Gilbert, Director of Public Works DATE: January 3, 1997 (Council Meeting 1- 15 -97) SUBJECT: Consider Conveying a Southern California Edi for the Construction o Existing Water Main Community Park Access Property. Water Easement to the son Company (SCE) to Allow f a Water Service from an within the Arroyo Vista Road Northerly to SCE 1. As you know the City worked with SCE and a firm leasing certain SCE property, to develop certain construction and post - construction conditions, which were required to facilitate early possession of certain easements the City needed for the pedestrian bridge. 2. One of the agreed upon terms of those conditions stated that the land lease tenant would relocate, at their cost, almost two hundred (200) boxed trees from the area being acquired by the City. 3. Those trees were to be relocated to the west to an area farther away from the present source of irrigation water. It was, therefore, also agreed that the City would offer to sell to SCE a water easement to facilitate the installation of a new water service at the westerly end of the SCE property, to remedy water pressure problems. 4. The City is in the process of finalizing a water easement to be granted to the Ventura County Waterworks District No. 1 (District) for an existing water main located within the Arroyo Vista Community Park Access Road. The recordation of that easement was delayed until certain problems with the legal description for the park property were resolved. avpwtr.aca `Ot. The above mentioned water easement to be granted by the City to SCE would extend from District's easement northerly to the northerly property line of the park. It will be necessary for SCE to later convey this water easement to the District to accommodate the future water service lateral serving the SCE property, said water service lateral to be owned and maintained by the District. 6. In recognition of the costs incurred by the tenant for the relocation of the boxed trees from the property being acquired by the City, the City agreed to pay the engineering costs for the preparation of the water easement and the legal description for same. A diagram of that water easement is attached as Exhibit 1. 7. Pursuant to the terms for early possession of the property required for the pedestrian bridge, the City has agreed to sell the subject water line easement to SCE for an amount yet to be determined, which shall be equal to the fair market value of that easement, as mutually agreed to by the City and SCE. It is the intent of staff to meet with SCE to discuss the method for determining the amount of the fair market value for the water easement. 8. The City has also agreed to allow the water lateral to be constructed and made operational upon receipt of a letter from SCE agreeing to purchase this easement. The City has received that letter of intent (Exhibit 2). City staff has met with the lease tenant and the District to discuss these matters in preparation for the actual construction of the new water service. It is the intent of all concerned to have this water service constructed prior to the construction of the new pavement for the Arroyo Vista Community Park access road. 0 6 • A diagram of the subject water easement to be sold to SCE is attached as Exhibit 1. The City Engineer is in the process of preparing the legal description and the Deed for this easement. Compam Ken Gilbert City of Moorpark 799 Moorpark Avenue Moorpark, CA 93021 DEC 2 3 1996 City Of MOOrpatlC ftII0W0ft D8partment December 18, 1996 SUBJECT: Arroyo Vista Pedestrian Bridge Stipulation Between City of Moorpark and Thomas Lucas for Waterline Easement Dear Ken; Please consider this a formal acceptance of the City's offer to grant to Edison an Underground Waterline Easement as stated in the above mentioned Stipulation. It is my understanding that the easement will run from the Arroyo Vista Community Park Center under the park road, northerly, to the Edison owned property: Edison shall pay the City Fair Market Value for the easement. It is also my understanding that the City will be preparing the Easement at it's sole expense with an accurate legal description within 30 days of receipt of required information from Performance Nursery. According to the Subject Stipulation, pending completion of the construction of the waterline and receipt of this letter, the Water Service will be allowed to be made operational.
