SUBJECT: CONSIDER ADOPTION OF AN ORDINANCE EXTENDING ORDINANCE NO.
221, AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF MOORPARK, CALIFORNIA, ADOPTED AS AN URGENCY
MEASURE, IMPOSING A MORATORIUM ON THE ISSUANCE OF NEW
PERMITS FOR ALCOHOLIC BEVERAGE SALES IN THE CITY
BACKGROUND
On December 4, 1996, the City Council adopted Interim Zoning
Ordinance No. 221 as an urgency measure, pursuant to Section 65858
of the State Government Code, imposing a moratorium on the issuance
of new permits for alcoholic beverage sales in the City. Ordinance
No. 221 expires on January 18, 1997, unless extended. For the
period of time that Ordinance No. 221 is in effect, no application
for a permit to allow alcoholic beverage sales shall be accepted
for filing with, or issued or approved by, the City; however this
prohibition does not apply to the only currently pending
application for the La Playita Restaurant.
Section 65858 of the State Government Code allows the legislative
body to adopt, as an urgency measure, an interim zoning ordinance
prohibiting any uses which may be in conflict with a zoning
proposal which the legislative body is considering, or studying, or
intends to study within a reasonable time. After the required
public notice and a public hearing, the legislative body may extend
the interim ordinance for 1C months and 15 days and may
subsequently extend the interim. ordinance for one year. Any
extension requires a four - fifths vote for adoption. Ten days prior
to the expiration of an interim zoning ordinance or any extension,
the legislative body is required tc issue a written report
describing the measures taken to alleviate the condition which led
to the adoption of the ordinance

DISCUSSION
This staff report has been written to fulfill the requirement for
the issuance of a written report, ten days prior to the expiration
of Ordinance No. 221, describing the measures taken to alleviate
the condition which led to the adoption of the interim zoning
ordinance. At its meeting on December 4, 1996, the City Council
also adopted Resolution No. 96- 1256A, initiating an amendment of
Title 17, Zoning, of the Moorpark. Municipal Code, pertaining to the
issuance of permits for alcoholic beverage sales in the City, and
directing the Planning Commission to study, set a public hearing,
and provide a recommendation to the City Council. Staff has
tentatively scheduled the Planning Commission public hearing for
March 10, 1997, and expects that:. the City Council public hearing
can be scheduled in April 1997. Upon adoption of an ordinance
amending Title 17 to include all State and City regulations
pertaining to the permit and processing requirements for allowing
alcoholic beverage sales in the City, the interim ordinance
imposing a moratorium will be terminated.
Attached to this report is a draft ordinance, extending Ordinance
No. 221.
STAFF RECOMMENDATION
Adopt Interim Zoning Ordinance No. , as an urgency measure,
which ordinance shall extend the moratorium on the issuance of new
permits for alcoholic beverage sa =les through December 3, 1997,
unless extended or amended by a subsequent ordinance. (Requires a
four - fifths vote for adoption.)
