Gilbert, Director of Public Works DATE: February 24, 1997 (Council Meeting 3 -5 -97) ?!1, I • • SU&7BCT: Consider Request for the Establishment of a one hour Parking Zone [Permits Exempt] on Certain streets in the Vicinity of Moorpark High School M-9 Staff has been advised that a number of High School students park vehicles on certain residential streets in the vicinity of Moorpark High School. This practice is a source of concern to a number of property owners and residents in that area. The "flier" attached as Exhibit 1 expresses some of those concerns. Several months ago Kim Francis, one of those concerned residents, approached City staff to inquiry if or how such parking could be prohibiting. Ms. Francis was advised that the only way a parking prohibition for non - residents could be imposed would be by establishing a "Permit Only" parking area similar to the one established near Moorpark College. That program restricts on street parking to One -Hour Parking, but exempts vehicles with parking permits. Parking permits are only issued to vehicles registered to local residents. Ms. Francis was advised that in order to receive proper consideration, an application for the establishment of a "Permit -Only" parking area should come from the Homeowners Association for the affected areas and be accompanied by a petition or some like means to demonstrate that the requested action is supported by those most affected. Attached as Exhibit 2 is a copy of a Petition with signatures from most of the property owners and residents within the Willows II Homeowners Association. Attached as Exhibit 3 are copies of photographs demonstrating the scope and degree of the parking problem. •..5._ -. Attached as Exhibit 4 is a copy of a letter from one resident in the affected area who is opposed to this proposal. rp61\rpt \hs _prk V Permit Only Parking Near High School March 5, 1997 Page 2 In February 1990 the City Council adopted Resolution No. 90 -634 establishing a One -Hour Parking Zone on certain streets near Moorpark College. That resolution also established a program to allow for the issuance of Parking Permits to vehicles registered to the residents and property owners in the affected areas. Action to adopt this resolution was taken in response to concerns raised by the Campus Hills Homeowners' Association, speaking on behalf of the property owners and residents in the affected area. The City granted that request and established those parking restrictions, in part, because a) it had been well demonstrated that a majority of the property owners and residents were in support of the proposal; and, b) the Campus Hills HOA agreed to fund the cost of establishing this program and installing the required signs. In order to provide the City Council with certain background information regarding the establishment of permit parking areas, and the administration of the issuance of permits, certain policies and procedures are attached. Attached as Exhibit 5 is a copy of the procedures pertaining to the administration of the Permit Only Parking Program established near Moorpark College. Attached as Exhibit 6 are the procedures established by Resolution No. 93 -970 setting forth the guidelines for establishing permit only parking zones elsewhere in the City. It should be noted that the later document requires a $100 filling fee. FARBT • • It is the view of staff that a Permit Only Parking Area should not be established without first considering the likelihood that, if established in one area, the parking problem might migrate to another neighborhood. Attached as Exhibit 7 is a map showing the location of the Willows II HOA. Also shown on that map are two other areas (Creekside HOA and Tuscany HOAR where this problem is likely to occur. It is recommended that, if established, the Permit Only Parking Zone include a large enough area to adequately address the problem. t .� OWN 70.. t It is the view of staff that the best solution to this problem is for the High School to find a way to accommodate all of its parking needs on -site. Staff has been in contact with the Moorpark Unified School District to discuss means they may be considering to address this problem. In discussions between the City Manager and the School Superintendent, it was mentioned vp51 \rpt \hs _prk 4)(M V) ) Permit Only Parking Near High School March 5, 1997 Page 3 that the School District intended to expand an existing parking lot on High School Property near Mountain Trail Street by using a portion of an existing paved playground area. The Superintendent has been asked to provide the City with a letter providing details regarding this proposed project. In addition, in a recent discussion between Captain Lewis and High School staff, he was advised that the School District plans to have that parking lot ready for use on April 21st. As mentioned above, in that the establishment of a Permit Only Parking Program near Moorpark College was seen as only benefiting a specific neighborhood, the City Council determined that the costs related to the establishment of that program be funded by the Homeowners Association which requested the program. If the City Council determines that a like program ought to be established near Moorpark High School, and if it is also determined that the costs related to the establishment of that program are of specific -- not general -- benefit, the City Council could approve the program with the condition that all costs be borne by the Homeowner Associations affected. Depending on the size of the area affected, it is estimated that