SUBJECT: Consider City Sign Agreement by and between NLA 14339, LLC and
the City of Moorpark and City Welcome Sign Design for Property at
14339 White Sage Road
BACKGROUND/DISCUSSION
On July 19, 2017, the City Council adopted Resolution No. 2017-3614, approving
Modification No. 2 to Commercial Planned Development Permit No. 2004-03 and
Conditional Use Permit No. 2016-05 for a 48-foot high wireless communication tower at
14339 White Sage Road. One of the conditions of approval was as follows:
Prior to issuance of a building permit for the wireless communications facility, the
property owner and City shall enter into an agreement to provide City Welcome signage
on the tower at the applicant’s expense including perpetual maintenance, with a design,
materials, colors, and illumination to be reviewed and approved by the City Council.
Any future change to the City Welcome signage would require City Council approval.
City Welcome Sign Agreement
The City Attorney’s Office had drafted an agreement between the City and Property
Owner (attached) that ensures that the City Welcome signage would be constructed
and installed at the expense of the owner (NLA 14339 LLC) or tenant (Verizon Wireless)
on the top of three sides of the tower (not on the side facing the building), and that the
tower structure would be constructed in compliance with Building Code, as most
recently amended for telecommunication towers. The City Welcome signage would be
maintained by the owner or tenant for the life of the tower; however, the City would have
the right to update the signage every 5 years at City expense. This agreement was
approved by the City Council on December 6, 2017. It included a requirement to have
the current lender on the property subordinate its Deed of Trust to this agreement so
that if there is a foreclosure on the Deed of Trust, the Agreement is not wiped out.

After the December 6, 2017 approval by the City Council, the lender would not agree to
subordinate their loan to the sign agreement. Without the subordination, the City would
still be able enforce the conditions of the permit, including the sign agreement, through
code compliance efforts, even through foreclosure, as the conditions run with the use.
Staff believes that this is sufficient without having the lender subordinate its Deed of
Trust to this agreement. The City Attorney’s Office amended the agreement
(Attachment 1) to remove the requirement for lender subordination.
City Welcome Sign Design
When the proposed telecommunications tower was presented to the City Council on
July 19, 2017, representatives from Verizon told the City Council that the City Welcome
Sign could be internally illuminated like the rest of the signage on the tower, using black
halo reverse lit channel letters. Verizon later informed staff that illumination in front of
the antenna panels would cause interference with the signals. Verizon did indicate that
spotlights illuminating the signage on the upper part of the sign tower would not cause
undue interference. The current proposal calls for one LED spotlight located on a
gooseneck at the top center of the cornice just below the upper tower element on each
of the three sides where a City Welcome Sign would be located. Attachment No. 2
shows the location of the spotlights. Staff believes that the spotlighting would effectively
illuminate the City Welcome Sign. The draft sign agreement provides for Community
Development Director review and approval of the spotlighting.
City staff has continued to work with the applicant’s sign contractor on developing the
proposed wording and design for the City Welcome Sign. The proposed sign is shown
in the attached draft Sign Agreement and would incorporate the City’s tag line, with the
top line reading, “Moorpark,” and the lower line reading, “Life can be this good,” in black
script. The “Moorpark” letters would be 17” high and the “Life can be this good” letters
would be 9” high. Individual channel letters would be used and would be 4” thick for the
top line and 2” thick for the lower line. The scale of the City’s sign is consistent with
other signs on the tower and could be read easily at freeway speeds.
STAFF RECOMMENDATION
Approve City Welcome Sign design, and approve City Sign Agreement subject to final
language approval by the City Manager and City Attorney.
