HARE Chief of Police City Treasurer MEMORANDUM TO: The Honorable City Council FROM: Philip Newhouse, Director of Community Services DATE: May 31, 1989 -7.1 y\\ SUBJECT: Consider Lease Agreement with Dr. Caren for Temporary Storage, Assembly and Testing of Kitchen Equipment for the Senior Citizens Center. BACKGROUND: In February, 1987, the City purchased eleven pieces of kitchen equipment from the Lompoc Hospital District to he used in the proposed Senior Citizens Center kitchen. The kitchen equipment has been in storage awaiting the time when it will he installed in the new Senior Citizens Center. DISCUSSION: Prior to installation in the Senior Center, the kitchen equipment must be checked by the building contractor and repaired to a usable condition. Staff has made arrangements through ,John W. Newton and Associates to use 1,000 square feet of space in Dr. Caren' s building at 111 Poindexter Avenue. The space is offered at no charge for a maximum of 90 days for the temporary storage, assembly and testing of the kitchen equipment. In exchange for free use of the space, the City would install the gas and electric meters for testing of the equipment. Attached for your review and approval is a draft "Temporary Lease Agreement" outlining the conditions set forth by Dr. Caren in the attached letter to the City Manager from Mr. Newton dated May 24, 1989. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 CAREN.MEM/PRAGENDA • The Honorable City Council Page -2- May 31, 1989 STAFF RECOMMENDATION: Approve the Temporary Lease Agreement subject to final approval of language by City Manager and City Attorney between the City and Dr. Caren for the temporary use of 1,000 square feet of space at 111 Poindexter for the temporary storage, assembly and testing of kitchen equipment to be installed in the new Senior Citizens Center kitchen. He will allow the City to utilize the 1000 S . F . space adjacent to Building & Safety , as follows : • Temporary storage , assembly & testing of kitchen type appliances (approximately 15 units) • Free-no rental charge • 60 days , not to exceed 90 days • City to pay for installation of gas meter and gas service line extension to unit • City to pay for electric meter installation and turn on to unit • City to pay gas & electric utility service charges during term • City to be responsible for all permits , licenses , zone clearances and fees associated with this temporary use . • City to provide liability and property damage protection in the form of "additional insured" endorsement on City ' s insurance policies , or similar protection . Basically , Dr . Caren will not charge for this temporary use and will consider it a charitable contribution to the Moorpark Seniors . The consideration for this temporary lease agreement will be the City ' s improvement to the unit in the form of the gas meter installation . If agreeable , please draft up a short agreement , in a form acceptable to the City , outlining the above terms ; have it signed by the appropriate authority ; and forward it to me for execution by Dr .
