Knipe, Assistant City Engineer t- /— DATE: — DATE: April 26, 1989 SUBJECT: PM-4318 (Falke) - Approval of Parcel Map and Agreement to Construct Improvements BACKGROUND INFORMATION The subject parcel is located in the northwest section of the City of Moorpark adjacent to Gabbert Road. A vicinity map is enclosed for your reference. The parcel map represents a subdivision of 39.83 acres into 4 lots for the development of single family units. The tentative map was approved by the City of Moorpark Planning Commission on March 7, 1988. The conditions of approval for the tentative map have been satisfied and all of the requirements precedent to recordation have been fulfilled. Since there are dedications to the City of Moorpark included in the map, this map must be approved by the Moorpark City Council. The parcel is being developed by Robert Falke and will be provided water service by Ventura County Waterworks District No. 1. Included in this submittal are the following items (on file in the office of the City Clerk) : 1. Parcel map for PM-4318 2 . Surety (issued as an assignment to the City on an insured account) : NAME OF SAVINGS AND ACCOUNT TYPE AMOUNT LOAN ASSOCIATION NUMBER Streets $36,750 Santa Barbara Savings 1161008623 Grading $22,300 Santa Barbara Savings 1161008623 Note that the street surety is not for a public street, but is required to ensure that adequate access to each parcel is provided by the developer. The irrevocable offer for road purposes is to be rejected at this time. This road may be required in the future by the City if the land to the east of PM-4318 develops. However, this road dedication is not required at this time and should be rejected. The approximate location of the road dedication area is shown on the enclosed map. RECOMMENDED ACTION - Approve the parcel map for PM-4318 and authorize the Mayor to sign the title sheet accepting for public use the right-of-way for Gabbert Road, the flowage easement as shown on the map and the access easement over the private road for emergency vehicle use. However, the irrevocable offer for public road purposes on the map should be rejected at this time. - Authorize the Mayor to sign the agreement for construction of subdivision improvements for the parcel map and direct the City Clerk to retain the original agreement and return an executed copy to the developer and surety company. Assistant City Engineer reviewed Condition 29 which requires the Developer to dedicate a flowage easement in the flood hazard areas indicated on the map. The intent is that this will be a recorded document that there is potential for flooding in this area. Condition 30 requires that all drainage easements and secondary drainage easements be maintained by the property owner. The condition does not specifically include the flowage easement for flood hazard purposes. The map reads, "flowage easement consisting of the right of way for flood control purposes for periodic inundation with flood and/or storm waters and the right to prohibit the construction of any structure or channel improvement within said right of way as shown on said map." The purpose of the conditions and the note on the map is that it be a recorded document and a warning to all potential buyers of the property that there is this potential flood hazard in this area. In response to Councilmember Lawrason, Assistant City Engineer Knipe advised that the applicant is aware of the conditions and advises they are no problem. MOTION: Mayor Brown moved and Councilmember Lawrason seconded a motion to approve the staff recommendation as modified. The voice vote was unanimous.
