Subject: Consider Commercial Planned Development Permit 89 -1 Minor
Modification 6, and Commercial Planned Development Permit
89 -2 Minor. Modification No. 12, for modification of the
sign program for Mission Bell Plaza (Mission Bell
Partners), located at the northwest corner of Los Angeles
Avenue and Park Lane
This request is to modify the approved sign program to clarify the
sign program, especially the definition of anchor or chain tenants;
to include Bauducco's as an anchor /chain tenant, and incorporate
Bauducco's signs as part of ':he sign program.
Major Modification No. 1 to Commercial Planned Development Permit
No. 89 -1 and 89 -2 was approved by the City Council on October 2,
1991 for the construction of Mission Bell Plaza. Condition No. 19
of Resolution No. 91 -798 required t}ie filing of a comprehensive
sign program for the center.
Minor Modification No. 3, approved on February 16, 1993 reaffirmed
the requirement for a sign program and specified the allowed sizes
for the pylon sign and the two monument signs.

On October 5, 1994 the Council approved Resolution 94 -1074 for
Major Modification No. 2 to CPD 89 -1. Condition No. 19 of this
Resolution required the Phase I sign program to be updated to
include phase II of the center. The revised sign program was
approved by the City on December 26, 1995.

This Minor Modification is for two changes to the approved sign
program: Part one consists of a revision to the definition of
anchor /chain tenants (Page 10 of the sign program) . The second part
is to include Bauducco's Restaurant and Market as a special tenant
and adopt their signage, both existing and proposed as part of sign
program attachments
The provisions for anchor /chain tenants (page 10 of Exhibit 2), as
currently written does not specify the number of stores required to
be considered a special tenant, or provide any limitations on the
number of signs allowed, colors or materials. The proposed
revisions (Exhibit 4` provides a minimum number of stores to be

considered a anchor tenant. However, the definition of "region"
(line S) is not defined. Although a more comprehensive requirement
for anchor tenants is clearly desired, neither the existing or
proposed section addresses issues such as the maximum number of
signs allowed, their color, materials or the minimum size a store
must be to qualify as an anchor tenant. In addition, the provision
that all anchor tenants will be allowed their "usual and customary
signage" supersedes all limitations )f the sign program and sign
code. The result of this could be where a majority of tenants could
have signage which does not. conform to the sign program
(Albertson's, Baskin Robbins, Carls, 'hief, E1 Pollo Loco, K -Mart,
Payless Shoes, Rega Cinemas).
Section 17.40.010 of the code and Policy 17.1 of the Land Use
Element to the General Plan requires signage that is compatible
with surrounding development, in character with the development and
avoids visual clutter. Sign programs are required for this reason.
The function of a sign program is to codify the desired
architectural themes of the center through limitations on the
number of signs, lettering st.y es, cc. lors and materials.
The Miscellaneous Notes section must be revised to delete reference
to "regional tenants" as this provision is not needed. This section
should be further revised to require that anchor tenants meet the
size, sign number and location requirements as specified for non -
anchor signs. Anchor tenants will be allowed added flexibility in
their lettering sty: es and co l(.)i .

The second part of this request is to include Bauducco's as an
anchor tenant. A summary of the existing and proposed signage
(Exhibit 6) is contained in the table below:

Note: the sign code specifies that sign area be measured by
drawing a rectangle around the perimeter of the sign and
calculating the area of the rectangle. This calculation would
result in a significantly larger area than indicated. The sign
area totals i.n these tables were based upon Staff
calculations. The totals provided by the applicant vary
somewhat as shown in Exhibit 4.

Sign Program Criteria
The sign program allows non - anchor tenants one sign, the size of
which is one square foot of sign area for each foot of leasehold
width not to exceed 700 of the width of the store frontage. This
would allow a sign of 76 square feet. The existing sign on the
front of the building is 40 sq.ft. The addition of three new signs
with a total area of 30.74 sq.ft.. on the front would bring the
total sign area to 70.34 sq.ft., which is less than the allowed 76
sq.ft. The sign program allows a second sign for businesses with
additional frontage but does not specify an allowed size. A 30
sq.ft. sign on the western facade has been approved. This sign has
been installed and is not cut: of proportion with the building
scale. The sign program allows one sign on the front, and one
additional sign for businesses with an second frontage. This
proposal would bring the total number of signs to five, including
the logo, three greater than is allowed for non - anchor tenants. The
current definition :)f anchor tenants sets no limit on either the
number, size or style of lettering for tenant. Because the current
provision for anchor tenants provides no numerical or specific
criteria for these tenants, it could be interpreted that the
provisions for non - anchor tenants (one sign limit) would apply by
default. City policy as been -:o allow anchor tenants additional
variation in lettering style anc colors (such as K -Mart,
Albertson's, and Baskin Robbinsl but. not. in the number of signs or
their location. Exhibit 10A of -he current sign program allowed one
sign for Bauducco':s with a maximum of 24" high letters. Staff
allowed 20" high letters as consideration for a special tenant, but
indicated the additional signs should be further reviewed.
The current proposal for a total of five signs exceeds the allowed
number of signs for a tenant (one sign plus one for the second
frontage) and exhibit 10 A of the sign program (which allows only
one sign on the main entrance)
Sign Code Criteria
This section is being included to provide a comparison between the
sign program and zoning code standards. Because Bauducco's is under

