MOORPARK 799 Moorpark Avenue Moorpark, California 93021 (8Q�5�A5�9,64 ,-:i1y Council Meei`ng of / 199 The Honorable City Council ACTION:C , Steven Rueny, City Manager B April 26, 1991 SUBJECT: Consider Acceptance of Grant Deed and Temporary Slope Construction Easement from Carlsberg Financial Corporation for Spring Road It was anticipated that right -of -way on the east side of Spring Road,needed for intersection improvements at Tierra Rejada Road, would be acquired from Conejo Freeway Properties, Ltd. (Carlsberg) by Embassy (PD 1062 and 1063) for required public improvements. As we now know, that project will not be built. Carlsberg and Embassy had been in negotiations for the subject property but the acquisition was not completed. A portion of the subject right -of -way is needed for intersection improvements related to the Tierra Rejada Road widening project. At this time, it will cost less to accept the entire right -of -way than to prepare new legal descriptions. The dedication for street purposes is 31,412 square feet and the temporary slope construction easement is 18,758 square feet. The legal descriptions for both properties were previously checked by the then City Engineer as part of the plan review for PD 1062 and 1063. These documents are on file in the City Clerk's office. Carlsberg has requested to be paid $4,246.50 for the dedication of property. This is equivalent to their legal and engineering costs incurred to prepare the necessary documents. It is recommended that the Council authorize the requested payment for the subject property since it is less costly than the appraisal, legal, engineering and staff costs that would otherwise be incurred. STAFF RECOMMENDATION 1. Approve acquisition of spring Road right -of -way and Temporary Slope Construction Easement from Carlsberg. 2. Appropriate $4,246.50 from the Gas Tax Reserve for the subject property acquisition and authorize City Manager to proceed with the-acquisition. PAUL W. LAWRASON JR. BERNARDO M.