implementation costs could range from $500 to $2,000. With existing available resources it will be difficult to routinely monitor the proposed restricted parking area. It appears that the School District is attempting to resolve this problem by providing sufficient student parking on -site. If this solution is implemented and adequately addresses the problem, the requested parking restrictions may not be necessary. It is the view of staff, therefore, that action on the request should be deferred until after the School District has provided the above referenced additional on -site parking, and reviewed again in September 1997. Staff recommends that the request be deferred until after the School District has provided additional on -site parking, and reviewed again in September 1997. wp51 \zpt \hs_1 -k Reasons why high school parking should not be permitted in the Willows II tract: 1) It is unsafe ■ Students frequently exceed the speed limit, causing a hazard to small children and others IN Students have been observed "playing games" with their vehicles, such as blocking each other in with their cars, jumping on top of moving cars, driving with their doors open, etc. • Students make unsafe u -turns in the middle of the street and at the intersections of Willow Hill and Willow Springs and Willow Forest and Willow Springs • Students walk in the middle of the street, stand in the street to talk and sit in groups on the corners and curbs • Residents have difficulty backing out of their driveways because their vision is blocked when cars are lining the street on both sides • Students frequently block fire hydrants • Students park on the rounded curb corners, making it difficult and hazardous for cars wanting to turn onto Willow Springs to see oncoming traffic • Many drivers pile large numbers of students into their cars - more than there is room for • They pull out in front of on- coming cars 2) Students are breaking laws • They are speeding • They are parking illegally in front of fire hydrants • They are making unsafe turns in front of homes and in front of oncoming traffic • They do not obey "no parking" signs on street sweeping day ■ Some students have been observed smoking pot before and after school and during lunch breaks ■ Underage students are frequently observed smoking 3) Students are a nuisance to the homeowners • They are loud and inconsiderate. They yell, scream, laugh, play their car radios too loudly, honk their horns, squeal their brakes, and slam their car doors, usually starting as early as 7:00 AM • They congregate in groups, sitting on the curbs or corners, often times smoking and throwing dice ■ They throw their trash and cigarette butts in homeowners yards • They walk through the common areas and pull on trees, trample flowers and throw things behind the bushes • Their cars drip oil stains on the street - the street sweeper can seldom clean because they illegally park on street sweeping day • They block access to the community mail boxes • They knock over garbage cans getting out of their cars and by parking in front of all the homes, make it difficult for trash operators to reach and empty the cans High school parking in the Willows II tract has become unbearable. It has recently been brought to my attention by homeowners association representative, "Terry", that more than one petition is being circulated in my neighborhood to ban street parking during the hours of 7:00 AM to 2:00 PM weekdays, without special permit. The reason for the petition is simple. Terry told us that students from Moorpark Highschool are parking cars, littering, and doing other things to annoy the residents- on Willow Springs and Willow Hill. And I know that's true. I've seen the effects of the problem on my way to and from work. I stand with the homeowners in their concern for safety, property protection, and the need for enforcement of illegal parking. However, by enacting a parking -by- permit -only ordinance in the Willows II tract we would simply be migrating the problem from our neighborhood to another. Which means this isn't a REAL solution at all. Terry failed to tell us what the costs to homeowners would be for new signs to announce the parking ordinance. Or that we taxpayers would be obligated to increased city taxes to pay for the additional workload at the city offices to issue, control, police and renew the stickers the residents of Willows II would have to obtain. No provisions were made for or even considered with regard to the parking needs of domestic help (eg: gardeners and housecleaning services), housesitters for those who frequently work out of town, or those who occasionally bring home employer owned vehicles, or that some would not want to affix a sticker of any kind to the bumper (or elsewhere) on their vehicles. But, even more important, our adjacent tracts weren't warned that the problem would most certainly be headed their way, and increasing each year as more children leave the middle schools and begin highschool. A precedence has already been set for disobedience of city ordinances. Everyone knows the ordinances we have in place now aren't regularly enforced. While this is lost revenue to the city, manpower simply isn't sufficient to provide daily patrols. Terry told me that the city gets around to our neighborhood about once a month to check for violations. So, what assurances do the homeowners have that a new ordinance would be any better enforced? 