10,000 sq.ft., it is considered to be a minor tenant, and would be
allowed one 20 sq.ft. sign, with a 10 sq.ft. sign on the second
frontage. Bauducco's would be a Minor Tenant regardless if they
take the space of four regular stores or the City or applicant
believes that due to the unique nature of the business additional
flexibility in the signs should be allowed. Major Tenants over
10,000 sq.ft. are allowed 80 sq.ft. (,f sign area. This allowed 30
sq.ft. is considerably less than -.he 100.74 sq.ft. which is
proposed. However, due to Section 1 ".40.050 C, the sign program
supersedes the sign code requirement:.
Because elements of the proposal exceed the sign code limits,
approval of this permit is being deferred to the City Council.
Section 17.44.060 of the zoning cede allows the Director of
Community Development to defer approvals when any project is in
conflict with City policies, -n this rase the requirement that sign
programs conform to the sign code requirements. The applicant has
been informed that this request woi:ld be deferred to the City
Council.
This project is Categorically Exempt from CEQA requirements as a
under Section 15311 as a Class 11 exemption; "...construction, or
placement of minor structures accessory to (appurtenant to)
existing commercial facilities. including but not limited to... a)
on premise signs."
Adopt the attached Resolution approving Minor Modification No. 6 to
Commercial Planned Development Permit No. 89 -1 and Minor
Modification No. 12 to Commercial Planned Development 89 -2, for a
modification to the approved sign program subject to the following
conditions of approval:
1. Prior to approval of the Sign Program all conditions of
approval contained in this Resolution shall be incorporated in
the text of the sign program.

2. The text of the sign program shall be modified to indicate
that all signs shall be allowed only one line of text. This is
not specified in the text of the sign program, but indicated
in all of the drawings.
3. The sign program shall be modified to limit the size of logos
to four square feet. The logo may be in one or two sections,
neither of which may exceed two feet in height. This is a
clarification which will eliminate confusion in the current
wording.
4. Should Bauducco's vacate the premises, all signs shall be
removed within 30 days of vacancy, as is currently required by
the sign program.
5. Should the space currently occupied by Bauducco's be
subdivided, all future tenants shall meet the provisions of
the sign program.
6. The Miscellaneous Notes section shall be revised to delete
reference to "regional tenants ". This section shall be further
revised to require that anchor i:.enants shall comply with the
provisions of the Sign Code as specified for major tenants.
Anchor tenants shall be 10,0('0 sq.ft. or larger, or as
designated by -he City Council.
7. Bauducco's shall be considered an anchor or special tenant and
the requested signs are hereby approved, subject to the
issuance of a Sign Permit. Should Bauducco's vacate the
premises and be occupied by a non - restaurant use, City Council
review of any proposed signage is required.
8. Failure to inaugurate this Minor Modification in twelve months
or less from the date of approval will render this
modification null and void. A one year extension to this Minor
Modification may be granted by the Director of Community
Development upon the written request and payment of the
appropriate fi i.ng fee.

