SUBJECT: Consider Response to Final Report of the Ventura County Grand Jury Annual
Detention Report.
BACKGROUND / DISCUSSION
On May 24, 2018, the Ventura County Grand Jury provided the City Council and City Manager with
a Final Report of its investigation entitled, “Annual Detention Report.” The Grand Jury noted that
the Moorpark Police Department did not have a current Fire-Life Safety Inspection certificate and
recommended that the Moorpark Police Department obtain a current certificate and schedule
biennial inspections. The Grand Jury also recommended that all local police departments
(including Moorpark PD) incorporate PREA standards (Prison Rape Elimination Act) into their
policy and procedure manuals.
The Fire-Life Inspection Certificate was completed on 06/08/2018 and biennial inspection dates
have been added to our calendar. A copy of the Fire-Life Safety Inspection is on file at Moorpark
PD. PREA is not a state requirement and has not been fully implemented in Sheriffs’ Facilities.
The Grand Jury report has required a response from the City Council on the findings and
recommendations within 60 days of receiving the report. A form was provided for the response.
The attached draft response is for City Council consideration.
FISCAL IMPACT
There is no fiscal impact associated with providing a response to the Grand Jury or implementing
any of the recommendations provided in the report.
STAFF RECOMMENATION
Approve the draft response to the Grand Jury report findings and recommendations and authorize
the Mayor to sign and submit the response to the Presiding Judge of the Superior Court.

GRAND JURY FINDING C-18:
The Grand Jury concluded that it was unsatisfactory for safety and liability purposes that
seven out of 10 holding facilities did not have current fire life safety certifications
available for inspection. (FA-50)
CITY COUNCIL RESPONSE TO FINDING C-18
The Ventura County Sheriff’s Office (VCSO) is the contract law enforcement agency for
the City of Moorpark. On 06/08/2018, a Fire-Life Safety Inspection was conducted at
VCSO / Moorpark PD. Moorpark PD passed the inspection and a copy of the Fire-Life
Safety inspection is on file at Moorpark PD. A copy of the Fire-Safety certificate is
attached.
GRAND JURY FINDING R-07:
The Grand Jury recommends that all adult jails and holding facilities incorporate biennial
Fire-Life safety inspections into maintenance schedules. (C-18)
CITY COUNCIL RESPONSE TO FINDING R-07
The Ventura County Sheriff’s Office (VCSO) is the contract law enforcement agency for
the City of Moorpark. VCSO / Moorpark PD has agreed to incorporate biennial Fire-Life
Safety Inspections into our maintenance schedules. The next inspection will occur in
June of 2020.
GRAND JURY FINDING C-17:
The Grand Jury concluded the absence of PREA standards in the 10 city police
departments' policy and procedure manuals exposes the cities to potential liability. (FA-
51)
CITY COUNCIL RESPONSE TO FINDING C-17:
The Ventura County Sheriff’s Office (VCSO) is the contract law enforcement agency for
the City of Moorpark. The Ventura County Sheriff’s Office understands the seriousness
of sexual assaults and sexual harassment in our detention facilities. It is important to
note that there is a substantial difference between a holding area where an inmate may

spend several hours, and the jails which the Sheriff’s Office operates. The majority of
arrestees are held separately while in the Moorpark Police holding area; we immediately
initiate and conduct a thorough investigation into any reported offense. Although we are
not currently required to fully implement PREA, the Sheriff’s Office Detention Services
Division has a PREA policy that provides direction and serves as a resource for the
entire agency should an incident occur in a holding area within its jurisdiction.
