Gilbert, Director of Public Works DATE: July 27, 1993 (Council Meeting 8 -4 -93) SUBJECT: Consider Request to Convey to the City the Maintenance Responsibility for the Parkway Located on the North Side of Campus Park Drive East of Loyola Street OVERVIEW This presents an analysis of the facts surrounding the development of the parkway located on the north side of Campus Park Drive east of Loyola Street, and a request from the HOA that this parkway be conveyed to the City for maintenance. BACKGROUND 1. Prior to the incorporation of the City of Moorpark, the County of Ventura approved Tract 3070. The conditions of approval for that tract required the developer to dedicate and improve Campus Park Drive west of Princeton Avenue to the standards called for by County Plate B -2B. These standards require the dedication of ninety -four feet (941) of right -of -way and the improvement of divided arterial street having a curb -to -curb dimension of seventy -eight feet (781) and a center median fourteen feet (141) wide. 2. In 1984 the City Council of the City of Moorpark approved Tract 4170 (formerly Tract 3170 -5). The conditions of approval for that tract revised the above mentioned requirements for the improvement of Campus Park Drive. Those conditions required the street improvements to be "tapered" down to a paved section of thirty -four feet (341) within forty -three and one -half feet (431) of right -of -way and with no center median. The street improvement plans for this segment of street (an excerpt of which are attached as Exhibit 1) implemented this direction. loyopkvy Parkway @ Loyola & Campus Park Drive August 1993 Page 2 3. As shown on Exhibit 1 (the street improvement plans) and Exhibit 2 (an excerpt from Tract Map 4170) there is a portion of unused right -of -way on the north side of Campus Park Drive east of Loyola Street. The conditions of approval for Tract 4170 stated that the right -of -way line on the north side of the Campus Park Drive was to be changed to be located at the back of sidewalk. For some unknown reason, this direction was never implemented. 4. Although the intent is not clearly stated, it is presumed that the area between the sidewalk and the lot lines was to be conveyed to the HOA as a common area. This could have been accomplished by including this area in Lot 11 (see Exhibit 2) which is owned by the HOA. 5. The conditions of approval for Tracts 3070 and 4170 also require the landscaping of all common areas owned by the Home Owners Association. Attached as Exhibit 3 is an excerpt of the landscaping plans for those common areas. These plans include the installation of landscaping and irrigation in the subject parkway. DISCUSSION A. Committee Review The City is in receipt of a request from the HOA that the City take over the maintenance of the subject parkway. This request was referred to the Public Works, Facilities and Solid Waste Committee (Mayor Pro Tem Montgomery and Councilmember Wozniak) for review and recommendation. B. Basis of Recommended Action The action recommended below is based on actions taken by the City Council in approving the subdivision which created the subject parkway. Those actions and related facts are summarized as follows: 1. As stated above, it was the intent of the City that the area in question be removed from the street right -of -way. 2. Although not clearly stated, it appears that the subject area should have been granted to the HOA as a separate parcel or as a part of Lot 11. loyopkvy Parkway @ Loyola & Campus Park Drive August 1993 Page 3 3. The landscaping and irrigation plans prepared by the developer and approved by the City show this area to be included in the common areas to be landscaped and to be maintained by the HOA. There is no discussion in the staff report or the conditions of approval for these Tract Maps or accompanying Residential Planned Development permits that supports the concept that this parcel was to be maintained by the City. 4. Currently the landscaping and irrigation in the subject parkway is maintained by the HOA. The irrigation system for that area is connected to the irrigation system for other landscaped areas maintained by the HOA. The water meter for the irrigation system supplies water to many landscaped areas, including the subject parkway. Although not impossible, separating this parkway from other areas maintained by the HOA would be difficult.