D. Wall Signs (Major and Minor Tenants).
1. Size. _
a. Minor Tenants. For minor tenants, the wall signs
may not exceed a maximum sign area of twenty (20) square
feet per building tenant.
b. Major Tenants. For major tenants, the wall signs
may not exceed a maximum sign area of eighty (80) square
feet per building tenant.
c. Single Parcels, Under Ten Thousand (10,000) Square
Feet. Single parcels under ten thousand (10,000) square
feet shall be subject to the same signage allowed for a minor
tenant.
2. Height, for Minor and Major Tenants. Wall signs,
for all tenants, may not extend beyond the roof line.
3. Length. Sip length may not be greater than seventy -
five percent (75%) of the linear frontage of a building.
In the case of multiple tenants, the sign may not be greater
than seventy-five percent (75%) of the linear frontage of
the space occupied by the applicant
4. Number of Signs.
a. One (1) wall sign per tenant may be allowed. For
single out parcel tenants, two (2) wall signs per parcel may
be allowed, with a maximum wall sign area of twenty (20)
square feet of signage per wall sign.
b. A single oenant with move than ten thousand (10,000)
square feet of retail space may be allowed three (3) wall
signs, with a maximum wall sign area of ten (10) square
feet of signage per wall sign.
c. Corner tenants which are attached to a center may
have an additional wall sign which either fronts the street
or the parking lot.
5. Location.
a. Signs on the Front Elevations. Signs on the front
elevations are allowed as provided herein.
b. Side and Rear Elevations. A second sign may be
allowed provided that the sign is no more than fifty percent
(50%) of the sign area of the sign on the front elevation.
No building shall have more than two (2) signs per building.
6. Illumination. Wall signs may be illuminated, consis-
tent with illumination policies as outlined within Section
17.40.050E. External and indirect lighting is not allowed.
7. Letter Size. For minor tenants the minimum letter
height may be fourteen (14) inches and the maximum letter
height may not exceed eighteen (18) inches. For major
tenants the maximum letter height may be forty-eight (48)
inches. For industrial developments the maximum letter
height may not exceed twenty-four (24) inches.
8. Mounting. All wall signs shall be mounted parallel
to the wall and shall not project more than eight (8) inches
from the wall, and shall not project into the public right -of-
way or over the property line.

9. Design. Wall signs shall exhibit an architectural
design which is compatible to the design of the building
in which the business that the sign identifies is located.
E. Window Sips.
1. Permit Not Required. Window signs are allowed
without obtaining a sign permit.
2. Size and Location. Window signs may not exceed
twenty-five percent (25%) of the total window area, per
window, on any single frontage of the building fronting
a street to be displayed in conjunction with sales or special
events for an indefinite period of time.
3. Illumination. Window signs shall not be illuminated
except for signs made of neon.
4. In -Lieu of Wall Signs. If window signs are used
in -lieu of wall signs, no temporary window signs are
allowed for those windows having permanent window signs.
F. Under - Canopy Signs.
1. Size and Height. The sign area for an under canopy
sign may not exceed twenty (20) square feet Under canopy
sign may be allowed in a hanging fashion if it maintains
a clearance of not less than eight (8) feet from the bottom
of the sign to the walkway.
2. IDumination. Under canopy signs shall not be
illuminated.
3. Letter Size. The maximum letter size may not exceed
fourteen (14) inches in height
4. Mounting. Under-canopy signs may be mounted
using a flexible device such as a chain or cable.
5. Design. Under -canopy signs shall exhibit an architec-
tural design which is compatible to the design of the
building in which the business that the sign identifies is
located.
6. Other. Under-canopy signs ate not allowed to project
beyond the canopy.
G. Clocks and Thermometers. Time and temperature
devices may not exceed a maximum area of twenty-four
(24) square feet and shall not display commercial advertise-
ment on the clock or thermometer. No permit is required
for clocks and thermometers which do not function as an
advertising copy.
H. Directory Signs.
1. Size and Height. Directory signs are required in
multitenant residential, or industrial complexes. Directory
signs may be required in commercial office buildings as
required by the director of community development All
directory signs may not exceed a maximum of five (5)
feet in height and three (3) feet in width.
2. Letter Size. The maximum letter size for all directory
signs may not exceed six (6) inches in height
3. Mounting. All directory signs shall be mounted upon
an architecturally attractive support or base, which is

architecturally compatible to the building which the sign
represents.
4. Design. Directory signs shall exhibit an arbWwral
design which is compatible to the design of the building
in which the business that the sign identifies is located.
5. Illumination, Directory signs may be illuminated.
consistent with illumination policies as outlined within
Section 17.40.050E. External and indirect lighting is not
allowed.
6. Other. Directory signs are not allowed to project
into the right -of -way.
I. Riders. Riders on all signs (as defined in Section
17.40.020) are not allowed.
J. Trademark Signs. Trademark signs for Nationally
and Nonnationally recognized businesses are allowed as
follows:
1. Trademarks.
a. Design. The returns, trim cap, size and type of sign
shall exhibit an architectural design which is compatible
to the design of the building in which the business that
the sign identifies is located.
b. Size, Height and Colors.
i. The trademark may not exceed the allowable size
of the type of sign.
U. Signs shall be consistent with the requirements of
this chapter and the zone in which the sign is located,
including height, size and location, except for cola require-
ments outlined within Section 17.40.050A.
2. Logos.
a. Design. The returns, trim cap and size of the sign
shall exhibit an architectural design which is compatible
to the design of the building in which the business that
the sign identifies is located.
b. Size, Height and Color. The logo may not exceed
the allowable size of the type of sign. Signs shall be consis-
tent with the requirement of this chapter and the zone in
which the sign is located except for the color requirements.