111 1 , t z�, I know the majority of my neighbors were not presented with the pros and cons of permit -only- parking or given the time to consider how it will change their daily lives, in the forms of inconvenience and cost. They certainly didn't consider the fact that parking by permit in Willows II is not a solution for the students, our neighborhood, or our neighboring tracts. Our city tax and homeowners association dollars would be better spent on a solution that gives the students a more suitable and secure place to park and all of the residents of Mountain Meadows the freedom they deserve as homeowners to park and entertain sticker free. I do not want this to escalate into another Belmont -Home Acres dysfunctional relationship. I am convinced that, under the supervision and guidance of the Mayor and his council, the Willows II homeowners and the school district will indeed find a solution to expand the parking facilities on the Highschool site or find a park - and -ride option at another site which could accommodate the overflow parking we're seeing today and the growth of tomorrow. LICY The City Council of the City of Moorpark has adopted, and may from time to time adopt additional resolutions, which establish restricted parking zones with provisions for exemptions from the stipulated parking regulations. Examples of such resolutions are attached hereto as Exhibit 1. The parking regulations established for such restricted parking zones shall apply to all vehicles, except those vehicles which properly display a PARKING PERMIT which has been issued by the City of Moorpark in accordance with these procedures. PROCEDURES 1. These procedures shall only aR21V to certain residential properties (hereinafter referred to as "affected property ") which front upon a portion of a street subject to parking restrictions which have provisions for the granting of an exemption by means of the issuance of an appropriate parking permit. 2. Said parking restriction exemption shall only be made applicable to any given vehicle through the granting of a PARKING PERMIT issued in accordance with the procedures set forth herein. 3. Such a PARKING PERMIT may only be issued to the owner or resident of an affected property. 4. Any owner or resident of an affected property who wishes to be issued a PARKING PERMIT, must first file with the City a Parking Permit Application. 5. In order to be approved, a Parking Permit Application must state that the address of the applicant is an affected property. 6. Such Application must also contain adequate and sufficient information pertaining to the vehicle(s) to be issued permit(s). �, I Exhibit Page 1 Policies and Procedures For the Issuamce of Parking Permits to vehicles Registered to Residents of a Designated PERMIT ONLY Parking Area PURPOSE To establish guidelines and procedures for 1) the designation of PERMIT ONLY parking zones; and, 2) the issuing PERMITS exempting certain vehicles from the parking restrictions established in any such zone. POLICIES A. The City Council of the City of Moorpark has adopted Resolution No. 93 - which states the intent of the City Council to establish PERMIT ONLY parking zones in specified areas of the City. Said Resolution directs the City Manager to develop and maintain these policies, procedures and guidelines for the administration of that program. B. Resolution No. 93 - states that PERMIT ONLY parking shall be made applicable to certain specified areas or neighborhoods upon adoption of a Resolution of the City Council. It is the intent of the City Council to only enact such restriction upon receipt of a request to do so from the residents of the area to be affected, unless otherwise determined necessary for the public health, safety or welfare of the Community. In order to be considered, any such request shall be in the form and shall meet the minimum requirements of the applicable Procedures set forth herein. C. Whenever a PERMIT ONLY parking zone is established by resolution of the City Council, the parking restrictions set forth in Resolution No. 93 - shall apply to all vehicles except those vehicles which properly display a PARKING PERMIT issued by the City of Moorpark in accordance with the applicable procedures set forth herein. prk cwd Exhibit iW Page 2 A. Establishment of a PERMIT ONLY Parking Zone 1. Pursuant to the provisions of Resolution No. 93- , the City Council may adopt resolutions designating certain areas as PERMIT ONLY parking zones. 2. Said Resolution provides for the pre- designation of the areas or neighborhoods to be considered for PERMIT ONLY parking. Those areas [hereinafter referred to as "area (a)] are identified on the map attached hereto as Exhibit 'A'. 3. Upon receipt of a request that an area be designated a PERMIT ONLY parking zone, the City Council may consider adoption of a Resolution so designating said area. In order to be considered, such request must have been presented by a group duly representing the owners and residents of said area. For the purposes of these Procedures, a group deemed to be duly representing the owners and residents of an area shall be defined as one of the following: • the Board of Directors of the Homeowners Association for the area; or, • the holder(s) of a petition signed by at least ten percent (10 %) of the owners and /or residents of said area. 4. Any such request must be accompanied by a mailing list of all of the property owners and residents within the area. Upon receipt of any such request, a public hearing shall be scheduled before the City Council to consider adoption of a Resolution designating the area in question a PERMIT ONLY parking zone. Public Hearing Notices shall be mailed to all of the owners and residents within said area, advising them of the proposed action. 