SUBJECT: Consider Resolution No. 97- , Amending Resolution No.
97 -1267 Initiating the Proceedings Related to the Levy of
Assessments for the "Moorpark Lighting and Landscaping
Maintenance Assessment District" (AD 84 -2) for Fiscal
Year 1997/98, by Directing the Engineer's Report to
Provide for the Possible Establishment of a New Zone of
Benefit to Fund Maintenance Coast Related to Campesina
Park.
A. Prior Resolution
On January 15, 1997, the City Council adopted Resolution No. 97-
1267 initiating the process required to consider extending the
assessments levied by Assessment District 84 -2, to Fiscal Year
1997/98. That Resolution included language to allow the City
Council to consider the establishment of two new Zones of
Benefit generally described as follows:
• Zone 11: Tract 4174 (Colmer)
• Zone 12: Carlsberg Specific Plan Area.
B. Subject Resolution.

The subject Resolution amends that prior action to allow the
City Council to also consider the establishment of a third new
Zone of Benefit consisting of the area within Tract 4147 -- the
villa Campesina neighborhood. If established, the assessments
levied by this Zone of Benefit will fund maintenance (and
possible improvement) costs associated with Campesina Park, a
new park proposed to be developed by the Cabrillo Economic
Development Corporation (CEDC) near the south end of Liberty
Bell Road. The purpose of this action is to allow the
Assessment Engineer to include this option in the Engineer's
Report to be presented to the City Council in April. Such
action does not commit the City to this coarse of action. It
only allows for the consideration of this alternative.

C. Committee Discussions
The construction and maintenance of Campesina Park was recently
discussed at a meeting of the Public Works, Facilities and Solid
Waste Committee. The matter was continued to a meeting of that
Committee set for February 18, 1997,,
D. CEDC Request
The Cabrillo Economic Development Corporation (CEDC) is expected
to present to the Committee (and to the City Council) its plans
for the phased implementation of the construction of Campesina
Park. CEDC is also expected to request City participation in a
portion of the construction costs for this park.
E. City Maintenance
In addition, CEDC is also expected to request that the City take
over the ownership and maintenance of the park. As you may
recall, the City Council has directed that no new landscaped
areas are to be added to those funded by the Parks Assessment
(AD85 -1) or the Citywide Landscape Assessment (AD84 -2).
At the last Committee meeting it was discussed that City
maintenance costs could be funded by a Zone of Benefit
Assessment levied upon the residential properties within Villa
Campesina. A preliminary estimate of the amount of that
assessment is less than $5.00 per lot per month. The subject
resolution will allow the City Council. to consider that option.
F. Proposition 218
It should be pointed out that this may be the last year that new
assessments may be added without an affirmative vote from the
property owners being assessed.
G. Assessment Engineering Costs

The City's Assessment Engineer has stated that this change will
have no impact on the fees established for assessment
engineering services.

RECOMMENDATIONS
Staff recommends that the City Council adopt Resolution No. 97-
amending Resolution No. 97 -1267 to provide for the consideration of
a third new Zone of Benefit for Campesina Park.