K Temporary Signs. Temporary signs are allowed
by permit as follows:
I. Temporary Banners —New Businesses.
a. Size. The allowed banner area may not exceed
twenty (20) square feet or twenty-five percent (25%) of
the total window area. whichever is greater.
b. Duration. Temporary banners may be erected for
a maximum of sixty (60) days during the opening of the
new business. On the sixty-first day, the temporary banner
shall be removed.
c. Location. Temporary banners for new businesses
are allowed, in commercial and industrial zones only, to
announce the opening of a new business. Banners must
only be attached to structures and shall not be attached
to trees or between posts. Banners must be securely fash-
ioned to the building.
d. Permit. In no case shall a sign permit for a tempo-
rary batmen be issued prior to city review and approval
of a sign permit request for permanent signage on the
subject site.
2. Banners— Existing Businesses.
a. Size. The allowed banner area may not exceed
twenty (20) square feet or twenty-five percent (250) of
the window area whichever is greater.
b. Duration. Banners for existing businesses are allowed
for three (3) week intervals, four (4) times per year. The
three (3) week intervals must be interrupted by at least
one four (4) week interval without a banner.
c. Location. Temporary banners will be allowed for
existing businesses in commercW and industrial zones only.
Banners must only be attached to structures and shall not
be placed on trees or between posts. Banners must be
securely fastened to a building.
d. Permit. Banners for existing buildings are allowed
by permit, consistent with the duration standards established
for banners, see subsection (KX2Xb) of this section.
3. Removal of Temporary Banner Signs. Failure to
remove the temporary sign within two (2) days after the
permit has expired will be cause for enforcement action
consistent with this chapter. (Ord. 199 $ 1(8110 -2), 1994)

17.40.050 General sign requirements.
A. Sign Colors.
1. For ceaeeisloomplexes with and without an approved
sign program, all permanent signs may contain no more
than four (4) different sign colors within a center /complex.
When reviewing a sign permit, consideration will be given
to the color of adjacent signs.
2. The sign structure and any related supports shall
be the same color and materials throughout a cen-
ter /complex.
3. Pictorial trademarks/logo and tradem k signs shall
be excluded from the color limitati ons as outlined above.
B. Placement of Signs. No sign shall be erected within
a sight triangle, or within the public right -of - -way. Except
as permitted by Section 17.40.150.
C. Master Sign Program. As part of an entitlement
permit, a toaster sign program may be required to be ,
submitted by the applicant to the department of community
development for review and approval. Should a master
sign program be determined to be required. the approved
master sign program shall constitute the sign requirements
for the project. The sign requirements of a master sign
program for a complex/center will supersede the sign
requirements as outlined within this chapter.

D. Signs Within the Public Right -of -way. No signs,
regulated by this chapter, are allowed within the public
right -of -way.
E. Illuminated Signs.
1. Location. Illuminated signs are not allowed in open
space, agricultural and residential zones. Illuminated signs
are allowed in other zones, subject to compliance with other
sign requirements as set forth in this chapter and approval
of a sign permit.
2. Illumination.
a. Illuminated signs in nonresidential zones shall not
exceed the brightness of a diffused light panel having slim -
line cool white fluorescent four hundred thirty (430) milli-
ampere lights spaced at least twelve (12) inches on center.
Sign illumination shall not result in glare being directed
toward surrounding properties. The source of illumination
shall not be visible from a walkway or street.
b. Unless otherwise authorized by the director of
community development, internally illuminated signs which
use the technique known as "push through,' as well as
individually illuminated channel lettering or halo lighting
is required. The director may allow a modification of this
requirement in the interest of aesthetics or compatibility.
Illumination of industrial monument signs shall not occur
by the use of internally illuminated signs; externally illumi-
nated monument signs are preferred, see Section
17.40.040B.
F. Trimming of Trees. No existing tree shall be
trimmed, pruned or removed from a city right -of -way to
increase the visibility of any sip, unless such work is fast
approved by the director of community services.
G. Tracking for Wall Signs. All individual letter or
channel letter wall signs shall be installed using a track
system. (Ord. 199 § 1 (8110 -3), 1994)
17.40.060 Sip permit administration.
A. Permit Requirements.
1. Application.
a. Except as expressly allowed by this chapter, no
person shall authorize, erect, construct, remove (except
as outlined within Section 17.40.080), alter, change, place,
suspend or attach any sign within the city without first
obtaining an approved sign permit from the department
of community development.
b. The application for such sign permit should be made
on the form provided by the department of community
development. A fee, as established by city cotmcil resolution
is requited to accompany each application for a sign permit.
2. Consistency Review.
a. An application for a sign permit will be reviewed
by the director of community development or a designee
for consistency with the requirements of this chapter and

