SUBJECT: Reconsideration of a Request for the City to Construct
Certain Improvements to the Property Located at 41 Flory
Avenue [North Side of Los Angeles Avenue, West of Flory
Avenue -- Miranda]
This presents a request for the reconsideration of City
participation in the funding of certain improvements to the subject
property, including the extension of the perimeter block wall
located on Los Angeles Avenue.
BACKGROUND
1. The City received a letter (Exhibit 1) dated January 27, 1996,
from Mr. and Mrs. Miranda, the owners of the property located
at 41 Flory Avenue, requesting that the City raise the height
of the block wall along the south side of their property, which
is adjacent to Los Angeles Avenue.
2. On April 3, 1996, this matter was discussed by the
Transportation and Streets Committee (then Councilmembers
Hunter and Wozniak). The Committee concurred with the
conclusions of staff that this matter was not the
responsibility of the City.
3. On April 4, 1996, a letter ( Exhibit 2 ) was sent to the Mirandas
denying their request and stating that they were welcomed to
undertake any desired block wall modifications.
4. In mid -May, then Councilmember Brown requested that this matter
be referred back to the City Council Transportation and Streets
Committee (then Councilmembers Hunter and Brown).
5. On May 28, 1996, the Committee discussed this matter once more.
Mr. and Mrs. Miranda were present. After discussion, the
Committee recommended that this matter be referred to the City
Council for consideration.

6. On June 19, 1996, the City Council considered this matter. A
copy of that staff report is attached as Exhibit 1. Subsequent
to a discussion of the matter, the City Council directed staff
to meet with the Miranda family for the purpose of exploring a
possible remedy to the concerns expressed by the Mirandas.
7. Staff met with the Mirandas to discuss a possible project for
the replacement of the block wall in question. Based on prior
City approved projects of a like nature which required the
property owner to bear a portion of the cost, staff described
a project with City funding of only fifty percent (50 %) of the
costs. The Mirandas declined to participate in this project.
8. Several months later, staff and then Councilmember Brown met
with the Mirandas at the subject property to discuss other
possible alternative solutions. The purpose of this report is
to summarize the results of that meeting.
DISCUSSION
A. Existing Wall
The current height of the block wall along the south line of
the subject property, as measured from the sidewalk on Los
Angeles Avenue, ranges from 41211 to 516". As stated in the
June 1996 report to the City Council, the sidewalk along the
south side of this wall (north side of Los Angeles Avenue
between Moorpark Avenue and Flory Avenue) was constructed in
1989 by the developer of the Le Club apartment complex
(southeast corner of Los Angeles Avenue and Moorpark Avenue).
It is alleged that it was only after this sidewalk was
constructed that the height of the existing block wall was
rendered a height less than the five feet minimum. The
Mirandas have requested, therefore, that the City take steps to
raise the height of the wall.

City staff and the Mirandas have met and discussed elements of
a compromise solution which not only addresses their concerns
but also provides solutions to a number of other problems. A
description of the various improvements proposed is summarized
as follows:
1. Location Map: The location of the project is shown on
Exhibit 'A'.

2. Site Plan: Attached as Exhibit 'B' is a site plan showing
all of the improvements proposed. The various elements of
work are described in the construction notes.
3. Wall Extension: The City would construct a "free- standing
wall extension along that portion of the westerly portion of
the wall which is too short. The design for this element of
the work calls for a fencing or siding material to be
affixed to free - standing poles to be placed along the north
side of the wall. A diagram of the fence extension is
attached as Exhibit 'C'.
4. Street Right -of Way: The property owner would be asked to
convey additional right -of -way at the corner of Flory Avenue
and Los Angeles Avenue, sufficient to allow for the
construction of additional sidewalk, a planter area and a
monument entry sign. A diagram of the improvements proposed
at the corner is shown on Exhibit 'D -11.
5. Sidewalk Improvements: The City would construct additional
sidewalk in this area to remove a "missing link" between the
sidewalk on Flory Avenue and the sidewalk on Los Angeles
Avenue (see Exhibit 'D -1' for details).
6. Additional Wall: The City would construct a four feet (411)
high block wall (see Construction Note #6 on Exhibit 'B')
along the front side yard and diagonal southeast corner'of
the property. Details of the wall construction are shown on
Exhibits 'D -11, 'D -2' and 'D -31.
7. !Monument Sign: The City would have a Monument sign
fabricated and installed on the above described wall,
identifying the Flory Tract (see Exhibit 'D -21 and 'D -3' for
details).
8. Planter Area: The City would install and maintain an
irrigation system and landscaping in the planter area shown
on Exhibit 'D -11. Water would be provided by the property
owner at no cost.
9. Mature Tree: The existing mature tree would be preserved
and made a part of the landscaping of the entry statement
which will be situated within the street right -of -way to be
conveyed to the City.
10. Easement / Sidewalk Widening at Northeast Corner: Upon
conveyance of a sidewalk easement by the property owner, the
City would construct additional sidewalk near the northeast
corner of the property to provide a useable sidewalk around
an existing power pole.

C. Property Owners' Responsibilities
As stated above, the Mirandas are being asked to participate in
the implementation of this project in a number of ways,
including:
1. the relocation of certain storage sheds;
2. conveyance of additional street right -of -way; and,
3. provide irrigation water to the City's future landscaped
planter area.
D. Agreement to Provide Water
It is the intent of staff to prepare a letter agreement between
the property owner and the City documenting the fact that
irrigation water will be provided by the property owner.
The proposed monument sign and landscaped planter area is
consistent with certain stated goals of the Moorpark
Redevelopment Agency (MRA) to promote the establishment of
entry statements at entrances to residential neighborhoods in
the downtown area. In that most of the costs for the above
described work pertains to the construction of an entry
statement at the entrance to the Flory Tract, it is recommended
that this project be funded by the MRA.

If this project is approved, it is the intent of staff to
prepare a Resolution, to be considered at a future meeting of
the Moorpark Redevelopment Agency (MRA), approving an amendment
to the MRA budget, in the amount of $6,000, to fund the actual
costs described above. The staff time noted above, to be
provided by the Public Works Department, would be funded by the
Gas Tax Fund.
G. Maintenance
Future maintenance of the landscaped planter to be constructed
within the street right -of -way to be conveyed to the City, will
be provided by the City in a manner similar to other landscaped
parkways on arterial streets. No contract maintenance costs
are expected for this area during FY 1996/97.
It is the recommendation of staff that the City Council approve the
improvements proposed in this report and direct staff to prepare
the funding resolution and proceed with project implementation.
