Article 3 Purposes
BACKGROUND
On August 21, 2017, the City submitted an application to the Ventura County
Transportation Commission (VCTC) for $531,180 in Transportation Development Act
(TDA) Article 3 Bicycle/Pedestrian Project Funds, with a local match of $68,820. The
grant was to develop plans and estimates from schematic to design development stage
for sidewalks and bikeways on Collins Drive between Campus Park Drive and Arroyo
Drive and the railroad crossing along Arroyo Drive. As City Council may recall, the City
has already been awarded $200,000 in TDA Article 3 funding to construct a sidewalk
along the south side of Arroyo Drive, from the east side of the railroad crossing to the
Simi Valley city limit line.
DISCUSSION
Pursuant to California PUC Section 99233.3, a portion of the available TDA Local
Transportation Funds each year must be used for planning, maintaining, and
constructing facilities for the exclusive use of pedestrians and bicyclists. Beginning in
FY 2017/18, VCTC implemented a two-year (FY 2017/18 and FY 2018/19) combined
call for projects for both TDA Article 3 and Congestion Mitigation and Air Quality
(CMAQ) funding. The concept was to enable applicants to submit larger and potentially
more regionally-focused grant applications.
Twenty-one applications were submitted by seven agencies (including the City). The
City’s project scored second and was recommended for full funding at the October 6,
2017 VCTC meeting, using FY 2018/19 TDA Article 3 funds. The City must submit a

Resolution (Attachment 1) and a TDA Article 3 Claim Form (Attachment 3). Upon
submittal of the documents, VCTC will send the grant payment to the City.
FISCAL IMPACT
The City is expected to receive $531,180 in TDA Article 3 funding in FY 2018/19. The
FY 2018/19 Draft Budget reflects both revenue (revenue line 2411.000.00000.46200)
and expense (expense line 2411.311.C0037.55300). Expense line
2001.311.C0037.55300 also includes the City’s local match requirement of $68,820.
The reimbursement percentage is 11.47%, which means that each time the City pays
for an eligible expense, payment should be split with 88.53% funded with TDA Article 3
and 11.47% funded with Traffic System Management Fund (2001).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AUTHORIZING THE FILING OF A CLAIM
WITH THE VENTURA COUNTY TRANSPORTATION COMMISSION
FOR ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT
FUNDS FOR BICYCLE AND/OR PEDESTRIAN ARTICLE 3 PURPOSES
FOR FISCAL YEAR 2018-2019
WHEREAS, the State Transportation Development Act (TDA), as amended
(Public Utilities Code Section 99200 et seq.), provides for the allocation of funds from
the Local Transportation Fund (LTF) for use by eligible claimants for various
transportation purposes; and
WHEREAS, the TDA was specifically amended in 1973 to include funding under
PUC Section 99234 for planning of and/or projects for the exclusive use by bicyclists
and/or pedestrians; and
WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to
the applicable rules and regulations hereunder (Cal. Code of Regulations Sections 6600
et seq.), a prospective claimant wishing to receive an allocation from the LTF shall file
its claim with the Ventura County Transportation Commission (VCTC).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the City Manager and or his designee is authorized to execute
and file an appropriate claim pursuant to the applicable rules and regulations
promulgated hereunder, together with all necessary supporting documents, with the
VCTC for an allocation of LTF Article 3 funds in FY 2018/19.
SECTION 2. That the City’s authorized claim includes $531,180 under TDA
Article 3 for local bicyclist and/or pedestrian project expenditures.
SECTION 3. That the City Clerk is directed to transmit a copy of this resolution to
VCTC.
SECTION 4. That the City Clerk shall certify to the adoption of the resolution and
shall cause a certified resolution to be filed in the book of original resolutions.

County Transportation Commission is subject to such monies being on hand and available for

accordance with applicable State regulations. Claimant will track and spend the TDA funds in
proportion to local match as approved by the Commission and the will accrue interest on
unused TDA funds.
90-DAY ANNUAL REPORT . Claimant certifies that it has submitted a State
Controller’s report in conformance with the uniform system of accounts and reports, to
VCTC and to the State Controller, pursuant to PUC 99245, for the prior year
(2017/18). Claimant assures that this report will be completed for the current fiscal
year (2018/19).