the criteria of this section. The director may approve, or
conditionally approve any sign which meets the standards
of this chapter. The director of community development
may not approve any sign that does not meet the standards
of this chapter.
b. No sign permit of any kind will be issued for an
existing or proposed sign unless such sign is consistent
with the requirements of this chapter in every respect or
is consistent with any master sign program in effect for
the subject property. Any decision made by the director
of community development may be appealed in accordance
with the provisions of this chapter.
3. Sign Permit Tags. Every sign requiring a sign permit
is required to have the permit number placed on the ap-
proved sign. At the time of permit issuance, the city will
issue a permit tag which is required to be permanently
affixed to the lower right corner of the sign. The tag should
state the permit number assigned by the city for the sign.
B. Computation of Sign Area and Sign Height.
1. Individual Signs. The sign area will be measured
by drawing a rectangle around the perimeter of the lettering
and/or the pictorial symbol and calculating the area of the
rectangle.
2. Multifaced Signs. The sign area for a sign with
more than one (1) face shall be computed by counting only
one (1) face of the sign, provided the sign mess the double -
sided sign requirements. If this is not met. the face of the
square footage of each side of a sign will be calculated
when determining the total sign square footage for a build-
ing.
3. Sign Height The height of a sign will be computed
as the distance from the base of the sign at normal grade
to the top of the highest attached component of the sign.
Normal grade will be construed to be the lower of (a)
existing grade prior to construction; or (b) the newly estab-
lished grade after construction. excluding any filling,
berming, mounding or excavating solely for the purpose
of locating the sign.
4. Double -Sided Signs. Any sign erected on the back
of another sign must have the same exterior dimensions
as the existing sign. If this is met, the sign area will be
calculated based upon the square footage of one (1) side
of the sign. (Ord. 199 § 1 (8110 -4), 1994)
17.40.070 Sip construction and maintenance
standards.
All signs should be designed, constructed and maintained
(see definition in Section 17.40.020) in accordance with
the following standards:
A. Construction.
1. All signs are required to comply with applicable
provisions of the Uniform Building Code, the Underwriters

I. GENERAL

Signs are not only effective as store identification but are a source of interst,
excitement and good advertising when designed with taste and in harmony
with the design standards of the shopping center. The sign regulations
herein have been established for the purpose of achieving the best
possible effect for store identification and overall, design, while allowing
each Tenant creativity within the limits of their leasehold. The Tenant's
shall be required to install both fascia and under canopy signs. Experience
has proven that all stores in the Center benefit by the establishment of sign
control such as herein set forth.
II. APPROVALS
A. The design and construction Tenant's exterior sign MUST receive written
approval by Landlord prior to fabrication and installation.
Landlord's approval shall be based on:
1) Conformity to the sign criteria established for the center, including
fabrication and method of installation.
2) Harmony of the proposed sign with the design standards of
"MISSION BELL PLAZA" and cotenants.
Landlord has the specific right to refuse approval of any sign which does
not conform to the criteria set forth within.
B. To secure Landlord's approval Tenant agrees to conform to the following
procedures

1) Two copies of the detailed sign design drawings submitted to
Landlord at:

C. Unless Landlord and site architect have received the above described
plans in the quantities set forth above, Landlord will not approve Tenant's
exterior sign.
The sign drawings are to be prepared by a reputable STATE licensed sign
contractor. The sign drawings must indicate the following information:
1) A scaled storefront drawing reflecting the proposed sign design and
all dimensions as it relates to the storefront elevation of Tenant's
premises (SEE EXHIBIT 1 FOR SUBMITTAL DETAIL)
2) A plot plan and elevation indicating location of Tenant's sign.
3) Sizes of sign letters must be accurately dimensioned, spaced and
drawn at a minimum of 1/2" = 1'0" scale.
4) Section through sign and facia to show its construction method.
5) Plexiglass colors, pairhfev-and-typ materials.
6) Neon tubing sizes, end i oo017%.L1

