SUBJECT: Consider Bids for the Construction of a Bicycle / Pedestrian / Equestrian /
Emergency Access Bridge Across the Arroyo Simi at Liberty Bell Road.
This presents the results of the bid opening for the subject project and recommends the award
of a contract for the construction of the project.

On October 16, 1996, the City Council audwrired staff to advertise for receipt of bids for
the subject project. A summary of the steps which lead to that action are set forth in
Exhibit 1.
A summary of the bridge design is as follows:
1. Locadon: The location and alignment of the proposed bridge is depicted on the maps
and diagram attached as Exhibit 2.
2. Alignment:
• macular to the channel to allow for a shorter span which will not require
center support piers;
• North end of the bridge located just east of Liberty Bell Road.

support piers (161').

4. Width: Fifteen feet (15') clear -- seventeen feet (17') edge to edge.
5. Type of Coastaction: Cast in place, reinforced concrete, box girder construction.
6. Bridge Rail & Fence: Six feet (6') high 2" x 2" tubular steel posts spaced one foot
(i') apart, with chain link fabric, installed on a one foot (1') high concrete curb.
7. Deck Surface: Concrete with a rough broom finish.
8. Parking Lot: Project to include the construction of a puling lot just east of Liberty
Bell Road, to serve those using the bridge as well as patrons of the future Campesina
Park.
9. Vegetation: Several of the existing trees on the north and south sides of the Arroyo
will be removed. As required by the Mitigated Negative Decimation for the project,
certain landscaping will be installed adjacent to this facility. This work is not a part of
the subject project. Lmg will be installed labor under a separate contract.
10. Erosion Control: As mentioned in the Mitigated Negative Declaration for the project,
the plans and specifications require the contractor to eke certain measures to
eliminate or minimize soil erosion during the construction of the project.
11. Electrical:': The contract documents include plans and specification prepared by an
electrical engineer retained by the City, for the installation of an electrical service,
conduit and lighting in the vicinity of the bridge.
12. Irrigation Water: The contract documents include plans and specifications prepared
by a landscape architect retied by the City, for the installation of an irrigation water
line to extend from the existing irrigation system for Arroyo Vista Community Park,
across the bridge to a point just north of the bridge. This now system will provide well
water from Arroyo Vista Community Park to the landscaping which will be planted in
the areas adjacent to the bridge. This water source will be available to the serve
Campesina Park. It will also be available to be extended northerly to serve other City
owned and maintained landscaping.
1. Cabrillo: The City Council has approved a Certificate of Acceptance for an Easement
Deed from Cabrillo Economic Deveb11 Copmation to the City for certain property
required for the project. In a related metier, staff forwarded a Deed from Cabrillo to
the Ventkira County Flood Control District (VCFCD) for easements required for the
levee maintenance road on the north side of the Arroyo.

2. VCFCD: The City Council also approved a Certificate of Acceptance for an Easement
Deed from the Ventura County Flood Control Dftxt (VCFCD) to allow the
construction and use of the subject bridge across the Arroyo Simi.
3. SCE: Easements are required across property owned by the Soudwrn California Edison
Company (SCE). One easement is required for the construction of the bridge abutment
on the south side of the Arroyo and to allow access between the brings and the Arroyo
Vista Community Park. Other easements (to be granted to VCFCD) are required for
the levee maintenance road on the south side of the Arroyo. The City has initiated an
eminent domain action to acquire these easements.

When the City condemns property, it normally cannot take possession until there is a final
Judgement in the case. The final judged does not occur until the value of the property
has been established at trial. It can take several months for the case to go to trial.
In the meantime, the City can take possession of the property if it deposits the amount of
its appraisal with the court and receives a court order for early possession- When an order
of early possession is issued, the City can take possession of the property ninety (90) days
after the order is served on the property owner and any occupant. However, the property
owner can have the cyder stayed on the ground that possession by the City will not be
compatible with the owner's use of its surrounding property. In such a case, the City's
possession of the property is delayed until the court hues teases and condifions that are
intended to make the City's possession compatible with the property owner's use. The delay
can be several weeks or more, depending upon how soon the court hears and decides the
"compatible use" dispute.
In this case, SCE, the property owner, and Performance Nursery, the occupant, have both
indicated a willingness to allow the City to take possession as of January 1, 1997, rather
than on a regular ninety (90) day order, as long as the City agrees up from to certain terms
and conditions. An agreement with SCE is not only essential to possession on January 1,
1997, it would be essential for possession even upon a ninety (90) day order. SCE has
indicated that it would seek to stay a ninety (90) day order, absent terms and conditions that
it finds acceptable. Thus, City staff and the City Aftwney have been working with both
SCE and its tenant on the development of a set of terms and conditions required by them
prior to agreeing to the waiver of the ninety (90) day period. Filing the case prior to
reaching such an agreement would not facilitate early possession by the City, but could
hinder it.

