(650 EAST LOS ANGELES AVENUE) On July 2, 1996, the City received a request from Utility Supply Group Incorporated for a legal lot determination. The property for which the request was made is presently zoned M -2 (Limited Industrial) requiring a 10,000 sq. ft. minimum lot size. The parcel is located approximately 600 feet east of the Spring Road /East Los Angeles Avenue intersection and is shown as APN 512- 0- 160 -585 on the County tax assessor's role. A location map has been attached as Exhibit 1. Section 66499.35 of the Map Act states that any person owning real property or a vendee of that person pursuant to a contract of sale may request, and the local agency shall determine, whether the real property complies with the provisions of the division and of local ordinances enacted pursuant thereto. Upon the determination, the City shall cause a Certificate of Compliance to be filed with the County Recorder if the proposed division complies with local ordinances. Utility Supply Group Inc. has made this request to accommodate a sale of the property. A determination of a legal lot by the City will allow Utility Supply Group Inc. to sell the property in compliance with the requirements of the City's Subdivision Ordinance and the State Government Code. At the present time this property is developed and has a one story concrete block and corrugated metal building located on it. Research of the County's building records indicates that the County granted a permit for construction of the building in May of 1974. It is the City Engineer's opinion that a Certificate of Compliance be issued for the described parcel and has prepared such certificate (Exhibit 2) for recordation. Discussion: As a result of this determination, the City Engineer has issued a. Certificate Of Compliance verifying that the parcel is in compliance with the City's Subdivision Ordinance and Section 66499.35 of the Subdivision Map Act regarding Certificates of Compliance. This request has also been reviewed by the Planning Department which has given its approval for issuance of a Certificate of Compliance. This matter is being presented to the City Council as a courtesy. Should the City Council, or any other authority, desire to appeal the City Engineer's Certification of this property, a public hearing should be scheduled.