D. All drawings marked "Disapproved" or "Approved as Noted" must be
resubmitted as here and above set forth in paragraph "B" with required
corrections. Tenant or its sign consultant will not be permitted to commence
installation of the exterior sign unless the following conditions have
occurred:
1) A stamped set of final sign drawings reflecting Landlord's approval
are received and retained at Tenant's premises at all times during
the installation of sign and for a period of thirty (30) days thereafter.
2) NOTE: No sign shall be constructed until approved installation
permits from the City of Moorpark are received by the Sign
Contractor.
III. GENERAL SIGN CRITERIA AND RESTRICTIONS - SEE EXHIBITS
A. Each In -Line Tenant shall provide one sandblasted under canopy
sign and one illuminated Pan Channel Letter sign to be located only
on the space and on the surface specially provided for the same on
the building exterior in accordance with the drawings attached
hereto. No other signage is permitted on the exterior of the premises.
Tenants with more than one frontage MAY BE allowed additional
signage with Landlord approval.
B. Channel letter sign length shall not exceed 70% of leasehold width;
sign square footage shall not exceed leasehold width multiplied by
1.0 factor. Signage are shall be centered on the facia VERTICALLY
and HORIZONTALLY. Maximum and minimum letter heights are
reflected on Exhibit 1 attached hereto. Logo plaques are allowed
with size and limitation as reflected on Exhibit 1.
C. The advertising or information content on the sign shall be limited to
letters designating the store name or established trade logo, as set
forth in signed lease documents between Tenant and Landlord.
Tenant shall display their established trade names only. The trade
name may be used only one time per permitted sign location. No
additional advertising will be permitted, i.e.: "Discount Sales,"
"Quality Shoes," "Ladies Wear," prices, phone numbers, etc. or
miscellanous brand names included in their operation.

D. The face colors and type styles of all signs shall be subject to
Landlord's approval. See Exhibit 1 for allowed face colors. Only the
colors listed will be allowed. In the even the Tenant does not have
an established exterior sign identity, the Landlord recommends that
the lettering style be designed by the sign contractor to reflect a
visually exiting look. Established trade logos and signage shall be
permitted providing they conform to the criteria described herein.
E. Logo plaques used in conjunction with individual letters will be
considered a part of the sign area, and are subject to Landlord's
approval.
F. The Tenant shall pay for all signs, their installation (including final
connection transformers and all other labor and materials) and
maintenance. Tenant sign contractor must file, pay for and obtain
any licenses, permits and variances as required for sign installation
by the City of Moorpark.
G. Each Tenant or its sign contractor shall be responsible for the cost of
repair by the Landlord of any damage to the building casued by the
installation of said Tenant's sign.
H. Each Tenant shall be responsible for the performance of its sign
contractor.
I. Tenant shall be responsible for removal of his sign within (30) thirty
days after vacating the site. Removal of the sign shall include the
repair and repaint of the wall surface back to the original condition.
J. Installing sign company must provide a photocopy of final inspection
approval by City inspector to the Landlord prior to payment of
contract balance by Tenant.
K. Individual shop address numerals will be installed by the Landlord.

L. Each occupant shall be responsible for keeping all signage or
graphics on its premises in a state of good repair, in sole judgement
of Landlord and City of Moorpark. Landlord shall inform occupant, in
writing, of non - compliance with the sign criteria. Remedy of specified
non - acceptance condition (s) shall be made by occupany within (30)
thirty days from receipt of such written notification.
M. No individual free standing building shall be allowed to have more
than two sides with wall or canopy signage. Logo signage may be
allowed on the other two exterior sides.
N. NOTE: Exhibits 1 thru 14, are an integral part of this criteria. Please
refer to these pages for additional information, location, and
fabrication.
O. Tenants that are specifically denoted by company name in this Sign
Criteria are hereby a part of this Signage Criteria.
IV. FABRICATION AND INSTALLATION
ILLUMINATED CHANNEL LETTERS - SEE EXHIBIT 1
A. The fabrication and installation of all signs shall be subject to the
following restrictions:
1) All Channel Letters are to fabricated 20 to 22 GA. sheet metal.
Fabricated full welded aluminum letters with aluminum backs
will be permitted. Channelume, Channel Classic, and
Channel Let -r edge type letters will not be permitted due to
rapid deterioration factor (no exceptions).
2) Letter faces shall be 3/16" thick, flat surface, colored plexiglas
as manufactured by Rhom & Haas or approved equal.
Painted plexiglas will not be permitted.

