Subject: Consider Request to Import and Stockpile 18,000 cubic
yards of soil (Marketplace Properties)
Background
On May 23, 1996 the City Council approved Tentative Parcel Map 5001 for
the property at the northeast corner of Tierra Rejada and Spring Road. The
tentative map indicated that roughly 12,000 cubic yards of soil would
need to be imported to grade the site. The maximum height of fill would
be approximately 5 feet.
Carlsberg Tract 4974, immediately to the east of the subject site, has
dedicated property to the Ventura County Water Works District for the
construction of a water tank site. Grading on the water tank site will
produce an excess of roughly 18,000 cubic yards of soil that needs to be
exported in late March
On March 3rd, 1997 the City received a request from Marketplace
Properties that they be allowed to receive and stockpile the soil that will
be exported from the water tank site (letter attached). As of this date no
grading plan has been received for the Marketplace site but the applicant
has submitted a proposed stockpile plan (attached).
Discussion
Marketplace Properties has indicated that it is their plan to go forward
with developing the KinderCare portion of the site as soon as a contract is
signed. The start of construction date, however, is uncertain. Due to the
immediate availability of the soil it is the applicant's desire to receive
and stockpile the soil until the grading plan is approved, at which time it
will be spread and graded per the approved plan. As such, the applicant
has requested that they be allowed to temporarily stockpile the soil for an
indefinite period (see revised request letter dated March 7, 1997).
The applicant's engineer has stated that he is currently working on the
grading plan for the site and that it should be submitted to the City for
review shortly. He has also reevaluated the preliminary grading estimate
and feels that the development will be able to utilize all 18,000 cubic
yards on site due to anticipated shrinkage of the compacted soil.
The proposed location of the stockpile will be the southerly portion of the
Marketplace site, to a maximum height of approximately 10 feet with
positive drainage to the southeast. Sandbags are proposed to control
erosion. The existing drainage basin at the southeast corner of the site is
shown to be left undisturbed.
The truck haul route proposed by the Water Works District will be Peach
Hill Road to Spring Road. Direct access from the Carlsberg site is
apparently not possible due to the saturated condition of the site. It is
proposed that hauling of soil commence late March and should take 2
weeks. Between 1200 and 1800 truck trips will be necessary.
Grading plan check fees and inspection deposits will be required based on
the yardage of soil imported. A surety is also typically required for such
work, based on cost, should the city have to remove the soil or finish the
grading if the developer, for any reason, is unable to. Staff would also
suggest that, as part of the temporary stockpile permit, the applicant
remove the existing slab and chimney on the site. The estimated cost to
remove and export the stockpile, remove the chimney and slab, repair the
fence and clean up or repair city property, if necessary is estimated to be
$95,000 plus a 10% contingency. However, the developer has requested
that they only be required to bond for the spreading of the soil - not for
import/export and that all sureties be released immediately upon
completion of the stockpile. Excluding the cost of import /export would
reduce the estimate to $38,000 plus a 10% contingency. It is the
applicant's contention that there will be no need to export the soil
because the site will need this much earth for future development, even if
he is unable to finish grading and the property is developed by someone
else.

It is staff's opinion that the stockpile, as proposed, is visibly too high and
abrupt and, if left uncompacted, unstable to leave indefinitely. If
vegetation doesn't take, sandbags deteriorate, fill slopes collapse, etc.
site drainage also may be adversely impacted. A more appropriate stock
pile plan might be one that more closely reflects grading as shown on the
tentative map, is less visibly obtrusive and is more stable. It is
recommended the following conditions be attached to the issuance of a
temporary stockpile permit:
Special Conditions
• Applicant shall submit a surety equal to $95,000 plus 10%
contingency for import operations (10% of which is to be
retained until such time that final grading and compaction of
the site is approved by the City). In addition to all
import /export operations, surety shall also cover the repair
and maintenance of a 6 foot high fence in good condition around
the perimeter of the property.
• Maximum height of the temporary stockpile shall not exceed 5
feet.
• Fill slopes shall not exceed 4:1.
• Stockpile area shall be sandbagged and seeded for erosion
control.
• Weekday truck traffic on Peach Hill Road shall be limited to
the hours of 9:15 a.m - 3:00 p.m
• All streets shall be cleaned daily or as requested by the City
Engineer.
The existing drainage channel shall be protected and
unobstructed.
• The existing slab and chimney shall be removed from the site
prior to the import of soil
Summary
Due to the immediate availability of soil from the Carlsberg site and the
need for soil at the Marketplace Properties site, the applicant is
requesting that they be allowed to import and stockpile 18,000 yards of
soil for an indefinite period. This soil is proposed to be used for site
development by the applicant after a grading plan is approved. The
applicant anticipates that construction may commence within the year.
Standard grading plan check fees and inspection deposits will be required
for the import and stockpile. The applicant, however, requests that he not
be required to provide surety for the cost of exporting /importing soil. He
also requests that all sureties be released upon completion of the
stockpile.
Staff feels that a less abrupt stockpile than the one proposed, one more
reflective of the approved tentative map, should be placed and that a full
surety for all work, including import /export costs, and a reduced surety
for maintenance should be provided
Recommendation:
Authorize staff to issue a temporary stockpile grading permit for the
import of 18,000 yards of soil at the Marketplace Properties site, for an
indefinite period of time, subject to all standard plan check and
inspection fees and each of the special conditions discussed.

Please accept this letter as a revised request of the property owner, Marketplace Partners
3, L.P., to stockpile up to 18,000 cubic yards of dirt on the above - referenced property.
As stated in your conversation with Mike Rue on March 5th, we are requesting that we be
allowed to stockpile up to 18,000 cubic yards per the grading plan sent to you by Tony
Favreau for an indefinite period. We will post a bond to make sure that the dirt is
stockpiled per the plan. The bond will be released once the stockpile is complete and no
further bonding required
