Troche, Public Works Management Analyst 3 DATE: November 21, 19% (CC Meeting of December 4, 1996) SUBJECT: Consider a Project for the Construction of Landscape and Related Improvements Within the State Route 118 Freeway Right -of -Way Between Collins Drive and Princeton Avenue This requests that the City Council direct staff to prepare a Memorandum of Understanding (MOU) relative to the design, construction and maintenance of the subject project and approve a Resolution amending the budget in order to appropriate funds for this project. The City /State Freeway Agreement, pertaining to the Route 23 / Route 118 freeway connector project, as well as the Environmental impact Report for that project, required Caltrans to construct landscape improvements along said freeway. However, these improvements were never constructed due to State funding cutbacks. Staff, therefore, sought alternative funding sources to fund a portion of these landscape improvements. Staff and Ventura County Transportation Commission (VCTC) personnel prepared a grant application under the Transportation Enhancement Activities Program (TEA), one element of the Federal Intermodal Surface Transportation Efficiency Act (ISTEA). This grant program funds improvements `over and beyond' the scope of improvement normally required by transportation facilities. The scope of work requested in the City's application went beyond the landscaping work originally anticipated by the Caltrans landscape project by requiring additional trees and a City Entry Monument sign at the Collins Drive westbound off -ramp. Rte. 118 Landscaping Project Page 2 On November 1, 1995, the City Council approved Resolution No. 95 -1152 (Exhibit `A') authorizing staff to submit said grant application. The City's grant application proposes to construct an entry statement by constructing a `Welcome to Moorpark' monument sign. As shown on Exhibit `B', the illuminated monument sign would be installed in area #1. Landscaping would be installed along areas #146. If surplus grant funds are available, the landscaping will be expanded to encompass areas #7412. Staff will continue to work with VCTC and Caltrans to seek funding for the remainder of the landscaping required by the Caltrans' freeway connector project. A. Transportation Enhancement Activities Program (TEA) Grant Application As expressed in the attached letter (Exhibit `C'), the City's grant application was approved. The amount approved is $300,000. The City is required to meet the minimum local match of 11.5 % ($34,500) for the project. As shown below, the estimated total project cost is $334,500. ()71 Rte. 118 Landscaping Project Page 3 B. Implementation Plan Should City Council determine that the landscaping project is warranted, staff recommends proceeding with the following steps: 1. Memorandum of Understanding (MOU): Direct staff to prepare a draft MOU between the City and Caltrans identifying and agreeing to the responsibilities between both parties prior to the commencement of the conceptual landscape design. During a recent meeting with Bill Koval, Caltrans District Landscape Architect, Mr. Koval advised staff that upon completion and acceptance of the project by the City, the City's construction contractor will be responsible for maintaining the area for the first year. Mr. Koval further informed staff that after this period is completed, landscape maintenance will be the responsibility of the City for the following three years. Caltrans would commence maintenance of these improvements beginning the fifth year. The draft MOU, to be prepared by staff, will request that Caltrans be responsible for landscape maintenance after the first year. City Council will be kept informed of the anticipated MOU negotiations between staff and Caltrans. 2. Conccgptual i aandsc= DesiglL Once the MOU is approved by both the City and Caltrans, staff will seek proposals and recommend to City Council selection of a landscape architect to design the subject project. It should be noted that Mr. Koval advised staff that cities who have requested the placement of a monument sign within Caltrans right -of -way have always been denied due to liability exposure. Staff will explore any means possible to set precedence and have the `Welcome to Moorpark' sign approved so that we may comply with the grant requirements. City Council will be kept abreast of any decisions made by Caltrans. cmo7z Rte. 118 Landscaping Project Page 4 C. Fiscal Impact During preparation of the Fiscal Year 1996/1997 Budget, an allocation for said project was not made. Staff recommends City Council defer appropriation until the MOU is approved. At that time, staff will recommend to City Council that $334,500 be appropriated from the Gas Tax Fund as an advance for this project. Subsequent to construction, grant monies will be received and deposited back into the Gas Tax Fund. OoiUO73 ■ Exhibit A (page 1 of 2) RESOLUTION NO. 95 . - 1152 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM UNDER THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991 FOR THE ENTRYWAY PROJECT WHEREAS, the United States Congress has enacted the Intermodal Surface Transportation Efficiency Act of 1991, which is intended to provide over $200 million in federal dollars over a 6 year period as matching funds to local state and federal agencies and nonprofit entities for transportation enhancement activities; and WHEREAS, the Department of Transportation has established the procedures and criteria for reviewing proposals and is required to submit to the California Transportation Commission a list of recommended projects from which the recipients will be selected; and, WHEREAS, said procedures and criteria established by the California Department of Transportation resolution certifying the approval of application by the applicants governing body before submission of said application to the California Transportation Commission and the State of California; and WHEREAS, the application contains assurances that the applicant must comply with; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the transportation enhancement activities project; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND AUTHORIZE AS FOLLOWS: SECTION 1. That the filing of an application for Transportation Enhancement Activities Program funds is hereby approved. SECTION 2. That in the event the grant is approved, the City hereby certifies that construction of the proposed improvements will not commence prior to review and certification from Caltrans stating that the future operation and maintenance of said improvem nt wiL� be rov' d by Caltrans. The CTC only allocated funds to VCTC's top two priority projects. These projects were the landscaping along Route 118 in Moorpark and the pedestrian and other improvements around the Santa Paula Depot. Unfortunately, the projects in the Ojai Valley, Fillmore, San Buenaventura and Rancho Camulos were not allocated funding. Those agencies which received funds should begin coordinating with Caltrans' Office of Local Assistance to begin the process of obligating and spending the funds. For those agencies which did not receive funds, VCTC staff will retain your project information and you will be notified if there is another opportunity to seek TEA funds in the future.