a. Retainer trim cap shall be 3/4" Bronze "Plasco" brand
trim cap edge. Retaining screws shall be #7 x 3/8
Phillip -type metal screws. All trim cap retaining screws
must be painted to match trim cap color.
b. 5" deep letter returns shall be painted minimum of two
(2) coats #8540 -A dark Bronze acrylic enamel as
manufactured by Dupont (enamel finish to be semi-
gloss).
4) Neon tubing will be 13 to 15 millimeter, 3" on center or less.
5) 60 MA. high power factor transformers shall be used.
6) PK Housings or Hage connectors shall be used for all neon
tube systems. Letters shall have U.L. labels.
7) All sign letters shall be secured by concealed fasteners,
stainless steel or nickel or cadmium plated.
8) No exposed lamps will be permitted.
9) All penetrations of the building structure required for sign
installation shall be sealed in a watertight condition.
10) No sign company labels will be permitted on the exposed
surfaces of the sign except those required by Underwriters
Laboratories, which shall be placed in an inconspicuous
location on first letter only.
1 1) All Channel Letters must have a 3/16" diameter drain hole at
bottom of every letter. All signs shall be fabricated and
installed with U.L. approval in compliance with all applicable
building and electric codes.
12) The Tenant shall be responsible for providing primary
electrical service terminations to the signage area on the rear
side of the facia wall

13) All signs shall conceal all necessary wiring, transformers,
ballasts, starters, and other necessary equipment within their
individual letters or behind storefront construction.
14) It is the responsibility of the Tenant's sign contractor to verify
all conduit and transformer locations and service prior to
fabrication.
V. NON- ILLUMINATED UNDER CANOPY SIGNS - SEE EXHIBIT 4
A. The fabrication and installation of all signs shall be subject to the
following restrictions:
1. All under canopy signs are to be fabricated of 1 -3/4" x 5' -0"
clear redwood with sandblasted background on both sides -
ease all edges. Depth is variable from 1/4" to 1/2" depending
on grain characteristics.
B. Stain on background to be Frazee #5210 Vanilla cream, border to be
Frazee #4333 Adobe.
C. Raised logo and letter of sandblasted background to be painted to
match channel letter faces.
D. 1 " square tube will be painted dark Bronze acrylic enamel as
manufactured by Dupont (enamel finish to be semi - gloss). See
Exhibit 4 for method of attachment.
E. Bottom of sign shall be 8' from grade.
VI. NON CONFORMANCE
A. No field installation changes are permitted without first notifying
Landlord in writing. If in the even any sign is changed as to
placement and location which differs from plan, sign company will be
responsible to remove and relocate sign to proper placement at sign
company's expense.
B. Any sign that is installed by Tenant which is not in conformance to
the approved drawings shall be corrected by Tenant within fifteen
(15) days after written notice by Landlord. In the event Tenant's sign

is not brought into conformance within said fifteen (15) day period,
then Landlord shall have the option to correct said sign at Tenant's
expense.
C. SEE PAGE 8 & 9 FOR "PROHIBITED SIGNS"
PROHIBITED SIGNS
1. NO BOX -TYPE SIGNS WILL BE PERMITTED. NO animated flashing
or audible signs will be allowed. No exposed lamps will be
permitted.
2. No signs will be permitted on awnings.
3. No temporary signs of any nature will be accepted without prior
written approval by Landlord and City of Moorpark.
4. No Tenant shall affix any type of illuminated or painted window signs,
placards, or temporary window signage unless written approval is
received by the Landlord and City of Moorpark.
5. SIGNS CONSTITUTING A TRAFFIC HAZARD
No person shall install or maintain, or cause to be installed or
maintained, any sign which simulates or imitates in size, color,
lettering or design, any traffic sign or signal, or which makes use of
the works "STOP ", "LOOK ", "DANGER ", or any other words, phrases,
symbols or characters in such a manner to interfere with, mislead or
confuse traffic.
6. IMMORAL OR UNLAWFUL ADVERTISING
It shall be unlawful for any person to exhibit, post or display, cause to
be exhibited, posted or displayed upon any sign, anything of an
obvscene, indecent, or immoral nature or unlawful activity.
7. SIGNS ON DOORS, WINDOWS OR FIRE ESCAPES
No window signs will be permitted except as noted herein. No sign
shall be installed, relocated, or maintained so as to prevent free
ingress and egress from any door. No sign of any kind shall be
attached to a stand pipe except those signs as required by code or
ordinance.

