Gilbert, Director of Public Works DATE: September 6, 1996 (Council Meeting 9- 18 -96) SUBJECT: Consider Acceptance of 1) a Deeds to the Parkway Along the Frontage of Country Trail Park, and 2) a Deed to the Access Road to the Easterly End of the Peach Hill Wash A. Peach Hill Wash Access st Endl ccbded Lot J of Tract 4342 -5 (Exhibit 1) is the east end of the Peach Hill Wash. Although this property is owned by the Ventura County Flood Control District (VCFCD), it has been improved by the developer [Urban West Communities / California Community Builders (UWC/CCB)] to provide linear park facilities consisting of a center low -flow concrete channel, landscaping and a concrete pathway along the south side of the channel. These amenities were provided in order to satisfy certain requirements of the Specific Plan, and they were constructed in a manner acceptable to the VCFCD. At the east end of the Peach Hill Wash the concrete pathway turns and extends southerly to Mountain Trail Street. This portion of the concrete pathway is not a part of the above mentioned Lot J owned by the VCFCD. In hindsight, this pathway, and the small landscaped area at the east end of the Peach Hill Wash, should have been shown on Tract 4342 -5 as a separate parcel to be conveyed to the City. It was not. Although the subject property is north and east of the perimeter fence for the Traditions neighborhood, this area (see Exhibit 2 for location) is actually a part of one of the commonly -owned lots within the Traditions Tract. CCB, on behalf of the Board of Directors for the Traditions Homeowners Association, has prepared a Grant Deed (Exhibit 3) conveying this property to the City. This deed has been executed by the owner and provided to the City for acceptance and recordation. r 000054 West Ranch Deeds September 1996 Page 2 If the City Council, approves the acceptance of the subject property, it is the intent of staff to add this area to the areas maintained by the City's contractor. CCB has agreed to fund City costs for the maintenance of this area through June 30, 1997. It would then be the intent of staff to include theses costs in the costs to be funded by the Zone 10 assessment for FY 1997/98. B. Parkway Parcels at Country Tram Park The standard cross section for the collector streets throughout the Mountain Meadows Planned Community (PC -3) places the street right -of -way line one foot (1') behind the curb. Separate parkway parcels were established for the sidewalks and parkways. This design concept was even used for two of the three neighborhood parks in PC -3. Parkway parcels were created between the City street and the City park. Country Trail Park is one of the parks where this is the case. The landscaped parkway within these parkway parcels is a part of the park property, and as such is maintained by the City's contractor along with the park landscaping. The parkway parcels along the frontage of Country Trail Park are currently owned by Urban West Communities (UWC). The owner has prepared and executed a Grant Deed (Exhibit 4) conveying these parkway parcels to the City. Staff recommends that the City Council take the following actions: 1. Approve a Certificate of Acceptance for a Grant Deed for certain property at the east end of the Peach Hill Wash and direct the City Clerk to forward said documents to the County for recordation. 2.
