As required by the Mitigated Negative Declaration for the project, certain landscaping will be installed adjacent to this facility. This work is not a part of the subject project, but will be installed as a follow -up project. 10. Erosion Control: As mentioned in the Mitigated Negative Declaration for the project, the plans and specifications require the contractor to undertake certain measures to eliminate or minimize soil erosion during the construction of the project. 11. Electrical: The contract documents include plans and specification prepared by an electrical engineer retained by the City, for the installation of an electrical service, conduit and lighting in the vicinity of the bridge. 12. Irrigation Water: The contract documents include plans and specifications prepared by a landscape architect retained by the City, for the installation of an irrigation water line to extend from the existing irrigation system for Arroyo Vista Community Park, across the bridge to a point just north of the bridge. This new system will provide well water from Arroyo Vista Community Park to the landscaping which will be planted in the areas adjacent to the bridge. This water source will be available to the serve Campesina Park. It will also be available to be extended northerly to serve other City owned and maintained landscaping. C. Environmental Review On April 17, 1996, the City Council approved a Mitigated Negative Declaration for the subject project. All of the mitigation measures cited in that document will be addressed by the subject contract and/or by subsequent action of the City. Pedbr4.ad Bids: Arroyo Vista Park Pedestrian Bridge October 1996 Page 3 1 , - Ir 1, Cabrillo: On April 3, 1996, the City Council approved a Certificate of Acceptance for an Easement Deed from Cabrillo Economic Development Corporation to the City for certain property required for the project. In a related matter, staff also forwarded a Deed from Cabrillo to the Ventura County Flood Control District (VCFCD) for an adjacent piece of property required by that agency in connection with the subject project. 2. VCFCD: The City has provided the VCFCD with an Easement Deed to be granted to the City by that agency, for certain property required for the project. VCFCD is processing the approval and recordation of that Deed. Upon receipt of that Deed, it is the intent of staff to request the City Council approve the granting of an Easement Deed for a portion of the south end of the right -of -way for Liberty Bell Road, required by VCFCD in connection with the subject project. 3. SCE: Easements are required to be granted to the City and to the VCFCD by the Southern California Edison Company (SCE) for certain properties required for the project. As you know, the City and SCE have been unable to come to an agreement on the terms of that acquisition. Accordingly, the City initiated the efforts required to acquire the property by eminent domain. On October 9, 1996, the City Council approved an appraisal report, established the amount of just compensation for the acquisition of the property and directed the City Manager to make a written offer to SCE to acquire the property. We are hopeful that the offer will be accepted. If not, it is the intent of staff to request that the City Council authorize the City Attorney to commence a condemnation action. Given the right circumstances, the City could have access rights to the property within a few weeks. Given the worst case scenario (condemnation proceedings with difficulties), staff estimates that the City will gain these access rights no later than early February 1997. In spite of these uncertainties, it is recommended that the City proceed with advertising for receipt of bids at this time. This recommendation is supported by the implementation schedule set forth in Section I of his report. I .. l01 1. VCFCD: The City has already obtained an Encroachment Permit from the Ventura County Flood Control District for the construction of the project. 2. Fish and Game: The City is in the process of obtaining permit information from the California Department of Fish and Game, setting forth requirements applicable to the subject project. This information will be included in the final plans and specifications. pedbrg.ed Bids: Arroyo Vista Park Pedestrian Bridge October 1996 Page 4 3. U. S. Army Corp of Engineers: The City is also in the process of obtaining permit information from the U. S. Army Corp of Engineers, setting forth that agencies requirements applicable to the proposed construction. This information will also be included in the final plans and specifications. r The plans and specifications include language related to the interruption of work and /or property damage (contractor's property) resulting from any conflicts between the need to work in the water course and the occurrence of storm events. Although contract delay time would be granted, the Contractor is advised that no additional cost will be granted for any such delays, or for any property damage the contractor may sustain during any such storm events. A set of the plans and specifications for this project have been placed in the City Council office for review and comment. H. FiscalImnact 1.
