Request for Curfew Ordinance Review and Submittal

The purpose of this letter is two -fold. The first is to ask that you join in the amicus
brief which the League of California Cities' Legal Advocacy Committee has commissioned
Walter Porr and Janice Scanlan to author. The second is to fill out the attached
questionnaire and forward it to Ms. Scanlan as soon as possible.
The Nunez case was filed in federal court. The suit attacks San Diego's_ curfew
ordinance on every conceivable (and some inconceivable) constitutional front. As you can
expect, Deputy City Attorney, Jim Chapin, wrote a very strong Motion for Summary
Judgment which Federal District Judge Marilyn Huff granted. Plaintiff filed an appeal with
the 9th Circuit. Mr. Chapin has requested that the amicus brief focus, not on the issues
he will address (every constitutional issue out there), but more on the impact striking down
such ordinances will have on cities' abilities to protect their citizens -- no matter how old
they may be. Juveniles not only commit crimes, they are victims of crime.
With that in mind, we have prepared the enclosed questionnaire which will help us
document that most cities which have curfew ordinances have drafted them consistent)
and how these curfew ordinances have helped deter juvenile crime and prevent juveniles
from becoming victims of crime.
