Lindley, Assistant to the City Manager DATE: April 18, 1996 i E M LD SUBJECT: Consider Opposing AB 2496 (Margett), Forced Accounts for Public Works Proj ects Background As currently written, AB 2496 (Margett) would curtail the City's authority to use its own employees on public works projects. The bill states that any work done by a local agency that was advertised for bid and subsequently done by force account (in -house labor) must be entirely completed with no changes to the original design specifications, with no exceptions. The bill would also replace the term "work contract" with "work expenditure" throughout the public contract code regarding force accounts and public bidding. The broader term will result in a more expansive list of projects which must be publicly bid and privately contracted. The League of California Cities is urging its members to oppose AB 2496. Recommendation Staff recommends that the City Council oppose AB 2496 and direct the Mayor to communicate its opposition to the appropriate legislative committee. 111
