MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Brian Chong, Assistant to the City Manager DATE: May 23, 2018 (CC Meeting of 6/6/2018) SUBJECT: Public Hearing to Consider a Resolution Establishing New Maximum Solid Waste Rates to Be Effective July 1, 2018, and Rescinding Resolution No. 2009-2873 BACKGROUND Moorpark Municipal Code Section 8.36.350 grants the City Council the authority to establish, by resolution, a ceiling on the charges a solid waste franchisee may charge for solid waste services at the conclusion of a public hearing. The City Council is considering a new Solid Waste Franchise Agreement with USA Waste of California, Inc. (USA Waste) as a separate agenda item. The new Franchise Agreement contains new maximum solid waste rates that may be charged by USA Waste for solid waste services within the City limits, reflective of the service levels contained in the Agreement. Because of the close relationship between this agenda item and consideration of a new Solid Waste Franchise Agreement with USA Waste, it is recommended that the City Council consider these two items concurrently. DISCUSSION The City’s current maximum solid waste fees have been in place since January 1, 2011, and have not changed since, as the City’s solid waste franchisees agreed to voluntarily defer rate increases guaranteed by the City’s current Solid Waste Franchise Agreements until a new Agreement was negotiated. The City Council is now considering a new Solid Waste Franchise Agreement with USA Waste as a separate agenda item, which proposes new maximum solid waste rates based on the services to be provided by the franchisee. Pursuant to Moorpark Municipal Code Section 8.36.350, the City Council may only approve new maximum solid waste rates at the conclusion of a public hearing. Item: 8.C. 209 Based on a Memorandum of Understanding (MOU) entered into by the City and GI Industries (the predecessor to USA Waste) on December 6, 2017, the City Council has the option of phasing in the 2018 rate increases over two years (with half to become effective on July 1, 2018, and the other half to become effective on January 1, 2019). However, it would be unreasonable to require USA Waste to start incurring the full expenses required by the new Solid Waste Franchise Agreement without being able to fully collect revenue to pay for those expenses. Accordingly, the MOU includes language that, if the City opts to phase in the rate increases, then various fees and reimbursements paid by the franchisee to the City will be adjusted downward correspondingly. While the precise financial impact of phasing in rates is difficult to calculate due to the number of variables involved, staff estimates that phasing in the rate increases would result in approximately $125,000 in foregone revenue for the City. A full analysis and discussion of the proposed maximum solid waste rates, and the option of phasing in the rates, are included in the staff report for the new Solid Waste Franchise Agreement. There are two potential Resolutions attached to this staff report for the City Council’s consideration. Staff recommends that the City Council not phase in the new maximum solid waste rates and adopt the resolution provided as Attachment 1. If the City Council opts to phase in the new rates, the City Council should adopt the resolution provided as Attachment 2. 210 FISCAL IMPACT If the City Council adopts the resolution provided as Attachment 1 (without phasing), the increased rates will increase the City’s franchise fee revenues (to the General Fund) and AB 939 fee revenues (to the Solid Waste Fund) by approximately $110,000 per year, with small annual increases expected as rates increase during the term of the proposed Franchise Agreement. Additionally, portions of the Franchise Agreement, not related to the proposed rates, will provide $220,000 in one-time revenue to the City and ongoing annual revenues of $285,000 per year. If the City Council adopts the resolution provided as Attachment 2 (with phasing), then approximately $125,000 in these revenues will be forgone by the City. The fiscal impact of new maximum solid waste rates is discussed in further detail in the staff report for the new Solid Waste Franchise Agreement. STAFF RECOMMENDATION ROLL CALL VOTE 1. Attachment 1: Resolution Adopting New Maximum Rates (No Phasing) Attachment 2: Resolution Adopting New Maximum Rates (Phasing) 211 RESOLUTION NO. 2018-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING THE SOLID WASTE COLLECTION SERVICE FEE SCHEDULE AND RESCINDING RESOLUTION NO. 2009-2873 WHEREAS, the City