5. In order to be considered, any such request must be accompanied by a one hundred dollar ($100) filing fee dUosit to cover the cost of evaluating the application and the administering the public hearing. The actual amount of the filing fee shall be an amount equal the number of lots in the area multiplied by fifty cent ($0.50), provided that the minimum fee shall be one hundred dollars ($100) and the maximum fee shall not exceed two hundred dollars .($200.00). prk cwd •(MILO7 Exhibit b Page 3 Public Hearing administrative costs may include, but may are not limited to the following: • verifying the public hearing mailing list, • preparation of the Public Hearing Notice, • postage, paper and envelops, plus • a fifteen percent charge for administration and overhead. 6. Subsequent to the receipt of written and /or oral testimony at or prior to the public hearing, the City Council may take action to adopt, or not to adopt, a resolution designating the subject area as a PERMIT ONLY parking zone. 7. Whenever any such resolution is adopted, the City Manager shall place signs giving notice of the parking restriction established by Resolution No. 93- , and advising that vehicle properly displaying PARKING PERMITS are exempt from said parking restrictions. B. Issuance of Parking Permits 1. Whenever a PERMIT ONLY parking zone [hereinafter referred to as "zone (s) ] is established pursuant to applicable provisions set forth herein, property owners and /or residents of said zone may apply for one or more Parking Permits to exempt their vehicle(s) from the parking restrictions applicable to said zone. 2. Whenever a parking permit is issued pursuant to these provisions, the vehicle to which said permit is issued shall be exempt from the parking restrictions set forth in Resolution No. 93 - and /or any amendment thereto. Whenever the term "Dermit(s) is used in these policies and procedures, said term shall mean a permit issued to a particular vehicle for the permit period as defined herein. Said term shall not apply to Guest Permits. 3. Permits shall only be issued to vehicles registered to the owner or resident of property located within a zone. 4. Permits shall only be issued subsequent to the City's review and approval of the information set forth in a Parking Permit Application [hereinafter referred to as "Application(s)]. In order to be approved, an Application must state, contain or be accompanied by the following information: a. the license number of the vehicle to be exempt; b. documents which sufficiently prove that the address of the registered owner of the vehicle is within a zone; c. documents and /of information which clearly demonstrates that there are at least four (4) other vehicle registered to individuals residing at the address of the registered owner of the vehicle to be issued a permit. d. a permit application fee equal to twenty -five dollars ($25.00) per permit. 6. A permit may only be issued to a vehicle when and if there are at least four (4) other vehicle registered to individuals residing at said address. 7. No more than four (4) permits may be issued to any one address. 8. Permits may only be issued to specific vehicles. The Application shall clearly indicate the license number of the vehicle to be issued a permit. Permits are non - transferable and shall be affixed to the vehicle at the left rear bumper of the vehicle, or at another suitable location subject to the approval of the City. 9. At the sole discretion of the City, an applicant may be required to present documents which clearly verifies the information required by the Application (i.e. vehicle registration, proof of residency, etc.). 10. Permits shall be valid for the period specified on the approved Application. The permit expiration date shall be 30th day of June of the permit period stated on the Application. Applications for permit renewal should be submitted to the City by April 30 of said year, in order to allow adequate time for the processing and issuance of renewed permits. 11. A Permit issued pursuant to these procedures shall not be effective unless said permit is attached to the left rear of the vehicle. prk cwd `"zo9 Exhibit 6 Page 5 12. Issuance of a Permit to a vehicle shall not exempt said vehicle from any provision of any other City regulation or any provision of the California Vehicle Code. 13. Permits shall not be issued to any over weight vehicle as defined by City Ordinance or the California Vehicle Code. Permits shall not be issued to commercial vehicles or to vehicle with business identification appearing on said vehicle. 14. Prior to issuance of any permit, the applicant shall pay a $25.00 permit fee for each permit issued, except that there shall be NO CHARGE for the first permit issued to the subject address. 15. The permit fee may be waived upon documentation of hardship in accordance with established policies of the City. 16. A Guest Permit may be issued to a specific vehicle not registered�to an individual residing at the address of the applicant, provided that the applicant demonstrates that there are at least four (4) other vehicle registered to individuals residing at the address of said applicant. The maximum number of Guest Permits which may be issued for any one period of time shall be six (6). The maximum number of times Guest Permits may be issued to any one address shall be two (2). Guest Permits shall be valid for a maximum period of ten (10) days. A Guest Permit shall be place in the left rear window of the vehicle.
