Los Los Angeles Ave. (Bauducco's) Commercial Planned Development Permit No. 89 -1 Major Modification No. 2 was approved by the City Council (Resolution No. 94 -1074 on October 5, 1994 for the construction of a 117,170 square foot commercial retail center. On July 30, 1996, Zone Clearance No. 96- 197 was approved for tenant improvements for an Italian restaurant, (Bauducco's) which is currently under construction and is scheduled to open in December 1996. The approved Resolution of approval for the center does not limit the hours of operation. However, the approved liquor policy (adopted on April 19, 1989) limits the hours of operation for businesses which sell alcoholic beverages until 12:00 a.m. midnight. General Plan Designations are: C -2 = General Commercial, M = Medium Density Residential, VH = Very High Density Residential) On October October 7, 1996, F & P Bauducco Inc. filed an application to sell beer and wine "on- sale" (for consumption on- site) for the restaurant and "off- sale" (for consumption off -site) for the Italian market at the Bauducco's restaurant at 561 W. Los Angeles Avenue. State Assembly Bill No. 2897 amends sections 23958 and 23958.4 of the Business and Professions Code to provide that the Department of Alcoholic Beverage Control shall deny an application for a license, if issuance of that license would tend to create a law enforcement problem, or an undue concentration of licenses. The Department may issue a license if the City Council determines that public convenience or necessity would be served. Resolution No. 95 -1170, adopted on December 20, 1995 provides that the processing of applications for alcoholic beverage sales utilize the procedures used for Administrative Permits with the decision deferred to the City Council. Staff sent a notice of hearing on October 25, 1996 to all property owners within 300' of the subject site. At present the nearest establishments selling alcoholic beverages are located on Los Angeles Avenue: Albertson's market(300' off - site), AM -PM Mini Mart gas station (1,9001, off - site), Canton restaurant (1,8001, on- site), Coffee Grinder restaurant (1,8001, on- site), El Pollo Charro (1,0001, on- site), Expresso Italian Deli (7501, off - site), Hughes Market (1,6501, off - site), K -Mart (5001, off - site), Park Lane Liquor (9000, off - site), Shell gas station (8801, off - site), Round Table Pizza (1,1001, on- site), Thrifty's Drug Store (1,2501, off - site). t"117 ADP 96 -26 Bauducco's Page 3 Pursuant to Resolution No. 95 -1170, this proposal has been reviewed by the Director of Community Development and is deferred for action. The Police Department has indicated that they have no objections to approval of this permit. This project is Categorically Exempt from CEQA requirements as a Class 1 exemption, for the operation or alteration of private structures.