As of the writing of this report, those agrees were being finalized and the City Attorney
was prepeft to file the con action with the court. Staff is hopeful that the City
will receive a court Order for early possession within the next few days or weeks.
The bid documents allow the City ninety (90) days from the date of the bid opening (March
11, 1997) to award a contract. Once the coaab*d is awarded, a Notice to Proceed with
construction will be issued as soon as all of the contract documents are executed and
necessary bonds and nwArance cextifkates are received. Normally a Notice to Proceed is
issued ten (10) to thirty (30) days after the award of contract.
The City will not be in a position to issue a Notice to Proceed until after the City has
acquired access to all of the required easements. As stated above, the City may only receive
early possession of the easements with a court order. It is recommended, therefore, that a
construction contract for the subject project NOT be awarded prior to the City's receipt of
that court order.
Bids for the subject project were received and opened on December 11, 1946. A tabulation
of the bid results is attached as Exhthit 1. A summary of the bid results is as follows:

The Engineer's Estimate of probable conow ion cost for this project was $360,000. The
amount lied for the Engineer's Estimate in the bid wry (Exhibit 3) is 5419,931. The
engineer's estimate has been revised further to $550,000. A summary of the reasons for
these changes is as follows:

2. Budget Amendment: It is recommended that the FY 1996 /97 Budget be amended to
provide suffices funding for this project. Consistent with prior actions of the City
Council, it is recommended that the finding sources be as follows:

• 2/3: Los Angeles Avenue AOC.
A resolution (Exhibit 4) has been prepared to increased the appropriation and budget
amount for the project and to revised the current budget spud to the one -third / two-

If on the date the City Council considers this action, the City has been granted a Court Order
for early possession of the Easemmis bemg accred f m the Southern Calif mm Edison
Company, staff recommends that the City Council take the following actions:
1. Adopt Resolution 96 - approving a budget amaWment to increase the appropriation and
budget amounts for the subject project as follows:
• Los Angeles Avenue Area of Contribution Find (Account No.
211.901.8002.000.9903) from $300,000 to $440,000 ($140,000 increase);
• Spring Road Tierra Rejuk Road Area of Coition Fund (Account No.
211.900.8002.000.9903) from $200,000 to $220,000 ($20,000 increase).
2. Award a contract to Q shwboger Co=&ucdm Corporafim in the amount of
$507,894.00 for the construction of the subject project.
3. Approve a construction contingency in the amount of $52,106 for the project and
authorize the City Manager to approve additional work, if required, for an amount not
to exceed ten per cent of the contract;
4. Authorize the City Manager to sign necessary contract documents.
Note: If on the date the City Comwil considers the above action, the City has =

Exhibit 1: Baekground
The following is a summary of the tasks required to develop and implement a project to constrict
a Pedestrian bridge across the Arroyo Simi:

Sept. 1985 PD -1010 (Palmer) approved for the coast tim of the U Club
Apartments. One Condition of Approval provided for the construction of
the Ped bridge.
May 1987 City & Palmer enter into a Settleamet Agreement. One paint in said
agreement clarified the developer's responsibility regarding the bridge.
Sept. 1992 City & Palmer approve a Revision to the Aunt whereby the City
agues to take over the raespomability for the design and construction of
the bridge, to be funded by the developer.
April 1993 City Council approves the selection of the design Engineer (VCE).
July 1993 City Council approves the alignment and the conceptual design for the
bridge.
Sept. 1994 City Council approves the final design concept.
July 1995 Final design completed.
Aug. 1995 City and County meet with residents of the Camillo neighborhood to
discuss the impact of the VCFCD channel widening proect on the design
for Campesina Park. Possible revisions to the channel widening project
could have required a change to the design for the bridge and easements
to be acquired from SCE.
Sept. 1995 City Council approves the acquisition of easements from Cabrillo and
from the VCFCD.
Feb. 1996 Revised alignment of the VCFCD channel widening project (Re:
Campesina Park) was provided to the City Council.
March 1996 City initiates efforts to obtain an aPpraisai report for the easements
required from the Southern California Edison Company (SCE).
April 1996 City Council approves the Conditional Negative Declaration for the
project.
June 1996 City retains Appraisal Firm.
Sep. 24, 1996 Appraisal received by City.
Oct. 9, 1996 City Council approves the appraisal, determines the fmmfr market value of
the property and directs staff to make an offer to SCE for the acquisition;
of the property.

A RE90LUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, AUTHORIZING A
BUDGET A MOMENT TO THE FISCAL YEAR 19960197
ADOPTED BUDGET FOR THE LOS APIGEL 3S AVENUE
AREA OF CONTRMUTION ACCOUNT (ACCOUNT
NUMBER 211.901) AND THE TIERRA REIADA / SPRING
ROAD AREA OF CONTRIBUTION ACCOUNT (ACCOUNT
NUMBER 211.900)
WHEREAS, on June 19, 1996, the City Council adopted the Budget for Fiscal Year
1996/97; and,
WHEREAS, said budget included the funding of a project to construct a Pedestrian /
Equestrian / Bicycle Emergency Access Bridge across the Arroyo Sine in the vicinity of Liberty
Bell Road; and,
WHEREAS, a staff report has been tented to the City Council requesting an increase in
the funding for that project in the aggregate amount of $ 160,000; and,
WHEREAS, Exhibit "A," attached hereto and made a part hereof, describes said budget
amendment and its resultant impacts to the budget line item(s) and projected year end fund
balance(s).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That a Budget amendment in the amount of $160,000 to Accounts 211.900
and 211. 901, as more particularly described in Exhibit "A, " is hereby approved.
PASSED AND ADOPTED this 18th day of December, 1996.
