with existing or proposed land uses in the area.
To restate, the answer is no. It is understood that the
future use of your property could include an agricultural use
by a lessee.
4. Water Rights: Providing water to your property is not
relevant to the City's project or to the subject environmental
document.
5. Electrical Service: SCE's ability to provide electrical
service to the area is not relevant to the City's project or
to the subject environmental document. ()("32

6. Erosion Control: Consistent with all City capital improvement
projects, the construction of this project will be done in
accordance with all applicable and relevant standards,
including those pertaining to erosion control. The future
easement across SCE property is adjacent to one of the SCE
towers. It is the intent of the City to construct a "useable"
surface on this easement. We do not believe that these
improvements will adversely impact the towers. If, however,
you have specific concerns in this regard, please bring those
concerns to the City at your earliest convenience. If
necessary, the improvement plans for the City's project will
be modified to adequately address any identified adverse
impacts.
7. Fencing: Please be advised that it is the intent of the City
to install appropriate fencing along each side of the easement
crossing SCE property.
8. SCE Access Across the Arroyo at Liberty Bell Road: The City's
project will not impair the use of the existing dry weather
crossing located just south of Liberty Bell Road. Present
and /or future access to SCE property is, therefore, not
relevant to the City's project or to the subject environmental
document.
It is the determination of the City that the above responses
adequately address your comments. A copy of your comments and this
response will be appended to the subject Mitigated Negative
Declaration. It is, therefore, not necessary to revise and
republish this document.
Approval of the subject Mitigated Negative Declaration by the City
Council of the City of Moorpark, will be considered by that body at
their regular meeting of April 17, 1996. You are welcomed to
provide additional written or oral testimony prior to that
scheduled action.