provides residential and commercial solid waste and recycling collection services; and WHEREAS, on June 6, 2018, the City Council granted an exclusive franchise agreement to USA Waste of California, Inc., a subsidiary of Waste Management Holdings, Inc., for the collection, transportation, recycling, and disposal of solid waste within the City limits; and WHEREAS, the franchise agreement establishes new maximum rates for solid waste services; and WHEREAS, Moorpark Municipal Code Section 8.36.350 grants the City Council the authority to establish, by resolution, a ceiling on the amounts of charges a franchisee may charge for solid waste at the conclusion of a public hearing; and WHEREAS, the City Council conducted a public hearing to consider a resolution establishing a ceiling on the amounts of charges a franchisee may charge for solid waste on June 6, 2018; and WHEREAS, the City Council declares its intention of maintaining reasonable rates for collection, management, and disposal of solid waste and recyclables within the City limits. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Effective July 1, 2018, the maximum solid waste service rates that may be charged by a franchisee shall be as shown in Exhibit 1. SECTION 2. The annual Self-haul Exemption Permit Fee shall continue to be $60.00 for the initial application for an annual Self-haul Exemption Permit and $30.00 for an annual Self-haul Exemption Permit renewal. Residents who qualify as seniors, age sixty-two (62) or older, receive a twenty percent (20%) discount on both the initial application for an annual Self-Haul Exemption Permit and the renewal fees. SECTION 3. This resolution shall be effective July 1, 2018. SECTION 4. Resolution No. 2009-2873 is hereby rescinded in its entirety upon the effective date of this resolution. 212 SECTION 5. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Contamination Fee ...................................................... $100.00 218 RESOLUTION NO. 2018-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, UPDATING THE SOLID WASTE COLLECTION SERVICE FEE SCHEDULE AND RESCINDING RESOLUTION NO. 2009-2873 WHEREAS, the City provides residential and commercial solid waste and recycling collection services; and WHEREAS, on June 6, 2018, the City Council granted an exclusive franchise agreement to USA Waste of California, Inc., a subsidiary of Waste Management Holdings, Inc., for the collection, transportation, recycling, and disposal of solid waste within the City limits; and WHEREAS, the franchise agreement establishes new maximum rates for solid waste services; and WHEREAS, Moorpark Municipal Code Section 8.36.350 grants the City Council the authority to establish, by resolution, a ceiling on the amounts of charges a franchisee may charge for solid waste at the conclusion of a public hearing; and WHEREAS, the City Council conducted a public hearing to consider a resolution establishing a ceiling on the amounts of charges a franchisee may charge for solid waste on June 6, 2018; and WHEREAS, the City Council declares its intention of maintaining reasonable rates for collection, management, and disposal of solid waste and recyclables within the City limits; and WHEREAS, the City Council desires to phase in rate increases such that half of the 2018 rate increases for recurring monthly residential and commercial service rates become effective on July 1, 2018, and the remaining half of the 2018 rate increases for recurring monthly residential and commercial service rates become effective on January 1, 2019, before applying any rate escalators that become effective the same date; and WHEREAS, on December 6, 2018, the City and GI Industries entered into a Memorandum of Understanding agreeing that, if the City exercises its option to phase in the new solid waste rates, then payments from the franchisee would make to the City would be adjusted downward to place the franchisee in the substantially same financial position it would have occupied in the event the City had not exercised its option to phase in the rate increases. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: 219 SECTION 1. Effective July 1, 2018, the maximum solid waste service rates that may be charged by a franchisee shall be as shown in Exhibit 1. SECTION 2. Effective January 1, 2019, new maximum solid waste service rates that may be charged by a franchisee shall be calculated by applying the rate escalators described in Section 5.3 of the franchise agreement between the City and USA Waste of California, Inc. to the maximum rates as shown in Exhibit 2. SECTION 3.
