Kellerman, City Clerk DATE: June 12, 1990 (for Adjourned CC Meeting of 6/13) SUBJECT: APPOINTMENT TO VENTURA COUNTY AREA AGENCY ON AGING As per the attached Articles of the Ventura County Area Agency on Aging, each local Council on Aging elect a representative and an alternate to the Advisory Council. The local Council recommend the representative and alternate to the City Council and then the City Council can ratify or deny the recommendation. When ratified the representative and the alternate are seated on the Advisory Council; if denied, the election process is repeated. The local Council, at its regularly scheduled meeting of June 4, 1990, elected Dr. Everett Braun as representative and Lindsey Burola as alternate. Section 5 - The Area Agency on Aging shall provide staff assistance to the Advisory Council to assist in carrying out specified duties. ARTICLE V - ADVISORY COUNCIL. MEMBERSHIP Section 1 - A. Total membership on the Advisory Council shall be no less than 19 persons and shall reflect compliance with federal and state guidelines. B. Membership shall be selected through a process designated by the local governing bodies and the Planning and' Service Area within which the Area Agency on Aging operates. No more than fifty percent (SO$) of the Council's membership shall be appointed by one official or body of officials. C. Membership shall be composed of: 1. A majority of persons 64 years of age or older; 2. One service provider; 3. Members who reflect the geographic, racial, economic and social complexion of the Planning and Service Area they represent; 4. At least one disabled person to represent the interests of the disabled. D. Advisory Council composition requirements shall be complied with as vacancies occur. Section 2 - The process for membership selection to the Advisory Council shall be as follows: A. 1. Each local Council on Aging, at a regularly scheduled meeting of its membership, shall elect a representative and an alternate to the Advisory Council. 2. The local Council on Aging shall recommend the representative and alternate to the City Council. The City Council shad then ratify or deny the recommendation. 3. When ratified, the representative and the alternate shalt be seated on _ the Advisory Council. 4. If denied, the local Council on Aging shalt elect another representative /alternate using the same process. This process will seat ten Advisory Council members and ten alternates. R. 1. The Board of Supervisors will appoint six members and six alternates to the Advisory Council and in those appointments will ensure that the Agency requirements for minority and disabled representation are met. Supervisorial appointments will be made after ratification of members elected by the local Council on Aging. 2. This process will seat six Advisory Council members and Six alternates. C: 1. The Board of Supervisors will appoint two representatives and two alternates from the Unincorporated areas of the Planning and Service Area. 3. This process will seat two Advisory Council members and two alter- nates. 0. 1. The eighteen Advisory Council members thus seated will elect a Service Provider member and alternate by democratic process. 2. This process will seat one Advisory Council member and one alternate. ,41 Section 3 - Alternates shall have voting rights and be eligible for reimbursement whenever serving in the place of the regular member. Section 4 - Conflict of Interest. Neither- members nor alternates shall cast a vote on any matter which has a direct bearing on the services to be provided by that member or alternate or by the entity which that member or alternate represents on the Council. Section 5 Names and required information about Advisory Council members shall be submitted to the Ventura County Board of Supervisors for review to ensure compliance with federal and state mandates concerning composition of the Advisory Council. In the event of non - compliance for any reason, the Advisory Council shall identify the cause of the non - compliance and shall make recommendations to the appropriate sponsoring authorities to attempt to correct the non - compliance. The Area Agency on Aging shalt receive the recommendation, review it and adopt or ,alter the recommendation to achieve compliance. The Director of the Area Agency on Aging shall implement the action of the Board of Supervisors. Section 6 - The term of membership for individuals on Lhe Advisory Council shall be two years. No individual may serve more than four cOr,5eciitive years on the Advisory Council AA20a5 f but may serve again after at least a one -year absence. At the organizational meeting of the 1981 -82 Advisory Council, a drawing will be conducted to determine nine of the members to serve initial one -year terms and nine of the members to serve initial two --year terms. This is done to establish staggered terms of membership in the interest of continuity on the Advisory Council. The term of each alternate shall be the same as that of his /her corresponding member. Section 7 - Each member of The Advisory Council is entitled to one vote on each matter submitted to a vote of the Advisory Council. Proxy voting and absentee ballot voting is not permitted voting by alternates is permitted only when they are sitting as members. Section 8 - Responsibilities of members cl the Advisory Council: Members shall: A. Attend the duly called meetings of the Council; B. Read and study, in advance, all written material provided them in preparation for duly called meetings of the Council; C. Serve on at least one committee of I.-ie Council; D. Become knowledgeable about the problems and needs of the elderly; E. Become knowledgeable about the various service delivery systems which impact the elderly at the federal, sate and local levels; F. Have the dual responsibility to accurately report facts and conditions of their constituency to the Council as well as the actions of the Council to their constituency and the general -,uhlic, Section 9 - Public statements on behalf of AAA shall reflect official positions of the Advisory Council and shall be issued through proper channels. Members who violate this provision shall be subject to removal by a majority vote of the Advisory Council subject to approval of the Board of Supervisors. Section 10 - Members who have been absent from three consecutive meetings without notification shall be automatically removed from the Council. Section 11 - In the event of the death or rc: ignation of a member, that _ member's alternate shall serve the unexpired portion of the term and the sponsoring authority shall elect /appoint a new alternate_ A member or alternate may resign by addressing a written resignation to the Chairperson of the Advisory Council or the Executive Direr. t �)r. AA8da6 'MClY- 1 1 ­90 FR I 9 :!5 -4 P _ 05 VENTURA COUNTY AREA AGENCY ON AGING Guidelines for the Election of Representatives from Councils on Aging Under the bylaws of the Ventura County Area Agency on Aging, every city having a Council on Aging elects a member and an alternate to serve a two -year term on the AAA's Advisory Council. The following guidelines are suggested to standardize the process of electing representatives: 1. Election of the Area Agency on Aging representative and alternate should occur at a regularly scheduled Council on Aging meeting. 2. At least thirty (30) days publYC notice of the election meeting must be given in the local community. - 3. The regular election procedure of each local council on Aging should be utilized to elect the member and the alternate. The winner will be the one who obtains the largest number of votes. The alternate to the Advisory Council will be the person who gets the second highest number of votes. These names must be submitted to City Councils for ratification,. 4. Should the persons elected riot be ratified by the City Council, the Council on Aging membership shall elect other persons. This process shall continue until the two bodies agree upon a member and alternate. 5. The names of the elected member, and alternate of each local Council. on Aging must be certified in writing by the City Council and sent to: Executive Director Ventura County Area Agency on Aging 505 Poli Street, Third Floor Ventura, CA 93001 These names should be forwarded to the Area Agency on Aging no later than Monday, June 4, 1990 CLH:bh guidelines /AC2/4 -90
