MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Jeremy Laurentowski, Parks and Recreation Director By: Jessica Sandifer, Community Services Manager DATE: May 22, 2018 (CC Meeting of 06/06/18) SUBJECT: Consider Resolution Authorizing Acceptance of Landscape Maintenance Improvements in Landscape Maintenance District 21 (Canterbury Lane & Ivy Lane) BACKGROUND & DISCUSSION Shea Homes is the developer of Tract 5133 (Canterbury Lane) and Tract 5425 (Ivy Lane). The conditions of approval for both Tracts required the developer to construct certain landscaping improvements within and/or adjacent to the Tracts. The conditions of approval also required that an assessment district be formed to fund City maintenance costs for these improvements. In June 2006, Landscaping and Lighting Maintenance Assessment District 06-01 (AD 06-01) was formed to fund the City maintenance costs for the landscape improvements installed by Shea within the Canterbury Lane development. In October 2013, Tract 5425 was annexed into AD 06-01 to provide funding for maintenance of the landscape improvements within that tract. In 2015, Shea Homes requested turnover of the Landscape Maintenance District (LMD) areas. City staff performed a series of inspections and on May 1, 2015 City staff prepared a letter of substantial compliance with the City approved landscape architecture plans and specifications for both developments. The City’s Landscape Standards and Guidelines require the developer to maintain the landscaping for one full year after notification of substantial compliance. However, during the one-year maintenance period, City staff became aware of the fact that some of the irrigation equipment was installed within HOA property and that an easement would be required prior to City acceptance. In October 2017, the Canterbury Lane Homeowner’s Association (HOA) granted the City an easement over HOA land which allows the City to perform its maintenance obligations. Item: 10.I. 723 Due to the time that elapsed between the recordation of the easement and end of the one-year maintenance period, staff initiated another series of field inspections and punch lists related to the landscaping for both the Ivy Lane and Canterbury Lane projects. Staff believes that the landscape improvements are acceptable as installed and recommends that the City assume the maintenance obligations. In order to begin maintaining the property, the City Council needs to accept the landscape improvements as complete. FISCAL IMPACT AD 06-01 will provide funding for the maintenance of the landscape improvements and is fully funded. There are sufficient resources to cover the landscape maintenance expenses. STAFF RECOMMENDATION Adopt Resolution No. 2018-________, accepting landscape improvements in Tract 5133 and Tract 5425 as complete and authorize the City to assume maintenance responsibilities effective July 1, 2018. Attachment – Resolution No. 2018-__________ 724 RESOLUTION NO. 2018- ____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ACCEPTING LANDSCAPE IMPROVEMENTS IN LANDSCAPE MAINTENANCE DISTRICT 21 (ASSESSMENT DISTRICT 06-01) MADE BY SHEA HOMES AS COMPLETE WHEREAS, the City Council approved Residential Planned Development (RPD) 98-01 and Tract 5133 and Residential Planned Development 2003-02 and Tract 5425 which allowed Shea Homes to construct two housing projects within the City of Moorpark; and WHEREAS, the conditions of approval of RPD 98-01 and RPD 2003-02 required construction of certain landscaping improvements within the tracts and formation of assessment districts within the tracts to fund the costs of City maintenance of these landscape improvements at such time as the maintenance is taken over by the City; and WHEREAS, Shea Homes has completed all of the required landscape improvements and the City has determined it is now appropriate for the City to take over the maintenance obligations; and WHEREAS, in order to take over the maintenance obligations, the City Council must accept the improvements as complete. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City of Moorpark hereby accepts the landscape improvements as complete pursuant to RPD 98-01 and RPD 2003-02 and authorizes the City to assume the responsibility to maintain such improvements, effective July 1, 2018. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
