SUBJECT: Consider Support for AB 2846 Regarding Annexations
Background
The League of California Cities is sponsoring AB 2846 (Sweeney) regarding annexations. The
intent of the bill is to level the playing field between cities and counties over annexations.
Under current law, counties may develop in a city's sphere of influence and refuse to negotiate in
good faith over annexations. If approved, AB 2846 would require cities and counties to adopt a
valid sphere of influence agreement prior to the approval of a development project within a city's
sphere of influence. The agreement would be required to contain specified elements, including,
but not limited to, the following:
1. Services and infrastructure to be provided to the development.
2. Services and infrastructure providers.
3. Planning and development requirements applicable to the development.
4. A schedule for complying with the Cortese-Knox Local Government
Reorganization Act of 1985 for annexation of the territory to the city, including
the requirement of Section 99 of the Revenue and Taxation Code.
Additionally, any approved development project within a city's sphere of influence shall be
consistent with the sphere of influence agreement between the city and the county.
Recommendation
Staff recommends that the City Council express support for AB 2846, and authorize the Mayor to
send a letter to the appropriate legislative committee communicating the City's position.