8. ANIMATED, AUDIBLE OR MOVING SIGNS
Signs consisting of any moving, swinging, rotating, flashing, blinking,
scintillation, fluctuating or otherwise animated light are prohibited.
9. OFF- PREMISE SIGNS
Any signs, others, other than a directional sign, installed for the
purpose of advertising a project, event, person or subject not related
to the premises upon which said sign is located, is prohibited.
10. VEHICLE SIGNS
Signs on or affixed to trucks, automobiles, trailers, or other vehicles
which advertise, identify, or provide direction to a use or activity note
related to its lawful making or deliveries of sales or merchandise or
rendering of services from such vehicles is prohibited.
11. LIGHT BULB STRINGS AND EXPOSED TUBING
External displays, other than temporary decorative holiday lighting,
which consist of unshielded light bulbs, and open, exposed neon or
gaseous light tubing are prohibited. An exception hereto may be
granted by the Landlord when the display is an integral part of the
design character of the activity to which it relates.
12. BANNERS, PENNANTS, AND BALLOONS USED FOR
ADVERTISING PURPOSES
Flags, banners, or pennants, or a combination of same constituting
an architectural feature which is an integral part of the design
character of a project may be permitted to subject to Landlord and
City approval.
13. SIGNS IN PROXIMITY TO UTILITY LINES
Signs which have less horizontal or vertical clearance from
authorized communication or energized electrical power lines than
that prescribed by the laws of the State of California are prohibited.

MISCELLANEOUS NOTES
The provisions of this Exhibit, except as otherwise expressly provided by this
Exhibit, shall not be applicable to the identification signs of Anchor or Chain
Tenants or other occupancy designated by the Landlord as a "Regional' or
"Special" Tenant that may be located in the Shopping Center, except as
incorporated and approved as a part of the attached City approved Tenant
Signage Exhibits. It being understood and agreed that these occupants may have
their usual signage on similar buildings operated by them in California; provided,
however, there shall be no rooftop signs which are flashing, moving, or audible,
and provided said sign is architecturally compatible and has been approved by
the Landlord.

The purpose of this Minor Modification request for both Phase I and
Phase II of Mission Bell Plaza is to amend the current sign criteria on
two counts:
A. To further define the allowable signage for major and /or chain
tenant's under the Miscellaneous Notes provisions of the current
sign criteria. It is hoped this will provide the Community
Development Department more latitude when reviewing retail and
other chain type tenant's, whose signage is an integral part of their
advertising and corporate identity, while defining the type of tenant
that would fall under this provision of the criteria. The suggested
text would read as follows:
"The provisions of this Exhibit, except as otherwise expressly
provided herein, shall not be applicable to the identification signs of
Anchor or Chain Tenant's. Anchor or Chain Tenant's, for purposes of
this criteria, shall be any tenant having five (5) or more stores within
a region or ten (10) or more stores statewide or nationally, whose
signage (or a portion thereof) is either a registered trade mark or has
corporate identification closely linked with the Tenant and is used
extensively as a part of their advertising. Those Tenant's so
designated as Anchor or Chain Tenant's may have their usual and
customary signage on similar buildings operated by them in
California, subject to the final approval of the City, whose objective
shall be to maintain the integrity of the Shopping Center Sign
Criteria, while allowing such Tenant's to install all or a majority of
their typical signage elements."
B. That the Bauducco's signage, represented by the attached, be
incorporated as Exhibit 15 of the approved Center Sign Criteria for
the project. Specifically the 30" square logo under the existing sign
and two 10" high signs in the column archways identifying the
restaurant and the market.
The Bauducco's premises consist of approximately 1,562 SF for an
Italian Market and Deli and 4,901 SF for the Italian Restaurant. This
portion of the project received special architectural treatment based
on these intended uses and was approved by City Council as a part &)(JLy2
Minor Modification No. 3 to CPD 89 -1.

The premises was originally planned for up to four (4) tenant spaces,
with an average store front width of 19'. Based on the current
criteria, there would have been 19.95 square foot of signage for each
tenant (19' x 70% length x 1.5' height), plus signage for the west
(theater) side of the end cap of probably 7.5 square feet (10' x 1.5'
height) for a total of approximately 87.3 square feet of signage.
Bauducco's has received approval of two main signs under the
current criteria. One on the west side of the premises which is 18"
by 17' and the other is arched over the main architectural element
on the south face of Shops No.l and measures 24" x 17'. These two
signs account for 59.50 square feet of signage.
This request would grant an additional 28 square foot of signage for
this tenant in the form of the logo ( 25 SF), Ristorante Del Toro in
the archway over the restaurant (11. SF) and Mercato Italiano in
the opposite archway on the market side (10.41 SF), bringing the total
Bauducco's signage to 87.5 square feet or .2 SF over what would have
otherwise been appropriate under the criteria.
The other feature of this signage was it's placement and size, since it
is different than was originally conceived when the Sign Program
was finalized. Based on the uniqueness of the architectural
treatments previously approved for this tenant, the extraordinary
craftsmanship and expense the tenant has gone to in fixturizing their
premises and the dual nature of the businesses being conducted
within, we would ask for Council's consideration and approval in
granting this modification and have it incorporated, by Exhibit, into
the criteria.
