OOOZOI CITY OF MOORPARK MEMORANDUM TO: Steven Kueny, City Manager FROM: Nelson Miller, Director of Community Developmivy— DATE: October 2, 1996 SUBJECT: Potential Schedule for Bollinger Reversion Per your request, following is a potential schedule for reversion of the Bollinger property to the previous General Plan and Zoning Designations: October 16, 1996 - Resolution of Intention. Initiation of action by City Council Resolution of Intention. It has been City policy that all General Plan Amendments and Changes in Zoning are initiated by City Council Resolution. Section 17.60.020 of the Municipal Code indicates Amendments to Zoning must be initiated by either City Council or Planning Commission Resolution or by application of the property owner. If Council directed, a resolution could be returned for their action on October 16. 2 November 11,19% - Planning Commission Hearing. It appears that if the direction was to revert to exactly the same designation as previous, then we could use the previous EIR. However, any changes might trigger additional environmental review. On that basis, we could probably prepare the required notices, staff reports, and draft Planning Commission Resolution for the November 11, 1996, Planning Commission Meeting. If a Negative Declaration was required then a minimum additional ten day notice would be required which would delay Planning Commission meeting to November 25. 3. December 4, 1996 - City Council Hearing. Planning Commission recommendations transmitted to the City Council for consideration. City Council could adopt the resolution for the General Plan designation and conduct first reading of an ordinance to change the zoning designation. 4. December 18, 1996 - Second reading of Zone Change Ordinance. January 17, 1996 - Effective date of Zone Change Ordinance. The typical processing deposits for a General Plan Amendment and Zone Change on 655 acres would be $!0,543.50. Considering the nature of this action, staff processing time and costs might be thirty to fifty percent of the typical. I am disappointed in that you have chosen not to provide the information you previously agreed to provide. The requested financing plan and schedule would not disclose confidential or proprietary information. It would show who has committed what amount of financing, under what conditions and a specific schedule. From my review of the documents shared with me on October 7, 1996, you are still considering three financing options and are months away from being able to conclude any of the options. Again, what I thought you agreed to provide is a reply to questions of how much financing, from whom, under what conditions and when. Your written response to these questions should be provided to me prior to the scheduled October 16, 1996 ad hoc committee meeting.
