Lindley, Assistant to the City Manager � 4-Z _ DATE: November 21, 1996 (CC Meeting of December 4) SUBJECT: Consider Day Laborer Ad Hoc Committee Recommendations Executive Summary 3 The City ouncil is being asked to consider and approve recommendations from the Da �bor Y g PP Ad Hoc Committee (Councilmembers Brown and Perez) regarding the day laborers who gather each morning at the southwest corner of High Street and Spring Road. The recommendations include the creation and distribution of a flyer informing both the laborers and employees about the City's Solicitation Ordinance No. 218 and to encourage the property owner to take actions available to him to manage the situation. Background On July 2, 1996, the City Council approved Ordinance No. 218, regarding the solicitation of work in pubic right -of -way and on private property. At that time, the Council directed the Ad Hoc Committee to meet with the property owner of Tipsy Fox to get a better understanding of his concerns, to determine his willingness to assist in addressing any problems, and to identify possible actions that could be taken to address concern expressed by residents and the downtown business community. In addition to meeting with the property owner, Mr. Abdul, on September 24 the Ad Hoc Committee held a public forum to provide the public with an opportunity to offer suggestions regarding the situation at Tipsy Fox. Approximately 16 people attended the public forum. The meeting notes have been provided with this staff report as Attachment A. Following the public forum, staff was contacted by Mr. Abdul for information about sections of the California Vehicle Code which allow private property owners to tow vehicles whose driver is in violation of any parking restrictions. Based on the conversation with Mr. Abdul, staff believes that he is prepared to take certain steps to attempt to manage the situation. C ADOCS \wPDUCS\DAYLB.AGI 0t)1U.1:"Z(j Day Laborer Ad Hoc Committee Report November 25, 1996 2 In addition to the aforementioned actions, the Committee has also discussed and considered alternative gathering sites including City Hall, a location on Spring Road and one on Old Los Angeles Avenue under the 23 Freeway overpass. Gaining the day laborers' cooperation to voluntarily relocate is essential if such action is to succeed. The Committee also explored the possibility of the Employment Development Department (EDD) opening a part-time office in Moorpark to assist the laborer secure work. To date, the EDD has not indicated that it is able to expend service into Moorpark. At its last meeting on November 15, the Day Laborer Ad Hoc Committee identified the following recommendations based on the members' individual and joint discussions with Mr. Adbul, input from the public forum, discussions with representatives from other agencies, and status information provided by staff: Develop and distribute a flyer, in both English and Spanish, that summarizes the City's Solicitation Ordinance. Include a statement that violators will be prosecuted. Persons who participated in the public forum indicated that they would be willing to assist with the distribution of the flyers. 2. Continue to encourage the property owner to take the steps available to him to manage the situation on his property. This includes enforcing any parking restrictions he may impose. Recommendation The Day Laborer Ad Hoc Committee and staff recommend that the City Council approve the recommendation to develop a distribute a flyer that summarizes the City's Solicitation Ordinance and continue to encourage the property owner to take steps available to him to manage the behavior of the day laborers who gather on his property.
