Dennis Delzeit, City Engineer /efa//��/- --1-' p +t DATE: April 25, 1988 SUBJECT: Acceptance of Off Street Drainage Improvements Tract 2865-3 (Pardee Construction) BACKGROUND INFORMATION At the City Council meeting of April 20, 1988, Pardee Construction requested that this item be placed on the agenda. The issue is whether or not the City should accept drainage improvements, constructed by Pardee Construction, which are outside the street right-of-way. As City Engineer, I have taken the position that the City should not be responsible for ownership or maintenance of a storm drain until "public drainage" has entered the drain. Both drains in question, accommodate drainage from the southerly hillsides. Tract 2865-3 was approved by the County Board of Supervisors in 1979, prior to City incorporation. There was no requirement for the Homeowner's Association to own and maintain the two drains. Similarly, the City of Moorpark is under no obligation to accept these drains. Pardee has responded that it would take months to form a Homeowners Association and they are requesting the City to accept the drains. 799 Moorpark Avenue Moorpark, California 93021 (805) 529-6864 Y ' { Page -2- The amount of annual maintenance that I would anticipate on the two drains would be very minimal, amounting to approximately four hours per year. I would anticipate an inspection, prior to the rainy season to be sure that there is no brush blocking the entrance to the drains and, perhaps one more inspection after any significant storm. Other than brush accumulation, the drains are self cleaning. I have been asked about the possibility of creating a special zone within the City's 1972 Act Lighting and Landscaping District, involving only the lots within Tract 2865-3 , northerly of Tierra Rejada Road, for the purpose of defraying the annual maintenance costs. I cannot recommend this approach for two reasons: 1. The cost associated with setting up this special zone would exceed the cost of the annual maintenance. 2 . Under the 1972 Act Law, the assessment engineer has the legal responsibility to develop the cost spread which is proportionate to the benefit received by the lots. As such, I cannot make the determination that each lot within the tract, northerly of Tierra Rejada Road receives special benefit and thus should be assessed. Because of the special circumstances involved with this situation, the City Council may wish to accept the drains, in recognition of the relatively low estimated annual maintenance cost. RECOMMENDED ACTION 1. Accept the storm drain easements as shown on the attached exhibits, provided the developer agrees to maintain the drains for one year or; 2 . Take no action accepting the easements, thus leaving the responsibility for the drains with private ownership.
